1. The bankruptcy trustee Krzysztof Wolowiec, whose bankruptcy proceedings are conducted by the District Court in Kielce under case number KI1L/GUp/14/2025, announces the possibility of selling a 1/2 share in the cooperative ownership right to the residential unit marked number 15, located in building number 8 Os. Na Stoku in Kielce, for which there is a land and mortgage register KI1L/00167935/8 (hereinafter referred to as the 'Unit', and the share as 'Share in the Unit'), with a usable area of 58.80 m2.
2. The sale will take place for a price not less than 149,850 PLN (one hundred forty-nine thousand eight hundred fifty PLN).
3. The above-mentioned right to the share in the Unit has been included in the inventory list prepared by the bankruptcy trustee Krzysztof Wolowiec under number 2.1, filed in the bankruptcy proceedings. The description and valuation of the Unit were submitted to the bankruptcy proceedings on March 19, 2025, under number 9. The notice of submitting the description and valuation to the judge-commissioner appeared in the National Register of Debtors on March 20, 2025. No objections were made to the description and valuation. By order of June 5, 2025, the judge-commissioner agreed to sell the Share in the Unit freely, for a price not less than indicated above.
4. The description and valuation of the sales item are also available for inspection at the office of the bankruptcy trustee, ul. Wesola 51/328, 25 - 363 Kielce, on weekdays from 9:00 AM to 3:00 PM. After scheduling with the trustee an appropriate date, it is possible to inspect the Unit.
5. The sale will take place in the condition in which the share in the Unit and the Unit will be at the date of the sales agreement. The buyer will not have any claims against the seller for defects (exclusion of the seller's liability for warranty relating to the object of the sale).
6. The sale will take place with effects resulting from Article 313 sections 1 and 2 of the Bankruptcy Law, in particular, the sale made in bankruptcy proceedings has the effects of enforcement sale.
7. The conclusion of the sales agreement will occur on the condition that the other co-owner of the cooperative ownership right to the residential unit does not exercise their right of first refusal resulting from Article 17(2) section 6 of the Act of December 15, 2000, on housing cooperatives.
8. Offers should be submitted by June 25, 2025, by 2:00 PM, at the address of the Trustee's Office Robert Pabis: ul. Wesola 51/328, 25 - 363 Kielce. Offers may be submitted by registered mail, courier, or in person, provided that in each case the date and time of submission are determined by the date and time of its delivery to the above address.
9. The offer should include: a) the identifier of the bidder; first name and last name or the name of the company and address or registered office of the bidder, phone number, email address, b) in the case of legal entities or organizational units not possessing legal personality - a current excerpt from the relevant court register, c) in the case of natural persons - a notarized copy of the document confirming identity (partial anonymization of part of the data is allowed), and if applicable - a certificate of registration in the business activity register, d) indication of the purchase price. The price should be expressed in a clear and unambiguous manner, numerically and in writing, e) in the case of an offer submitted by an attorney, a power of attorney document in the original or a notarized copy must be attached.
10. In the case of receiving a larger number of offers, an oral auction will be organized at the trustee's office among interested bidders. Information on the place, date, and time of the auction will be communicated directly to bidders via email. The trustee may condition participation in the auction on the payment of a deposit.
11. Notary costs are borne by the buyer.
12. The trustee - until the selection of the offer - reserves the right to annul the sale proceedings without giving reasons. | Seller: r.pabis |
