ESSENCE OF THE LOCAL SPATIAL DEVELOPMENT PLAN

The purpose of the plot is defined by the content of Resolution No. XLVI/1406/10 of the Wroclaw City Council dated February 25, 2010, regarding the adoption of the local spatial development plan for the urban complex Jagodno-Wojszyce in Wroclaw:

Chapter 2
Provisions for the entire area covered by the plan

§ 5. The following provisions regarding the shaping of
development and land use apply:

1) the height of buildings may not exceed the height
of surfaces limiting the height of development in the airport area,
using special regulations;
2) the height of single-family residential buildings may not be
greater than 12 m, subject to point 3;
3) the height of atrial single-family residential buildings may not be
greater than 7 m;
4) the height of non-residential buildings on areas designated
for single-family residential development may not exceed 12 m;
5) the height of structures may not exceed 30 m;
6) the number of above-ground floors of single-family residential
buildings may not exceed three, with the third floor allowed only in the attic with a roof slope of not less than 30°, subject to point 7;
7) the number of above-ground floors of atrial single-family residential
buildings may not exceed 2;
8) the number of above-ground floors of non-residential buildings on
areas designated for single-family residential development may not exceed 2;
9) on areas 1.MW1, 2.MW1, 3.MW3, 4.MW3, 5.MW1, 6.MW1, 7.MW2,
8.MW1, 9.MW3, 10.MW3, 11.MW2, 12.MW1, 1.MWU, 2.MWU, 3.MWU, 4.MWU,
5.MWU, the applicable building line applies only to buildings,
whose outer edge of the outer wall is at a distance
of less than 30 m from this line;
10) in the internal division marked on the plan drawing with the symbol A
only the following purposes are allowed:
a) park greenery,
b) squares,
c) road infrastructure,
d) technical infrastructure devices;
11) the biologically active area must constitute at least:
a) 40% of the area of the building plot for single-family
residential development with free-standing and semi-detached buildings,
b) 20% of the area of the building plot for single-family
residential development with atrial buildings,
c) 30% of the area of the building plot for multi-family residential
development;
12) free-standing advertising carriers with a board area greater than 3 m² are not allowed;
13) free-standing antennas and base stations
of mobile telephony are not allowed.

§ 6. The following provisions regarding the consolidation and
division of real estate apply:

1) division and consolidation of real estate is allowed;
2) the area of the building plot for each single-family residential
building may not be less than:
a) 600 m² for a free-standing building,
b) 450 m² for a semi-detached building,
c) 250 m² for a terraced building,
d) 250 m² for an atrial building,
e) 1200 m² for a city villa;
3) the following distances must be maintained between single-family residential buildings and city villas:
a) 8 m - in the case of a building facing a wall with window or door openings towards the neighboring building, subject to points c and d,
b) 6 m - in the case of a building facing a wall without window or door openings towards the neighboring building, subject to points c and d,
c) the provisions mentioned in points a and b do not apply to adjacent buildings,
d) the provisions mentioned in points a and b do not apply to atrial single-family residential development.

§ 7. The following provisions regarding the protection and
shaping of the environment and landscape and nature protection apply:

1) on undeveloped and unpaved surfaces, greenery must be arranged;
2) regarding acoustic climate, acoustic standards apply
as defined by environmental protection regulations, according to which:
a) areas marked on the plan drawing with symbols 1.MN, 2.MN1,
3.MN2, 4.MN1, 5.MN1, 6.MN1, 7.MN1, 8.MN2, 9.MN1, 10.MN1,
11.MN1, 12.MN1, 13.MN1, 14.MN1, 15.MN1, 16.MN1, 17.MN2,
18.MN1, 19.MN1, 20.MN2, 21.MN1, 22.MN2, 23.MN1, 24.MN1,
25.MN1, 26.MN1, 27.MN1, 28.MN1, 29.MN1, 30.MN1, 31.MN1,
32.MN1, 33.MN1, 34.MN, 35.MN1, 36.MN1, 37.MN1, 38.MN1 are designated
for single-family residential development,
b) areas marked on the plan drawing with symbols 1.MW1, 2.MW1,
3.MW3, 4.MW3, 5.MW1, 6.MW1, 7.MW2, 8.MW1, 9.MW3, 10.MW3,
11.MW2, 12.MW1, 1.MWU, 2.MWU, 3.MWU, 4.MWU, 5.MWU are designated for
multi-family residential development,
c) the area marked on the plan drawing with the symbol 1.U is designated for
areas related to the permanent or long-term stay of children and youth.

§ 8.1. Within the archaeological sites presented on the plan drawing and in the case of discoveries of archaeological artifacts in the remaining area, earthworks must be preceded by archaeological research with the permission of the relevant heritage protection services.

2. Within the area presented on the plan drawing of the settlement trace from the late Middle Ages no. 366, earthworks must be preceded by archaeological research with the permission of the relevant heritage protection services.

§ 9.1. An archaeological conservation protection zone is established,
concerning archaeological artifacts, the boundary of which is identical to
the boundary of the area covered by the plan.

2. In the zone referred to in paragraph 1, earthworks related to
the construction of buildings and structures must be consulted with the relevant heritage protection services.

§ 10.1. Access to the areas is allowed only from adjacent
local streets, access roads, and internal roads, unless the provisions for the areas state otherwise.

2. The following provisions regarding parking vehicles apply:

1) parking spaces for passenger cars accompanying each category of land use must be provided at least in the number determined according to the following indicators:
a) for single-family residential development - 2 parking spaces per 1 residential house,
b) for multi-family residential development - 1.2 parking spaces per 1 apartment,
c) for collective housing - 10 parking spaces per 100 usable places,
d) for small-scale retail - 2 parking spaces per 100 m² of sales area,
e) for gastronomy and entertainment - 1 parking space per 100 m² of usable area,
f) for offices - 15 parking spaces per 1000 m² of usable area,
g) for cultural, exhibition, and sacred facilities - 1 parking space per 100 m² of usable area,
h) for cultural performance facilities - 20 parking spaces per 100 usable places,
i) for hotels - 5 parking spaces per 10 hotel rooms,
j) for medical clinics and medical offices - 15 parking spaces per 1000 m² of usable area,
k) for additional education facilities - 2 parking spaces per 100 m² of usable area,
l) for education - 2 parking spaces per 1 department,
m) for indoor sports facilities - 10 parking spaces per 100 usable places;
2) parking spaces mentioned in point 1 must be located on the land and plot or plots where the building is located, to which these spaces accompany;
3) independent single-level parking is allowed only as underground, subject to point 4;
4) independent single-level above-ground parking is allowed only on plots of single-family residential development.

§ 11. Technical infrastructure is allowed.

2. Technical infrastructure networks are allowed only as underground.

§ 12. The following areas are designated for public purposes: 1.KD-G, 2.KD-Z, 3.KS, 4.KD-L, 5.KD-L, 6.KD-L,
7.KD-L, 8.KD-L, 9.KD-L, 10.KD-L, 11.KD-L, 12.KD-D, 13.KD-D, 14.KD-D,
15.KD-D, 16.KD-D, 17.KD-D, 18.KD-D, 19.KD-D, 20.KD-D, 21.KD-D,
22.KD-D, 23.KD-D, 24.KD-D, 25.KD-PR, 26.KD-PR, 27.KD-PR, 28.KD-PR,
3.ZP2, 4.ZP2, 5.ZP2, 9.ZP3, 10.ZP3, 11.ZP3, 12.ZP3.

§ 13. The percentage rate is established, based on which the fee referred to in Article 36 paragraph 4 of the Act of March 27, 2003, on planning and spatial development, is determined for:

1) the area marked with the symbol 1.U at 30%;
2) the areas referred to in § 12 at 0.1%;
3) other areas at 3%.

Chapter 3
Provisions for the areas

§ 14.1. For the areas marked on the plan drawing with symbols 2.MN1,
4.MN1, 5.MN1, 6.MN1, 7.MN1, 9.MN1, 10.MN1, 11.MN1, 12.MN1, 13.MN1,
14.MN1, 15.MN1, 16.MN1, 18.MN1, 19.MN1, 21.MN1, 23.MN1, 24.MN1,
25.MN1, 26.MN1, 27.MN1, 28.MN1, 29.MN1, 30.MN1, 31.MN1,
32.MN1, 33.MN1, 34.MN, 35.MN1, 36.MN1, 37.MN1, 38.MN1, the following
purpose is established:

1) primary - single-family residential development;
2) complementary:
a) services I, subject to paragraph 2,
b) education,
c) technical infrastructure devices,
d) heat energy production,
e) road infrastructure,
f) telecommunications.

2. Within the designated purpose:

1) cultural promotion facilities, cultural houses,
media libraries, information centers, thematic clubs are not allowed;
2) medical clinics, health centers, dialysis stations, blood donation stations are not allowed.

3. In the areas referred to in paragraph 1, the following provisions regarding the shaping of development apply:

1) applicable building lines according to the plan drawing;
2) non-crossing building lines according to the plan drawing;
3) single-family residential buildings in terraced development are allowed only in areas marked with symbols 9.MN1, 13.MN1,
16.MN1, 19.MN1;
4) for terraced buildings, the continuity of applicable building lines must be interrupted on sections of at least 12 m, separated by no more than 50 m;
5) small-scale retail, minor entertainment services,
cultural promotion facilities, medical clinics, medical offices, small production are allowed only as utility premises in single-family residential buildings;
6) the height of antennas and their supporting structures placed on the roofs of buildings may not exceed 1/3 of the height of that building.

4. In the areas referred to in paragraph 1, the following provisions regarding land use apply:

1) within the categories of land use for offices, education, and nurseries,
the biologically active area must constitute at least 30% of the area of the building plot;
2) open storage and warehouse areas are not allowed.
