ANNOUNCEMENT
Based on Article 38 in connection with Article 39 of the Act of August 21, 1997 on real estate management (Journal of Laws of 2024, item 1145, as amended), the regulation of the Council of Ministers of September 14, 2004, on the method and procedure for conducting auctions and negotiations for the sale of real estate (Journal of Laws of 2021, item 2213) as a result of the previous three negative auctions held on August 2, 2024, October 11, 2024, January 24, 2025, and April 16, 2025.
The Mayor of Bojadla announces the fifth unlimited oral auction
for the sale of the below-described undeveloped properties owned by the Municipality of Bojadla, located in the geodetic area of Klenica, Bojadla municipality, Lubusz Voivodeship:

Purpose
According to the applicable Local Spatial Development Plan for business and residential development in the village of Klenica, Bojadla municipality, approved by the Resolution of the Bojadla Municipal Council No. XVIII/76/08 dated June 25, 2008, plot No. 521/6 is designated as areas for single-family residential development. According to the land registry, the property consists of arable land (RVI) with an area of 0.1533 ha.

The second auction took place on October 11, 2024, the third auction took place on January 24, 2025, the fourth took place on April 16, 2025.

The auction will take place on August 28, 2025, at 11:00 in the USC room of the Bojadla Municipality Office, ul. Sulechowska 35. The first auction took place on August 2, 2024. The second auction took place on October 11, 2024, the third auction took place on January 24, 2025, the fourth took place on April 16, 2025.
The list was made public on May 14, 2024, and the deadline for submitting applications by persons entitled to priority in acquiring the property based on Article 34, paragraph 1, points 1 and 2 of the Act of August 21, 1997 on real estate management (Journal of Laws of 2024, item 1145) was set from May 15, 2024, to June 26, 2024 - no applications were submitted.
The previous four negative auctions were held on August 2, 2024, October 11, 2024, January 24, 2025, and April 16, 2025.
Conditions for participation in the auction:
1. In the auction for the above properties, a security deposit in cash must be paid in the amount specified for the given property by August 25, 2025, to the account of the Bojadla Municipality Office No. 10 9674 0006 0000 0030 3390 0003 Cooperative Bank in Nowa Sól. In the title of the security deposit, the subject of the auction must be indicated (security deposit for the auction on plot 521/6 or 521/10 in Klenica). In the case of paying the security deposit on behalf of another entity, the title of the transfer must clearly indicate that entity. The security deposit must be paid in advance so that by August 24, 2025, the funds are in the Municipality's account.
The security deposit paid by the person who wins the auction will be credited towards the price of the acquired property, and the remaining persons will be refunded within 3 days from the date of the auction's closure. The security deposit is non-refundable if the person who wins the auction refuses to conclude a notarial agreement.
2. Before participating in the auction, each participant must present to the auction committee:
a) in the case of natural persons - an ID card or passport, and in the case of representing another person, a notarial power of attorney,
b) in the case of natural persons conducting business activity - a printout from CEIDG, identity documents, appropriate powers of attorney,
c) in the case of partners in a civil partnership - a CEIDG printout, identity documents, appropriate powers of attorney,
d) in the case of legal persons - a current extract from the relevant register, appropriate powers of attorney, identity documents of the persons representing the entity.
e) In the case of persons married with statutory marital property, both spouses must be present to participate in the auction. If one of the spouses participates in the auction, it is necessary to present to the auction committee a written consent of the spouse to acquire the property with funds from the common property or to present the original document proving the existence of property separation between spouses.
3. The condition for acquiring the property, in addition to winning the auction, is the conclusion of a notarial agreement. The candidate for the buyer will be notified of the date of the agreement within 21 days from the date of the auction's resolution. The costs of concluding the sale agreement are borne by the buyer.
The Mayor of Bojadla may cancel the auction for a valid reason, informing about this fact in the legally prescribed manner.
The announcement is made public on the notice board of the Bojadla Municipality Office, in the Public Information Bulletin, and in the press.
