Targowa 18 ANNOUNCES AN AUCTION FOR THE SALE: The right of perpetual usufruct of the real estate with an area of 499 m² and the ownership rights of buildings and structures located on the land located in Zgierz, ul. Mysliwska 1a, plot no. 209, precinct 130. I. Auction organizer and property management unit Polska Spolka Gazownictwa sp. z o.o. Branch Gas Plant in Lodz, 90-042 Lodz, ul. Targowa 18. II. The subject of the auction is: ◦ the right of perpetual usufruct of the land marked in the land register as plot no. 209, precinct 130, with an area of 499m², for which the District Court in Zgierz, V Land Registry Department maintains land and mortgage register LD1G/00000250/5, ◦ ownership rights of buildings: ▪ office-administrative building with a usable area of 149.57 m², ▪ social-storage building with a usable area of 108.29 m², ◦ ownership rights of structures located on the land that are separate from the land. III. Property description: The property is located in the Lodz Voivodeship, Zgierz County, city of Zgierz, at ul. Mysliwska 1a. In the vicinity of the property, there are areas of single-family residential development. To the west of the property, approximately 50 m away, is ul. Lodzka, which is a section of national road no. 91 (in the direction of Gdansk - Lodz - Cieszyn). The plot has direct access to the neighborhood road ul. Mysliwska with a dirt surface. The property is built with: an office-administrative building, a social-storage building, and other structures (supporting infrastructure) located on the land and permanently connected to it. Brief characteristics of the buildings: • Office-administrative building: 3-storey, non-basement, without an attic, brick building made of ceramic brick and block, usable area 149.57 m². In the basement of the building, there are a garage, archive, boiler room, and utility rooms, on the ground floor and first floor there are office and social rooms. Communication between internal levels is via stairs in the central part of the building. • Social-storage building: 1-storey above ground, unventilated insulated flat roof, brick building made of ceramic brick and block, usable area 108.29 m². The building contains social, office, storage rooms, and a garage. The property is fenced and completely paved with concrete block surface. The plot is rectangular, does not show changes in height - the area is flat. The property is equipped with the following installations: electrical, water supply, sewage, telecommunication, gas. No industrial activity that could cause soil contamination has been conducted on the property. The property is not subject to conservation protection. No administrative or court proceedings are being conducted regarding the property that could change its legal status. No simplified forest management plan has been developed for the property, nor has an administrative decision been issued regarding forest management, and it is not located in degraded and revitalized areas due to the lack of a resolution of the Zgierz City Council, as mentioned in the Act of October 9, 2015, on revitalization (Journal of Laws of 2021, item 485). The property is located in an area where there is no local general spatial development plan for the city of Zgierz. According to the current Study of conditions and directions of spatial development of the city of Zgierz, the resolution No. XI/120/15 of the Zgierz City Council of August 27, 2015, the subject plot is located in unit 22/MN - areas of single-family residential development. The property is equipped with water supply, gas, electricity, and telecommunication networks. The buildings are equipped with internal installations: electrical, water-sewage, gas, heating, gravity ventilation. On the land property, there is a low-pressure gas steel connection DN40 running from the southern boundary of the plot to the social-storage building. The property is fenced, but the location of the fence may not coincide with the geodetic boundary, which the buyer acknowledges and will not make any claims against the Seller for this reason. No industrial activity that could cause soil contamination has been conducted on the property. IV. Polska Spolka Gazownictwa sp. z o.o. reserves that the sales agreement will include provisions: ◦ "The buyer declares that they fully accept the factual and legal state of the property, and that during the period between the conclusion of the agreement transferring the right of perpetual usufruct and the entry of the buyer into the land and mortgage register, they assume all responsibility for the property and potential claims that may arise during this period", ◦ "The buyer declares that they are aware of and fully accept the factual and legal state of the property, particularly its area, boundary course, access and access to the public road, type of use, boundary course, purpose of the property, technical condition of the property and the buildings located on it and will not make any claims against the Seller - the company named: Polska Spolka Gazownictwa Spolka z ograniczona odpowiedzialnoscia based in Tarnow, in the event that as a result of the surveyor's renewal of the boundaries of this property/other works, changes are shown on the property compared to the data from the land and building register on the day of sale", ◦ "The buyer declares that they are aware of the technical condition of the property and does not raise any comments or objections in this regard. The buyer waives and will not pursue any claims against - the company named: Polska Spolka Gazownictwa Spolka z ograniczona odpowiedzialnoscia based in Tarnow, in connection with the possible presence of unregistered network infrastructure or protective zones on the property", ◦ "The buyer declares that the established price will exhaust all claims arising from the conclusion of this agreement and that they will not make any other claims against the seller in this regard", ◦ "The buyer declares that to the extent permitted by law, they waive all claims that may be due to the buyer against the seller of the company named: Polska Spolka Gazownictwa spolka z ograniczona odpowiedzialnoscia based in Tarnow, including warranty claims for defects and assumes exclusive responsibility", ◦ "The buyer establishes in favor of Polska Spolka Gazownictwa sp. z o.o. based in Tarnow a free and unlimited in time easement for the low-pressure gas connection DN40 running from the southern boundary of the plot to the social-storage building", ◦ "The buyer declares that they undertake to return the fee paid by Polska Spolka Gazownictwa sp. z o.o. for the perpetual usufruct of the land proportionally for the period from the date of signing the sales agreement for the property covered by KW no. LD1G/00000250/5 until the end of the year", V. Legal status of the property: The legal status of the auction subject is regulated. The District Court in Zgierz, V Land Registry Department maintains land and mortgage register no. KW LD1G/00000250/5 for plot no. 209. The owner of the land is the Municipality of the City of Zgierz, the right of perpetual usufruct of the land belongs to Polska Spolka Gazownictwa sp. z o.o. until September 4, 2082.
