According to Article 38 of the Act on Real Estate Management (Journal of Laws of 2024, item 1145 as amended), I announce the first unlimited oral auction for the sale of real estate owned by the municipality of Orzysz located within the boundaries of the town of Orzysz. 1. The subject of the sale is undeveloped land consisting of a plot marked with the geodetic number 195/2 with an area of 0.1982 ha in the geodetic area of Ublik, gm. Orzysz. 2. In the local spatial development plan of the Nowe Guty area, gm. Orzysz, the property is marked with the symbol ZS - 1 – green areas related to sports, tourism, and recreation. 3. The property has been included in the list no. WIG.6840.3.2025.KOW dated June 23, 2025, made public on June 23, 2025. 4. The plot has an established land and mortgage register – OL1P/00028521/4. 5. Description of the property: The property is located in the area of compact development of the village of Ublik, gm. Orzysz. The plot borders the area of Lake Ublik Wielki and the main public road in the village and residential areas. The property has direct access to the public road and has an irregular shape. Electric, water, and sewage networks run along the plot. Uses: LzV – wooded and shrub-covered land, Lzr-PsIV - wooded and shrub-covered land in pastures. 6. The starting price of the property: 463,000.00 PLN gross. 7. The auction will take place on September 8, 2025, at 1:00 PM at the City Hall in Orzysz, room no. 113 (meeting room). 8. Deposit: 46,000.00 PLN. 9. The condition for participating in the auction is to pay the deposit to the account of the City Hall in Orzysz Warmińsko Mazurski Cooperative Bank Branch in Orzysz account number 02 9364 0000 2003 0001 9817 0007. The deadline for paying the deposit to the above account is by September 4, 2025. The date of payment is considered the day the account of the City Hall in Orzysz is credited with the deposit amount. In the title of the transfer, the geodetic number of the property and its location must be provided. 10. The minimum bid increment in the auction is 4,630.00 PLN. Participants in the auction submit oral successive bids, which cannot be lower than 4,630.00 PLN. 11. The candidate for the buyer of the above property is the person who offered the highest price. 12. The deposit of the participant who wins the auction will be credited towards the purchase of the property. 13. The deposits of other participants will be returned within 3 days from the date of closing or canceling the auction. 14. In the event of the participant who won the auction failing to conclude the sale agreement within the time specified in the notification, the paid deposit will be forfeited to the Municipality of Orzysz. 15. The transfer of ownership will take place in the form of a notarial deed drawn up at the Notary Office after the protocol from the auction is prepared. The costs of the notarial deed are borne by the buyer. 16. The organizer of the auction will notify the participant who wins the auction about the place and date of the notarial deed of the sale agreement within 21 days from the date of the auction resolution. 17. The buyer should pay the auction price before signing the notarial deed to the account specified in the protocol from the auction no later than the day before signing the notarial deed. 18. The marking of the property boundaries will be done at the buyer's expense and effort. 19. The auction will end with a negative result if none of the auction participants offers a price higher by at least one increment from the starting price stated in the announcement. 20.
