SECOND ELECTRONIC AUCTION OF REAL ESTATE
described as plots with registration numbers 63, 97, located in the village of Zdzary-Brzczyny, Pionki municipality, for the property, the District Court in Kozienice maintains land and mortgage register No. KW RA2Z/000xxxxx/4. On February 2, 2023, the Mayor of Pionki issued a certificate with reference number KIP 6727 20 2023, informing that for plots No. 63, 97 located in the registration area of Zdzary-Brzeziny:
- there is no local spatial development plan;
- the purpose of the property in the Study of conditions and directions of spatial development adopted by the resolution of the Pionki Municipality Council No. Xl 11'259/2014 of September 2, 2014 Plot No. 63: ZN areas of natural greenery, tree stands, and arranged greenery playing an important role in the ecosystem of the municipality. R agricultural areas. Plot No. 63 with an area of 1.9900 ha in the shape of a rectangle with a width of about 19 meters and a length of about 1017 meters, in the northern part there is a pond and it is partially fenced with woven wire on metal posts. The plot is used for agricultural purposes, field work has been done. From the north, an overhead power line SN runs over the plot, but there are no poles on the plot. The plot is undeveloped, used for agricultural purposes. From the south, the terrain gently rises to the middle and then descends.
Plot No. 97 with an area of 0.2200 ha in the shape of a rectangle with a front width of about 17 meters and a length of about 12.5 meters The plot is undeveloped, unfenced, and unarranged. Along the northern border, an overhead power line SN runs over the plot and there is a pole on the plot. At the front of the plot, there is a municipal sewage pumping station and there is a stench. At the front on the left side, there is a neighbor's fence and there are also walls of buildings located on the neighboring plot. The terrain of the plot is flat with a slight slope towards the ditch. Plot No. 63 has no access to public roads. The shorter sides of the plot from the north and south adjoin plots No. 260 and No. 266/1 marked as use 'w', which are ordinary drainage ditches on the surface.
Plot No. 97 on one side from the south adjoins a road with a bituminous surface plot No. 594/1 marked as use 'dr' owned by the Radom County. On the other side, the plot adjoins the ditch of plot No. 266/1, marked as use 'w'.
The property is valued at: 115,000.00 PLN. The starting price in the above auction is: 2/3 of the valuation value, i.e. the amount of 76,666.67 PLN.
Those participating in the auction are required to submit a deposit of 10% of the estimated value of the property: 11,500 PLN. The deposit must be submitted to the bailiff's bank account 87 2030 0045 1110 0000 0210 0820 no later than 2 business days before the auction begins. The sale is conducted by electronic auction.
Participation in the auction requires creating an account on the information technology site servicing electronic auctions available at s:.elicytacje.komornik,pl and joining the auction two business days before it begins. The bidder submits the deposit no later than 2 business days before the auction begins, and if participating in the auction as an attorney for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.
Based on Article 986 of the Code of Civil Procedure, the condition for participation in the auction is the creation of an individual account in the information technology system.
The auction of the above-mentioned property takes place electronically and will end on: 12.12.2024 at 12:00.
Based on Article 986 of the Code of Civil Procedure, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes, if further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes until the bids cease. For two weeks before the auction, the above-mentioned property can be viewed on weekdays from 10:00 to 16:00. The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations if these persons do not submit proof before the auction begins that they have filed a lawsuit to release the property or items seized with it from enforcement and obtained a ruling suspending the enforcement in this regard. Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction begins, will not be considered in the further course of enforcement and will expire upon the finalization of the ruling on the awarding of ownership to the content of Article 976 of the Code of Civil Procedure. The debtor, bailiff, their spouses, children, siblings, and persons present at the auction in an official capacity cannot participate in the auction, nor can a bidder who has not fulfilled the conditions of the previous auction.
