"§ 34. 1. Mixed-use development areas are designated – RESIDENTIAL, SERVICE, PRODUCTION (MR: MR1, MR2).

2. The primary purpose of the areas is free-standing single-family residential development along with non-intrusive service and production development.

3. The permissible purpose of the areas is: (...)

"The following conditions for land development for MR2 areas are established:

1) the areas of newly designated plots must not be smaller than 1500 m2;

2) the maximum height of residential buildings – 9 m; (...)

4) permissible indicators of building area and biologically active area: a) the building area ratio must not exceed 40% of the investment area, b) the biologically active area ratio must not be less than 50% of the investment area, c) if the existing building ratio is exceeded, there is a ban on increasing the building area."

  • Purpose R2

"§ 47. 1. AGRICULTURAL AREAS are designated (R1, R2).

2. The primary purpose – arable land: 1) agricultural land; 2) vegetable, flower crops; 3) green areas; 4) orchards, gardens.

3. The permissible purpose: (...).

4. In R1, R2 areas, the possibility of year-round vegetable and plant cultivation is allowed, including in heated covered facilities;

5. The following conditions for land development are established, subject to paragraph 6:

2) for residential buildings: a) the maximum height of buildings – 9 m; b) roof shape – (...)

3) in R2 areas, there is a ban on the basement of the building and the location of the ground floor level below a minimum height of 0.5 m above ground level;

6. In the height restriction zone for objects and development designated in connection with the approach areas to the airport in Pobiednik Wielki, marked on the Plan Drawing, there is a requirement to maintain the height of farm buildings, i.e. residential buildings, farm buildings, and facilities and devices related to agriculture, vegetable growing, gardening, breeding, and husbandry, to a maximum of 7 m height.
