The bankruptcy trustee Justyna Kucejko-Kowalczyk conducting the bankruptcy proceedings of an individual in bankruptcy case no. LD1M/GU/636/2025 announces the sale by free hand in the form of a tender, for the highest offered price, not lower than 181,500 PLN (in words: one hundred eighty-one thousand five hundred zlotys). 1) ½ share in the ownership right to the local property located in Lodz at Lanowa 20A m72 with an area of 44.70m2, located on the third floor. 2) For the local property, in the District Court for Lodz-Srodmiescie in Lodz, XIV Land and Mortgage Register Department, KW No. LD1M/00335421/8 The residential unit consists of 2 rooms, a kitchen, a bathroom with a toilet, and a hallway. Based on the decision of the District Court for Lodz-Srodmiescie, XIV Economic Department for Bankruptcy and Restructuring cases in case no. LD1M/GU/636/2025, the trustee invites offers - starting price 181,500 PLN (in words: one hundred eighty-one thousand five hundred zlotys gross). The following conditions must be met: 1. Participants in the competition may be domestic and foreign natural and legal persons as well as organizational units with legal capacity and capacity to perform legal acts. Foreign entities must have the consent of the minister responsible for internal affairs to acquire real estate, in accordance with the applicable provisions of the Act of March 24, 1920, on the acquisition of real estate by foreigners (consolidated text - Journal of Laws of 2017, item 2278). 2. The offer must be submitted in writing only in Polish, in person or by mail - registered letter, in a sealed envelope with a clear note: "Offer for the sale of bankruptcy estate components case no. LD1M/GU/636/2025 - DO NOT OPEN" by August 18, 2025, by 10:00 AM at the Trustee's Office in Lodz, ul. Radwanska 22 lok 2, 90-541 Lodz. The offer must include proof of payment of the deposit, in the amount of 10% of the estimated value to the bankruptcy estate bank account at BNP PARIBAS: 29 1600 1143 1776 8217 2000 0001. 4. The written offer, under penalty of rejection, should include: a) the company and registered office, and for natural persons - the first name, surname, and address of the offeror, b) in the case of offerors who are not natural persons, an up-to-date excerpt from the relevant register documenting the right to make binding declarations of intent on behalf of the entity by the person who signed the offer, and if the offer is signed by an attorney, also the power of attorney signed in accordance with the rules of representation. The power of attorney to participate in the tender and to make declarations required by these sales conditions should be confirmed by a document with a notarized signature. Powers of attorney granted to lawyers or legal advisors do not require certification. Foreign attorneys must submit confirmation of their registration on one of the lists of foreign lawyers maintained by the regional bar councils or the councils of regional chambers of legal advisors in Poland. c) the offered purchase price expressed in figures and words, which cannot be lower than the indicated starting price, the method and deadline for its payment d) the buyer's obligation to cover the costs, taxes, and fees related to the conclusion of the contract e) a statement that the offeror has familiarized themselves with the factual and legal state of the subject of sale, accepts it, does not raise any objections to it, and waives any future claims in this regard, and also that there are no factual or legal reasons that would limit or prevent the conclusion of the contract in the event of the selection of their offer f) proof of payment of the deposit and indication of the bank account number to which the deposit should be returned in case the offer is not accepted g) a statement of readiness to conclude the contract in case of winning the tender, at the place and time indicated by the trustee h) a statement of having read the sales regulations (tender) and accepting them without reservations i) all permits and consents, if required by law due to the buyer's identity j) the offeror must document that they have the financial means to make the purchase. 5. The offer or any statement contained therein cannot be submitted conditionally, subject to a deadline, nor can they be variant. The participant in the tender is bound by the offer until the expiry of the deadline set by the trustee for the conclusion of the contract. 6. The sale price of the property, reduced by the paid deposit, must be paid and credited to the bankruptcy estate bank account no later than one day before the conclusion of the sale contract. 7. All costs of concluding the sale contract, including the civil law transaction tax, notary and court fees, are borne by the buyer. If the provisions of the VAT Act provide for it, VAT will be added to the sale price. Upon the conclusion of the sale contract in the form of a notarial deed, the buyer acquires the benefits, taxes, and other public dues due from the subject of sale; non-recurrent public law obligations are borne by the buyer only if their payment falls on the day of the conclusion of the sale contract in the form of a notarial deed or after that day. 9. The trustee reserves the right to cancel the competition, withdraw from the competition, and withdraw from the sale at any stage without giving reasons and without public notification, as well as to change the announcement or change the conditions of the competition.
