The bankruptcy trustee informs about the sale of 3/4 of residential unit number 47, which constitutes a separate property, recorded in the land and mortgage register number GD1Y/00107597/9, maintained by the District Court in Gdynia, V Land and Mortgage Register Department, located in Gdynia, at ul. Sojowa 33B, with a usable area of 41.94 m2 along with a share in the common property, which consists of land and parts of the building and devices that are not exclusively for the use of the owners of the units in the amount of 70/10000 parts, recorded in the land and mortgage register number GD1Y/00078406/1

The subject of the sale is 3/4 of the residential unit located in Gdynia, with a usable area of 41.94 m2.

The Land and Mortgage Register Department of the District Court in Gdynia maintains the land and mortgage register no. GD1Y/00107597/9.

2. The starting price of the item specified in point 1 is 200,900 PLN

3. Written offers should be sent to the address of the trustee's office, ul. Batorego 23/7, 81-365 Gdynia or via email: trojmiasto@jkk-polska.pl, by 29.08.2025. Offers submitted after the deadline will not be considered. The date of physical receipt of the offer by the trustee is decisive.

The offer should also include the contact details of the bidder, especially the phone number. Additionally, the offer should include a statement of the validity of the offer for a period of 90 days from the date of submission.

Offers for amounts lower than the starting price mentioned in point 2 will not be considered.

If two offers of the same amount or the difference between the two highest offers is not greater than 5,000 PLN, the trustee will conduct a telephone auction between the bidders.

The trustee reserves the right to freely choose the offer and the right to cancel the bidding process without giving a reason.

4. Signing the purchase agreement: The bidder whose offer is selected is obliged to pay a deposit of 10% of the price immediately after the selection of the offer and to sign the agreement and pay the remaining part of the price at least 5 days before the sale date (notarial deed). The costs of the agreement are borne by the buyer.

6. Other conditions:

- Submission of an offer is simultaneously a statement that the bidder agrees to the conditions specified in these regulations, including the exclusion of liability for defects and limitation of the seller's liability for improper performance of the contract.

- Additionally, submission of an offer is tantamount to the bidder stating that they are fully aware of the physical and legal condition of the item for sale and do not raise any objections to it.

- Submission of an offer is tantamount to the bidder stating that they have read the sales regulations and do not raise any objections to its terms.

- Submission of an offer is tantamount to the bidder stating that they agree to the conditions specified in the regulations, including the exclusion of liability for defects.

- All costs of concluding the sales agreement are borne entirely by the buyer, in particular the costs of the notary and court.

- The seller does not provide any guarantees and excludes liability for defects in the property.

- The trustee is liable for improper performance of the contract only if the damage occurred due to their gross negligence and within the limits of actual damage.

- Liability for improper performance of the contract is completely excluded due to the technical condition of the property.

7. Additional information:

• The bankruptcy estate of Tomasz Pietruszewski includes a share of 3/4 in the residential unit located at ul. Sojowa, covered by the land and mortgage register no. GD1Y/00107597/9, maintained by the District Court in Gdynia.
• The co-owner of the above unit is also the son of the bankrupt, who has a share of 1/4.
• Based on the statement of the co-owner - son, the trustee's office informs that there is a willingness to sell his share (1/4) along with the sale of the share belonging to the bankruptcy estate (3/4).
• As a result, it will be possible to acquire 100% ownership rights to the subject residential unit by one buyer.

The trustee informs about the content of Article 1013 of the Code of Civil Procedure in connection with Article 313 of the Bankruptcy Law:

Article 1013 [Maintenance of mortgage burdens entered before the establishment of co-ownership] The decision on the adjudication of ownership of a fractional part of the property does not violate the burdensome mortgages entered before the establishment of co-ownership.
