MAYOR OF KROSNO ODRZANSKIE announces the first unrestricted oral auction for the sale of a residential unit along with a share in the common property. Location of the property: ul. 3 Maja 10 Swiebodzin, plot no. 559/5 with an area of 0.0271 ha, precinct 0002, share in the land and common parts of the building - 3/100. According to the study of conditions and directions of spatial development of the Municipality of the city and municipality of Swiebodzin, plot 559/5 is located in the area marked as "UM" - residential and service development and is within the boundaries of the area surrounding a monument entered in the register of monuments, identical to the cultural landscape protection zone "K". The residential building is entered in the municipal register of monuments. Description of the unit: Residential unit no. 7 is located in the attic, consisting of a room, kitchen, and WC with an area of 25.20 m2. The building in which the subject unit is located is a multi-family residential building, three-storey with usable attic. The unit is free from encumbrances and obligations. The residential unit has an established land and mortgage register. The starting price of the unit and the share in the land [PLN] is 130,000.00. The amount of the deposit [PLN] is 13,000.00. The auction will take place on September 9, 2025, at 10:00 AM at the City Hall in Krosno Odrzanskie at ul. Parkowa 1, building B, room no. 11. The property is owned by the Municipality of Krosno Odrzanskie. The buyer of the property is obliged to familiarize themselves before the auction with the existing legal and factual state of the property being purchased and before participating in the auction to submit to the commission a written statement of having familiarized themselves with the legal and factual state of the property and the auction conditions and accepting them without reservations, under the penalty of being excluded from the auction. The amount of the bid is determined by the auction participants, with the stipulation that the bid cannot be less than 1% of the starting price, rounded up to the nearest ten zlotys. Conditions for participation in the auction: 1. Individuals and legal entities who pay the deposit by the deadline, no later than September 5, 2025, to the bank account of the City Hall in Krosno Odrzanskie Santander Bank Polska S.A. Branch Krosno Odrzanskie No. 64 1090 1551 0000 0000 5500 1056, may participate in the auction. The date of payment of the deposit is considered the date of receipt in the bank account of the City Hall in Krosno Odrzanskie. 2. The deposit payment receipt must include the address of the property subject to the auction and the name of the person participating in the auction (buyer). 3. Persons entitled to compensation for leaving property outside the borders of the Republic of Poland due to expulsion from the former territory of the Republic of Poland or leaving it due to the war that began in 1939 are exempt from the obligation to pay the deposit specified in the auction announcement, if by September 4, 2025, they submit a written participation in the auction, presenting the original certificate or decision confirming the right to include the value of the property left outside the current borders of the Republic of Poland, as well as a written commitment to pay an amount equal to the deposit amount in case of refusal to conclude the contract. These persons must present to the auction committee before the auction the identity document, the original certificate or decision confirming the right to include the value of the property left outside the current borders of the Republic of Poland, and extracts from the registers referred to in Article 19 of the Act of July 8, 2005, on the implementation of the right to compensation for leaving property outside the current borders of the Republic of Poland (Journal of Laws of 2017, item 2097). 4. Participants in the auction are required to present to the auction committee the original deposit payment receipt and: - in the case of an individual: a document confirming the identity of the auction participant (identity card, passport, or driver's license); in the case of an attorney for an individual: a document confirming the identity of the attorney (identity card, passport, or driver's license) and a notarized power of attorney or a power of attorney with a notarized signature of the principal, - in the case of an individual married or an individual conducting business who is married, a statement whether the purchase of the property is made to the joint property or to the separate property and, if this person: · remains in a community of property (statutory or contractual): a statement from the spouse that they agree to the joint purchase of the property subject to the auction at the price and on the terms offered by the spouse participating in the auction; · has a separation of property: a statement that as of the auction date they remain bound by a separation of property agreement (provided that in the case of winning the auction, the document confirming the above must be presented to the notary before signing the sale agreement for the property); - in the case of a person conducting business: a document confirming the identity of the auction participant (identity card, passport, or driver's license) and a current (not older than 3 months) certificate of conducting business. In the case of a civil partnership, the consent of the partners in the form of a resolution or a partnership agreement authorizing the partner(s) to acquire property without the consent of the other partners; in the case of an attorney for an individual: a document confirming the identity of the attorney (identity card, passport, or driver's license) and a notarized power of attorney or a power of attorney with a notarized signature of the principal, - in the case of a representative of a legal person or an entity subject to registration in the KRS: a document confirming the identity of the representative (identity card, passport, or driver's license) and a current (not older than 3 months) extract from the court register; in the case of an attorney for a legal person or an entity subject to registration in the KRS: a document confirming the identity of the attorney (identity card, passport, or driver's license) and a notarized power of attorney or a power of attorney with a notarized signature of the principal, - in other cases, documents proving in accordance with applicable regulations the representation of the person or organizational unit participating in the auction and a document confirming the identity of the person participating in the auction on their behalf (identity card, passport, or driver's license); in the case of an attorney for such a person or unit, a notarized power of attorney or a power of attorney with a notarized signature. 5. A sworn translator must participate in the auction with a foreigner. Foreign entities are bound by the provisions of the Act of March 24, 1920, on the acquisition of real estate by foreigners (Journal of Laws of 2017, item 2278). 6. The buyer must pay the purchase price of the property no later than the date of concluding the notarial agreement. 7. The deposit paid will be credited to the purchase price of the property for the participant who wins the auction. The deposit paid will be returned to the auction participant immediately, but no later than within 3 days from the date of: cancellation of the auction, closing of the auction, invalidation of the auction, or completion of the auction with a negative result. 8. The date of concluding the notarial agreement will be determined no later than within 21 days from the date of the auction resolution. 9. If the person designated as the buyer does not appear without justification at the place and time of concluding the sale agreement, the Mayor of Krosno Odrzanskie may withdraw from concluding the agreement, and the paid deposit is non-refundable. 10. The cost of concluding the notarial deed is borne entirely by the buyer. 11. The sale price of the residential unit is exempt from VAT, based on Article 43, paragraph 1, point 10 of the Act of March 11, 2004, on goods and services tax (Journal of Laws of 2025, item 775). 12. The auction will be conducted in accordance with the regulation of the Council of Ministers of September 14, 2004, on the manner and procedure for conducting auctions and negotiations for the sale of real estate (Journal of Laws 2021, item 2213) and the provisions of the Act of August 21, 1997, on real estate management (Journal of Laws of 2024, items 1145, 1222, 1717, and 1881). 13. The buyer takes over the subject of the auction in its existing state. 14. The auction may only be canceled for important reasons in the manner specified in the provisions of Article 38, paragraph 4 of the Act of August 21, 1997, on real estate management (Journal of Laws of 2024, items 1145, 1222, 1717, and 1881). 15. The offered unit for sale can be viewed on August 26, 2025, from 10:00 AM to 12:00 PM. 16.
