Description
The President of the City of Dabrowa Gornicza announces that on September 4, 2025, at 10:00 AM at the City Hall in Dabrowa Gornicza at Graniczna 21, the first unlimited oral auction for the sale of undeveloped property owned by the Municipality of Dabrowa Gornicza located in Dabrowa Gornicza at Srednia Street, marked as geodetic number 9421 with an area of 973 m2 (Dabrowa Gornicza II district) will take place. The land register is maintained for the property with a total area of 15.5313 ha, the subject plot is registered under number 26 (identifier 246501_1.0020.9421). Sections I-Sp, III, and IV of the land register are free of entries. The starting price of the property is: 422,010.00 PLN. The deposit is: 84,402.00 PLN. The VAT tax at the rate applicable on the date of sale (currently this rate is 23%) will be added to the auctioned sale price. In the event of changes in the regulations on goods and services tax, the rates will be adjusted to those applicable on the date of sale of the property. The undeveloped plot is unfenced, with a shape similar to a trapezoid, covered with disordered low and high greenery. The terrain is uneven - there is a part of a small slope on the plot. A gas network runs through the plot, two water connections Ø40, and a stormwater collector DN 1000. There is also a well DN 1200 associated with the collector, to which an inactive general sewage network leads. The buyer will be obliged to establish a land easement for the Municipality of Dabrowa Gornicza when concluding the notarial sale agreement for the property - concerning the stormwater collector and the well (part of the plot with an area of 75 m2). Network operators will have the right to free and unlimited access to this network in case of emergencies or maintenance work. Nearby there are technical infrastructure networks in the form of electrical, water, sewage, and telecommunication networks. Connecting the facility to the technical infrastructure networks will be possible under the conditions specified by the network operators. The plot is located in the immediate vicinity of the former municipal landfill and may have been contaminated by it. The municipality does not have studies of this area. According to the classification of land use contained in the land and buildings register, the plot constitutes urbanized undeveloped or under construction areas (Bp). The property is free of encumbrances and is not subject to any obligations. According to the applicable plan titled: "Local spatial development plan of the city of Dabrowa Gornicza for areas located in the region of 'Ninth, Thirtieth, and Leknica'", approved by Resolution No. LXI/1185/06 of the City Council in Dabrowa Gornicza on September 27, 2006, published in the Official Journal of the Silesian Voivodeship No. 121 item 3441 on October 23, 2006, the plot is located in the area marked with the symbol: 33MN - areas for single-family residential development with non-intrusive services as a complementary function. The announcement concerns the plot marked on the map with number 9421. The plots marked with number 9420 with an area of 834 m2 and 9419 with an area of 788 m2 adjacent to it are also intended for sale (auctions on September 11, 2025, and September 18, 2025). Detailed conditions for the development of the subject property (including orders and prohibitions) are included in the provisions of the aforementioned local spatial development plan, which should be reviewed at the Urban Planning Department of the City Hall in Dabrowa Gornicza or on the Public Information Bulletin website: (tab: Subject lists → Spatial planning, monuments → Applicable documents). The auction will be conducted based on the Act of August 21, 1997, on real estate management and the provisions of the Regulation of the Council of Ministers of September 14, 2004, on the method and procedure for conducting auctions and negotiations for the sale of real estate. A condition for participation in the auction is the payment of the deposit specified in this announcement in cash to the account of the City Hall in Dabrowa Gornicza no. 57 1560 0013 2002 3620 7000 0049 in VeloBank S.A. (indicating the designation of the property and the auction participant - in the case where the participant is another entity than the one making the payment), by August 27, 2025 /the date of payment of the deposit is considered the date of receipt of funds in the City Hall account/. The deposit will be returned immediately (but no later than within 3 days) after the closing, cancellation, invalidation, or negative outcome of the auction. The deposit paid by the participant who wins the auction will be credited towards the purchase price of the property. The President of the City will notify the person designated as the buyer of the property about the place and date of concluding the sale agreement in a written notification, no later than within 21 days from the date of the auction resolution. In the event of the buyer's failure to conclude the notarial agreement without justification, i.e., not appearing at the place and time indicated in the notification or failing to pay the sale price of the property in the amount and time specified therein (the date of payment is considered the receipt of funds in the City Hall account), the President of the City may withdraw from concluding the agreement, and the paid deposit will not be refunded. The purchase price of the property will be payable before signing the notarial agreement, no later than 3 days before the date of concluding the notarial agreement. The acquisition of property by foreigners may occur upon obtaining permission from the Minister of Internal Affairs, if required by the provisions of the Act of March 24, 1920, on the acquisition of real estate by foreigners. The buyer is obliged to determine on their own whether the acquisition of the property subject to the auction requires such permission and bears legal responsibility in this regard. The President of the City reserves the right to: - make changes to the auction announcement, including changing the auction date and the deposit payment date. Any changes will be posted on the notice board at the City Hall in Dabrowa Gornicza, ul. Graniczna 21 and published on the City Hall website: (tab: News / Real estate) and the Public Information Bulletin: (tab: Subject lists / Sale of real estate) - no later than 7 days before the auction date; - cancel the auction for important reasons, providing information about the cancellation of the auction to the public; - invalidate the auction without giving a reason. The right to announce a break in the auction for the purpose of verifying additional documents or information regarding the subject of the auction, which arose after its opening, is reserved by the Auction Committee. In the event of cancellation or invalidation of the auction (especially for reasons beyond the control of the President of the City), costs incurred by participants will not be refunded. Persons who are late for the opening of the auction, i.e., enter the room after the list of persons admitted to the auction has been read, may not be allowed by the Auction Committee to participate in the auction. Individuals participating in the auction should have an ID card or passport with them, and entities conducting business should additionally have a current excerpt from the relevant register. The Municipality of Dabrowa Gornicza is not responsible for networks running through properties subject to auctions that are not disclosed on existing geodetic maps and documents. Regardless of the information provided above, the buyer is responsible for independently familiarizing themselves with the legal and factual status of the property and its current development method, its parameters, and the possibility of development. Recognizing all factual and legal conditions necessary for the planned investment is entirely the buyer's responsibility and constitutes an area of their risk. To possibly examine the land at their own expense, they should contact the Real Estate Management Department of the City Hall in Dabrowa Gornicza for permission to enter the area. All costs associated with the sale of the property (in particular: notarial, court, geodetic, including the possible indication of boundaries/indicating the location of boundary points), removal of any contamination (including items left in buildings) and other things conflicting with the investment (including trees and shrubs) or demolition costs are borne by the buyer. The buyer will be obliged to personally apply for permission to cut down trees and shrubs from the property. The sale of the property will occur according to the excerpt from the land register and the extract from the land map. The buyer will be obliged to declare in the notarial sale agreement that they will not make claims regarding any discrepancies in the type of uses and any differences in the area of the sold property if, after its sale, as a result of measurements made by an authorized surveyor, it turns out that the area of the property is different from its designation in the documents indicated above. The sale of the property will occur according to the certificate issued by the Urban Planning Department regarding its designation in the local spatial development plan. The buyer will be obliged to declare in the notarial sale agreement that they will not make claims regarding any discrepancies in the designation of the sold property in the local spatial development plan if, after its sale, as a result of geodetic work conducted in the area, it turns out that the boundaries of the property are also in the area of land with a different, neighboring designation. Before the auction opening: 1. The auction participant will be obliged to submit a declaration (the declaration form will be provided on the day of the auction): a. that they have familiarized themselves with the content of the full auction announcement, the factual and legal status of the property, and the auction conditions and accept these conditions without reservations, b. that they have familiarized themselves with the detailed conditions for the development of the subject property (including orders and prohibitions) specified in the provisions of the local spatial development plan applicable to this area, c. that they acknowledge that the sale of the property occurs according to the excerpt from the land register and the extract from the land map and undertake to declare in the notarial sale agreement that they will not make claims regarding any discrepancies in the type of uses and any differences in the area of the sold property if, after its sale, as a result of measurements made by an authorized surveyor, it turns out that the area of the property is different from its designation in the documents indicated above, d. that they acknowledge that the sale of the property occurs according to the certificate issued by the Urban Planning Department regarding its designation in the local spatial development plan and undertake to declare in the notarial sale agreement that they will not make claims regarding any discrepancies in the designation of the sold property in the local spatial development plan if, after its sale, as a result of geodetic work conducted in the area, it turns out that the boundaries of the property are also in the area of land with a different, neighboring designation, e. they acknowledge that the Municipality of Dabrowa Gornicza is not responsible for networks running through the property, not disclosed on existing geodetic maps and documents, f. whether they are a foreigner within the meaning of the Act of March 24, 1920, on the acquisition of real estate by foreigners, g. that based on Article 6 point 1 letter a of the GDPR, they consent to the processing of the provided data for the purpose of implementing the sale procedure of the subject property. If the auction participant is a person in a marriage, they will be obliged to submit a declaration: 2. regarding the applicable marital property regime, 3. specifying the property (joint, personal) to which the acquisition of the property will occur. If the auction participant is a natural person, married under the community property regime, winning the auction will be obliged to conclude the notarial sale agreement jointly with their spouse or with their consent. In the absence of the spouse's consent to conclude the agreement, the paid deposit will not be refunded. If the declaration of the auction participant who is a natural person, married under the community property regime, regarding the acquisition of the property for personal property turns out to be incorrect and this fact comes to light after the auction is closed and the protocol is signed, the notarial sale agreement will not be concluded, and the deposit will be forfeited. If the auction participant is a natural person, married under the separation of property regime, they should present the auction committee with an excerpt of the notarial act documenting the marital property agreement or a copy of the court ruling establishing the separation of property. The documents should be in original or copies certified as true copies by, for example, a notary. 4. The auction participant will be obliged to submit written information about the bank account number to which the deposit should be returned. 5. A foreigner is obliged to present registration documents from their country of origin, along with a certified translation into Polish. 6. Representatives of legal entities, civil partnerships, organizational units referred to in Article 33(1) §1 of the Civil Code of April 23, 1964, will be obliged to submit the appropriate document authorizing them to make declarations of will on behalf of these persons /partners/, required to participate in the auction. If the auction participant is represented by an attorney, a notarial power of attorney is required, to the extent necessary to participate in the auction.
