NOTICE OF THE FIRST AUCTION OF REAL ESTATE
BY ELECTRONIC AUCTION
Court Bailiff at the District Court Malgorzata Nowicka Bailiff's Office No. III in Zgorzelec based on art. 9864§3 of the Code of Civil Procedure announces to the public that

the first auction of real estate
in the mode of electronic auction specified in art. 9864 § 3 of the Act of November 17, 1964, the Code of Civil Procedure, located in the town of Ruszow, gmina Wegliniec having a land register established in the Land Registry Department of the District Court in Zgorzelec with the number JG1Z/000XXXXX/1 described as:
unbuilt land property (land plots No. 3 8, 41, 42, 62/3, 62/5, 63/1, 63/2, 66/11, 67/1).
The auction is held electronically and will end on 28.07.2025 at 11:00.
The property is valued at 234,000.00 PLN. The starting price in the above auction is: three quarters of the estimated value, i.e. the amount of 175,500.00 PLN.
Participants in the auction are required to submit a deposit of 10% of the estimated value of the property, i.e. 23,400.00 PLN no later than 2 business days before the auction starts, i.e. by 17.07.2025. The deposit must be submitted to the bailiff's bank account: 43116022020000000158991857 Bank Millennium SA Millennium - Settlement Center The date of the deposit is considered the day the bailiff's bank account is credited. Along with the deposit, the bidder is required to provide in the IT system the data necessary to issue a decision on the award: PESEL number, identity document number, and a statement of whether they are married, and if so, whether they intend to acquire the property for joint or personal property, as well as to indicate whether they are bidding in their own name or as an agent of another person, and any other data if the need to provide them arises from the provisions of separate laws.
According to art. 976 of the Code of Civil Procedure, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission. The presence of one bidder is sufficient to hold the auction.
In the last two weeks before the auction, the property can be viewed on weekdays from 8:00 AM to 6:00 PM. The protocol of description and valuation is made available in the IT system.
The rights of third parties will not hinder the auction and the award to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to exempt the items from enforcement and have obtained a judgment suspending the enforcement in this regard.
Usufruct, easements, and rights of a life tenant, if not disclosed in the land register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the award of ownership. A condition for participation in the auction is the creation of an individual account on the portal elicvtacie.komornik.pl
