Announcement of the second auction for the sale of residential unit No. 9 located in building No. 14B at Krakowska Street in Mysłowice.

The auction will take place on August 5, 2025, at 10:00 AM in room No. 204 of the City Hall in Mysłowice at 1 Powstańców Street.

The Mayor of Mysłowice announces an oral unlimited auction for the sale of independent residential unit No. 9, with a usable area of 41.51 m2, owned by the Municipality of Mysłowice, located in a multi-family building No. 14B at Krakowska Street in Mysłowice, along with a share in the common property and a fractional part of the land, covering the parcels marked with numbers 1118/34 and 1120/68 with a total area of 576 m2, map sheet 9, precinct 0007 Mysłowice, in the Old Town district registered in the land and mortgage register KA1L/00008565/7 of the District Court in Mysłowice. This property, managed by the Municipal Management of Buildings in Mysłowice, constitutes an independent residential unit and is not subject to lease or lease agreement. The property is located adjacent to developed areas. In the immediate vicinity of the property, there are multi-family residential buildings and service-trade facilities. The building in which the subject unit is located is a 3-storey object with an additional attic, three entrances, with a basement, built in 1957. The technical condition of the building is good. Made using traditional masonry technology, the roof is covered with trapezoidal sheet metal. The exterior facade has undergone thermal modernization, insulated with polystyrene and finished with thin-layer plaster. The residential unit is situated on the top floor of the building (attic), consisting of two rooms, a kitchen, a hallway, a bathroom with a toilet. The future buyer will also have access to a basement with an area of 1.83 m2, which is not an accessory room but remains in the common parts of the building. The layout of the rooms is functional, with double-sided lighting. All rooms are accessible from the hallway. The kitchen is bright with a window. The unit is equipped with installations: electricity, water-sewage, gas, central heating, and intercom. With the aforementioned property, there is a share amounting to 32/1000 in the fractional part of the parcels marked with numbers 1118/34 and 1120/68 with a total area of 576 m2, along with the shared parts of the building and the equipment that is not intended solely for the use of unit owners. The standard and functionality of the residential unit have been defined as low, requiring renovation. The building has an energy performance certificate for building part No. SCHE/16009/325/2024 dated September 10, 2024. The buyer will take over the aforementioned residential property in its existing condition. This property is covered by the local zoning plan 'Old Town and Southern Sand' in Mysłowice adopted by the Resolution of the City Council of Mysłowice No. IV/14/14 on December 22, 2014, taking into account the changes introduced by the resolution No. XXVI/424/16 on October 27, 2016, regarding the amendment to the local zoning plan 'Old Town and Southern Sand' in Mysłowice and remains in zone 6.U/MW - areas for service and service-residential development. We do not find entries in the sections III and IV of the land and mortgage register No. KA1L/00008565/7 conducted for the property constituting parcels No. 1118/34 and 1120/68, where the building with the subject unit for sale is located.

The starting price for the property is 179,000 PLN

The auction is valid regardless of the number of participants, provided that at least one participant offers at least one bid above the starting price of the property. The amount of the bid is determined by the auction participants, provided that the bid in the auction cannot be less than 1% of the starting price of the property, rounded up to the nearest tens of zlotys. The price achieved in the auction for the property must be paid in full, no later than on the day of concluding the property transfer agreement, where the date of payment is considered to be the date of acknowledgment of the bank account of the City Hall of Mysłowice, indicated in the notification of the location and date of the sale agreement. The sale of the property may be subject, according to regulations, to VAT taxation at the rate applicable on the day of sale. As of the date of the auction announcement, the sale of this unit is exempt from VAT based on Article 43, paragraph 1, point 10 of the Act of March 11, 2004, on the tax on goods and services (uniform text Journal of Laws of 2024, item 361 with subsequent amendments), in connection with Article 2, point 33 of this act.

The auction will take place on August 5, 2025, at 10:00 AM in room No. 204 of the City Hall in Mysłowice at 1 Powstańców Street.

Participants may take part in the auction who, by July 30, 2025, pay a deposit in cash in the amount of 35,800 PLN (in words: thirty-five thousand eight hundred zlotys), depositing it into the deposit account of the City Hall of Mysłowice No. 57 1030 1508 0000 0008 2417 7003 at Citi Handlowy Bank in Warsaw S.A, marked with the property's designation. The date of the deposit is considered the date of receipt of the funds on the above bank account. The deposit paid by the auction participant who wins will be counted towards the purchase price of the unit on the payment date of the remainder of the sale price. The deposits of the remaining participants in the auction will be refunded within 3 days from the closing date of the auction (without interest) to the accounts indicated by them. The organizer of the auction is obliged to notify the person established as the buyer of the location and date of the sale agreement, no later than 21 days from the date of the auction resolution. The set date cannot be shorter than 7 days from the date of delivery of the notification. If the person established as the buyer of the unit fails to appear without justification to conclude the agreement at the place and on the date specified in the notification, the organizer of the auction may withdraw from concluding the agreement, and the deposit shall not be refunded.

Before the auction opens, its participant must present to the Auction Committee:

  • Proof of deposit (original).
  • Identification document.
  • Current excerpt or certificate from the relevant register issued no later than 6 months before the auction deadline if the property will be purchased by the auction participant as part of their business activity, and in the case of partners in civil partnerships, also the civil partnership agreement.
  • Original notarized power of attorney authorizing to act at any stage of the auction procedure, in the case of a person representing the auction participant.
  • Written consent of the spouse for the paid acquisition of the unit, in the case of an auction participant intending to bid independently for a unit to be acquired for the common property, and in the case of acquiring the property for separate property for insight the original agreement on marital property separation.
  • Statement that the bidder has familiarized themselves with the documentation of the sold unit, its factual and legal state, and the conditions of the auction and accepts them without reservations.
  • Statement that the bidder consents to the processing of their personal data, including making it public in connection with the sale of the subject unit by auction.
  • Account number and name to which the deposit will be refunded if the auction is not won.

The acquisition of property by foreigners may occur with the approval of the minister responsible for internal affairs if required by the provisions of the Act of March 24, 1920, on the acquisition of real estate by foreigners. The buyer shall independently determine whether the acquisition of the property subject to the auction requires obtaining permission. The buyer shall also bear all notarial costs and costs and court fees associated with the acquisition of the unit.
