ANNOUNCEMENT OF AUCTION Based on Article 38 of the Act of August 21, 1997 on real estate management (Journal of Laws of 2024, item 1145 as amended) and § 3, 4 and 6 of the Regulation of the Council of Ministers of September 14, 2004 on the manner and procedure for conducting auctions and negotiations for the sale of real estate (Journal of Laws of 2021, item 2213), the Mayor of Swietajno in Olecko County announces the first unlimited oral auction for the sale: 1) plot no. 52 with an area of 5811 m², located in the Barany district – KW no. OL1C/00002438/4. The property is not covered by the applicable local spatial development plan due to its expiration. For the above-mentioned plot, a decision has been issued regarding the conditions of development and land management for the investment consisting of the construction of a single-family residential building in free-standing development with an accompanying facility, which is a utility building. The property is free from any encumbrances and obligations. The starting price of the property is 82,900.00 PLN. The deposit is 8,000.00 PLN. The amount of the minimum bid increase is determined by the auction participants, provided that the increase cannot be less than 1% of the starting price, rounded up to the nearest ten zlotys. The VAT tax of 23% will be added to the price achieved in the auction. The auction will take place on August 29, 2025, at 10:00 AM in the building of the Gmina Office, room no. 11. The condition for participating in the auction is the payment of the deposit in the above-mentioned amount to the bank account of BS Olecko Branch Swietajno No. 64 9339 0006 0010 0100 0707 0044 in such a way that the account is credited no later than August 25, 2025. In the title of the deposit payment, the designation of the property, the name and surname of the auction participant, and in the case of a marriage, both spouses should be indicated. Auction participants are required to present to the auction committee: - proof of deposit payment, - a document confirming identity and citizenship – an ID card, if the auction participant is a natural person, in the absence of the spouse, a relevant authorization to participate in the auction. - in the case of legal persons and organizational units without legal personality – a current extract from the register, relevant powers of attorney, identity documents of the persons representing the entity. The paid deposit will be: - credited towards the purchase price if the payer wins the auction, - returned if the payer does not win the auction. The purchase price of ownership rights equal to the price achieved in the auction, along with VAT, must be paid to the above-mentioned account no later than before the notarial contract is signed. The date for signing the notarial sale agreement will be established within 21 days from the date of the auction resolution. Withdrawal from the transfer of ownership rights in the form of a notarial deed on the established day and hour for reasons unjustified by the buyer will result in the forfeiture of the paid deposit in favor of the auction organizer, and the auction will be null and void. The auction organizer may: - from the moment of commencement, withdraw from conducting it for justified reasons, - withdraw from concluding the notarial agreement if it is found that the auction was conducted in violation of the law.
