ANNOUNCEMENT OF AUCTION The Lesko County Starosta acting under Article 23 sec. 1 point 7, Article 38, Article 40 sec. 1 point 1, Article 67 of the Act of August 21, 1997 on real estate management (Journal of Laws of 2024, item 1145) and § 4 sec. 5 of the Regulation of the Council of Ministers of September 14, 2004 on the manner and procedure for conducting auctions and negotiations for the sale of real estate (Journal of Laws of 2021, item 2213) and the order No. 85/23 of the Podkarpackie Voivode of April 19, 2023 announces: the fifth unlimited oral auction for the sale of an unencumbered property owned by the State Treasury located in Uherce Mineralne gm. Olszanica, marked in the land and building register as plots No. 694/9 with an area of 0.5898 ha, recorded in the land and mortgage register No. KS1E/00036579/7. Property description The property is located in Uherce Mineralne gm. Olszanica, with direct access to public - voivodeship, built with industrial buildings and facilities of the former sewage treatment plant. The plot is fenced and equipped with electricity, sewage. A gas pipeline and technical network run nearby. Marked in the register as Ba - industrial areas and Lzr - Ps - wooded and shrubbed land on agricultural land. The area for which there is no local spatial development plan. According to the Study of Conditions and Directions of Spatial Development of the Olszanica commune, the plot is located in an area marked as industrial areas, bases, existing and potential warehouses. Starting price: 300,000.00 PLN, deposit amount: 30,000.00 PLN Exempt from VAT in accordance with Article 43 sec. 1 point 10 of the Act of March 11, 2004 on goods and services tax (Journal of Laws of 2024, item 361 as amended). The auction will take place on March 12, 2025 - at 12:30 PM at the District Office in Lesko, ul. Rynek 1, in the meeting room on the ground floor of the building. Auctions were held at the District Office in Lesko on: I auction - December 12, 2023, II auction - March 19, 2024, III auction - September 3, 2024, IV auction - November 19, 2024. Auction conditions 1. Individuals and legal entities may participate in the auction if they pay the deposit by the deadline specified in the announcement. 2. Proof of payment of the deposit by the auction participant must be presented to the auction committee before the auction opens. The deposit must be paid in cash by March 7, 2025, to the account of the District Office in Lesko - PKO BP Branch in Lesko No. 97 1020 4391 0000 6402 0211 7778 with the note of the plot registration number for which the deposit was paid. The date of deposit payment is considered the date of receipt of funds to the above account. 3. Individuals participating in the auction are required to present an identity document, and in the case of conducting business and purchasing real estate for the business, a certificate of entry in the central register of information about business activity. Representatives of legal entities, in addition to the identity document, are required to present the auction committee with a current extract from the KRS and appropriate authorization to represent the legal entity in the auction. 4. The paid deposit will be: - credited towards the purchase price if the participant paying the deposit wins the auction (the deposit amount will be credited towards the purchase price on the day of payment of the full amount due); - returned immediately after the auction is canceled, invalidated, or closed, as well as in the case of a negative auction result, but no later than before the expiration of 3 days from the date of cancellation or closure of the auction. 5. The paid deposit is forfeited in case of unjustified withdrawal from the contract by the participant who won the auction. 6. The auction is valid regardless of the number of participants if at least one participant has offered at least one bid above the starting price. 7. The amount of the bid is determined by the auction participants, provided that the bid cannot be less than 1% of the starting price, rounded up to the nearest tens of zlotys. The minimum bid amount: 3,000.00 PLN. 8. If the acquisition of the property occurs in the joint property, the condition for admission to the oral auction is the presence of both spouses at the auction or one of them, having the written consent of the spouse to purchase the property with the spouse's handwritten signature. 9. The buyer is obliged to pay the entire purchase price of the property to the seller's account before the designated date of concluding the notarial deed of the purchase agreement. 10. All costs of preparing auction documentation and costs related to concluding the notarial agreement are borne entirely by the buyer. 11. The indication, renewal of property boundary points may be carried out at the effort and cost of the future buyer. 12. The auction organizer reserves the right to cancel the auction. 13.
