NOTICE OF THE FIRST AUCTION OF REAL ESTATE

IN THE COURSE OF ELECTRONIC AUCTION

The Bailiff's Office announces to the public that in the case Km 1017/23

on the day: 09.05.2024 at 13:00

the auction will commence in the manner established in Article 986 § 4 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc)

the first auction in electronic mode

of the following properties: - property located at Zaszkow, 07-322 Nur, for which the Land and Mortgage Register at the District Court in Ostrow Maz (address: ul. Prusa Boleslawa 2, Ostrow Mazowiecka, 07-300 Ostrow Mazowiecka) maintains the land and mortgage register number OS1M/000xxxx/5.

Description of the property:

undeveloped agricultural land, constituting plot no. 250 with an area of 1.3000 ha, located in Zaszkow, in the municipality of Nur, for which the land and mortgage register OS1M/000xxxxx/5 is maintained.

The property is located in the vicinity of agricultural land, between dirt roads. The plot is used agriculturally, in the shape of an elongated rectangle. For the property, the District Court in Ostrow Maz. The Land and Mortgage Register maintains the land and mortgage register number KW OS1M/000xxxxx/5.

The property is encumbered with a limited property right, according to the life estate agreement dated 02-12-2011, Rep. No. 2168/2011, disclosed in the land and mortgage register, the personal right includes lifetime benefits consisting of providing food, clothing and footwear, care in case of illness, and arranging funerals according to local customs. The value of the limited property right has been set at 16,000.00 PLN. According to the provisions of Article 1000 § 1.kpc "Upon the finality of the decision on the adjudication of ownership, all rights and effects of the disclosure of personal rights and claims encumbering the property expire. In place of these rights, the right to satisfaction from the purchase price arises with priority provided for in the provisions on the division of the price obtained from enforcement."

The estimated value is 66,000.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 49,500.00 PLN.

Within two weeks before the auction, the above-mentioned property can be viewed on weekdays from 13:00 to 14:00. The protocol of description and valuation is made available in the IT system.

The bidder participating in the auction should submit a deposit in the amount of one-tenth of the estimated value, which is 6,600.00 PLN. The deposit must be submitted to the bailiff's bank account 21 1020 1592 0000 2002 0203 2332 no later than 2 business days before the auction begins. The sale is conducted by electronic auction.

Participation in the auction requires creating an account in the IT system servicing electronic auctions available at / and joining the auction two business days before its start. The bidder submits the deposit no later than 2 business days before the auction begins, and if participating in the auction as an attorney for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.

Based on Article 986 § 2 kpc, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the above-mentioned properties are conducted in electronic mode and will end on: 16.05.2024 at 13:00.

According to Article 986 after § 3 kpc, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until the bids cease.

The rights of third parties will not hinder the auction and the awarding to the buyer without reservations, if these persons do not submit evidence before the auction begins that they have filed a lawsuit to release the items from enforcement and obtained a judgment suspending the enforcement in this regard. Usufruct, easements, and rights of the life tenant, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction begins, will not be taken into account in the further course of enforcement and will expire upon the finality of the decision on the adjudication of ownership.

According to Article 976 kpc, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
