NOTICE OF THE FIRST AUCTION OF THE PROPERTY BY ELECTRONIC AUCTION

The Court Bailiff at the District Court for Lodz Widzew in Lodz announces to the public that in case KM 84/24 on the date: 28.08.2025 at 10:00 the first auction will commence in the manner specified in art. 9864 § 4 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc) for the following property:

- residential premises located at ul. Antenowa, 93-304 Lodz.

Property description:

The premises with a usable area of 34.16 m2 consists of one room with a kitchenette and a bathroom. The premises are located on the ground floor of a one-story multi-family building.

The estimated value is 145,100.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 108,825.00 PLN.

For two weeks before the auction, the above-mentioned property can be viewed on weekdays from 10:00 AM to 2:00 PM. The protocol of description and valuation is made available in the IT system.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 14,510.00 PLN. The deposit must be submitted to the bailiff's bank account 13 1050 1461 1000 0090 7173 8646 no later than 2 business days before the auction starts.

The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at the address elicytacje.komornik.pl and participating in the auction two business days before it starts. The bidder submits the deposit no later than 2 business days before the auction starts, and if participating in the auction as an attorney for another person, must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.

Based on art. 9864 § 2 kpc, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the above-mentioned properties will take place electronically and will end on: 04.09.2025 at 10:00. Based on art. 9867po § 31 kpc, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes until the bids cease.

The rights of third parties will not prevent the auction and the awarding to the buyer without reservations, if these persons do not submit proof that they have filed a lawsuit to exempt the items from enforcement and have obtained a judgment suspending the enforcement before the auction starts.

Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.

According to art. 976 kpc, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
