Court Bailiff at the District Court in Bartoszyce Mariusz Golawski Bailiff Office No. 1 in Bartoszyce 11-200 Bartoszyce, Ketrzynska 25b/2 Km 1885/19 NOTICE OF SECOND AUCTION OF REAL ESTATE Court Bailiff at the District Court in Bartoszyce Mariusz Golawski, based on Article 953 of the Code of Civil Procedure, announces to the public that: WE ARE WAITING FOR THE SETTING OF THE II AUCTION DATE at the District Court in Bartoszyce 11-200 BARTOSZYCE, Warszawska 3, BARTOSZYCE will take place THE SECOND auction of the property which is an undeveloped land property located in the area No. 53 Plęsy in the municipality of Bartoszyce, consisting of land plot No. 52/2 with an area of 1.3446 ha, located at: 11-200 Bartoszyce, Plęsy, for which the Land and Mortgage Register Court maintains the land and mortgage register No. KW OL1Y/000xxxxx/3 The estimated value is 55,000.00 PLN, while the starting price is equal to 2/3 of the estimated value and amounts to 36,666.67 PLN. A bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is 5,500.00 PLN. The deposit should be made in cash or in a savings book of banks authorized under banking law, equipped with the owner's authorization to withdraw the entire deposit according to the legally binding court decision on the loss of the deposit. The deposit can also be paid to the bailiff's account: Bank Millennium 22 1160 2202 0000 0000 6191 1337 no later than the day before the auction. According to Article 976 §1 of the Code of Civil Procedure, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission, as well as other persons mentioned in this article, cannot participate in the auction. In the two weeks prior to the auction, the property can be viewed on weekdays from 08:00 to 15:00 and the protocol of the property valuation, the expert's valuation report, and the extract from the land register along with a map from the enforcement proceedings can be reviewed at the bailiff's office. The rights of third parties will not hinder the auction and the transfer of ownership to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to exempt the property or items seized with it from enforcement and have obtained a ruling suspending the enforcement in this regard. Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the ruling on the transfer of ownership.
