The subject of the auction will be a residential unit constituting a separate property marked No. 2 located in the town of Lagow No. 139, gmina Przyłęk, Mazowieckie Voivodeship, with a usable area of 57.00m2, located on the first floor of a partially basement residential building with 3 floors, consisting of one room, kitchen, bathroom with toilet, hallway, and pantry, as well as ancillary rooms, i.e. a storage room with a usable area of 12.50m2, a basement with a usable area of 11.40m2, a garage with a usable area of 18.70m2 for which the District Court in Zwoleń IV Land and Mortgage Register Department keeps the land and mortgage register No. RA1Z/00019103/8 covering a share of 996/2294 of the common parts of the building and other facilities not intended for the exclusive use of the owners of the premises and the same part in the ownership of the land plot No. 557/3 with an area of 0.3100 ha on which the residential building is located for which the District Court in Zwoleń IV Land and Mortgage Register Department keeps the land and mortgage register No. RA1Z/00019101/4. There is a discrepancy between the entries in section I of the land and mortgage register and the actual state, consisting of the fact that in point 6 Description of the premises in subpoints A and B the number of rooms is entered as 1, type of rooms - room, while in fact this room has been divided into two rooms. According to the attached land map, the brick garage and utility building exceeds the occupied plot No. 557/1 and is partially located on the neighboring plot marked No. 558/1. According to the actual state, the fence of the plot on the northeast side is not located on the plot boundary but on the neighboring plot marked No. 557/1.
The security should be deposited in cash or in a savings book equipped with the owner's authorization to withdraw the entire deposit according to the legally binding court decision on the loss of security. The security should be deposited into the bailiff's account: PKO PB I O/Radom 34 1020 4317 0000 5402 0144 0114.
According to the provisions of Article 976 § 1 of the Code of Civil Procedure, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
In the two weeks before the auction, it is allowed to view the property on weekdays from 09:00 to 14:00 and to review the enforcement proceedings files at the bailiff's office.
