ANNOUNCEMENT OF AUCTION Based on Article 38, sections 1 and 2, Article 40, section 1 point 1 of the Act of August 21, 1997 on real estate management (consolidated text Journal of Laws of 2024, item 1145 as amended) and § 6 and 13 of the Regulation of the Council of Ministers of September 14, 2004 on the detailed rules and procedure for conducting auctions for the sale of real estate (consolidated text Journal of Laws of 2021, item 2213). THE MAYOR OF PUCK announces an unlimited oral auction for the sale of the property described below, located in the Puck municipality. Property designation according to the land and mortgage register and land cadastre Plot No. 308/50 located in the Pomeranian Voivodeship, Puck County, Puck municipality, geodetic area 0010 Mieroszyno. Plot area in m2 1248 Starting price in PLN 268,000 Minimum bid increment in PLN 2,680 Deposit 26,800 Property description The property is located in a residential development area. The plot has an irregular shape, is undeveloped, unserviced, and its terrain is flat, accessed by a dirt road through plots No. 308/9, 308/47, 308/4, and 308/19 owned by the Puck municipality. Intended use and development conditions Area designated for single-family residential development, decision on development conditions BGG.6730.73.2023.IK dated April 20, 2023. Dates of previous auctions October 13, 2023 June 21, 2024 September 20, 2024 April 25, 2025 July 11, 2025 1. The auction will take place on October 3, 2025, at 11:00 AM in the building of the Puck Municipality Office at 10 Lutego 29. 2. The condition for participation in the auction is the payment of the deposit in the amount specified above, made in cash, in Polish zlotys, payable to the bank account of the Puck Municipality Office with the number 55834900020008950020000030 BS Krokowa. In the title of the deposit payment, it should be indicated which property the payment concerns and the name of the individual or legal entity participating in the auction. 3. The condition for the deposit will be fulfilled if the funds are in the municipality's bank account by September 29, 2025. 4. Payment of the deposit is equivalent to familiarizing oneself with the state of the auction subject, including its technical, legal, and functional condition, as well as planning and urban conditions concerning the sold property. 5. Proof of deposit payment by the auction participant must be submitted to the auction committee before the auction opening. 6. Participants in the auction or their representatives are required to present documents confirming their identity, and in the case of legal entities, also the current information corresponding to the current excerpt from the KRS register and a relevant resolution expressing consent to participate in the auction and acquire the property. In the case of individuals conducting business in the form of a civil partnership - the partnership agreement, REGON of the partnership, a resolution for the paid acquisition of the property, or appropriate authorization to act on behalf of the partners allowing for the paid acquisition of the property. In the case of property acquisition by individuals married (also partners of civil partnerships), both spouses must be present during the auction. If only one spouse participates, a written statement from the other spouse with a notarized signature expressing consent for the spouse to participate in the auction with the intention of acquiring the property with funds from the joint property is required. In the case of property separation, the appropriate document must be presented. Individuals married intending to acquire the property for personal property must submit the appropriate statement. 7. Foreigners, in the case of winning the auction, are required to obtain the consent of the Minister of Internal Affairs and Administration for the acquisition of real estate in cases where such consent is required before concluding the notarial agreement. The buyer is obliged to determine on their own whether the acquisition of the land subject to the auction requires such permission. Before the auction begins, a foreigner must present the auction committee with the appropriate promise, and the permission to acquire the property must be presented before signing the property transfer agreement, under penalty of losing the deposit. 8. The auction is valid regardless of the number of participants if at least one participant offers at least one bid above the starting price. 9. The deposit paid by the participant who wins the auction is credited towards the purchase price of the property. The deposits of other auction participants are returned immediately after the auction closes. 10. A participant who wins the auction but refuses to conclude the purchase agreement for the auctioned property loses the deposit. 11. The purchase price of the auctioned properties is subject to a value-added tax (VAT) of 23%. 12. The purchase price determined in the auction, along with VAT, will be payable in a lump sum, to the bank account indicated by the seller, no later than two days before the scheduled date of the notarial agreement transferring ownership of the property. 13. The Mayor of Puck will notify the person selected in the auction as the buyer of the place and date of the sale agreement no later than 21 days from the date of the auction resolution. If the person designated as the buyer does not appear without justification to conclude the agreement at the place and time indicated in the Mayor's notification, the auction organizer may withdraw from concluding the agreement, and the paid deposit is non-refundable. 14. The cost of concluding the sale agreement is borne by the buyer of the property. 15. The Puck municipality is not responsible for hidden defects of the property that could not be determined based on the available documents. 16. The right to cancel or invalidate the auction is reserved in case of justified reasons. 17. Properties are sold based on cadastral data contained in the land register, and the renewal and presentation of boundary markers may be done at the effort and expense of the future owner. 18. The announcement will be published in the press through the internet service entered in the register of journals and periodicals. It will be posted on the Puck municipality's website (local law/tab on sale and lease) and displayed on the notice board of the Office. 19.
