Building plot in DabrowicaThe plot will be separated from a large 2-hectare property. The proposal concerns the separation of a plot with an area of approximately 36 ares - this results from the provisions in the local spatial development plan.
At the investor's request, the owner will separate a larger area.
In the local spatial development plan, the plot is designated MR - agricultural housing - with the following provisions:1) division into newly separated building plots with an area of not less than 1800 m² within the MR area is allowed;
2) the minimum width of the newly separated plot is set at 25 meters;
3) it is allowed to build residential and utility buildings up to 20% of the plot area;
4) it is necessary to ensure the location of at least 1 garage or parking space on each plot;
5) the following requirements are established for agricultural residential buildings:
a) height up to 2 floors, of which the second may be a usable attic,
b) ridge height up to 11 meters measured from the lowest point of the land within the building outline,
6) in the existing farm buildings:
a) the completion of buildings and major renovations is allowed,
b) the realization of a residential house for family members of the farmer is allowed within the homestead,
c) the designation of agricultural homesteads for low residential, holiday, or guesthouse purposes is allowed according to the conditions for the adopted land function;
d) there is an obligation to change the character of the building's shape and to plant greenery, enhancing aesthetic values, during modernization and change of function of the facilities;
7) the location of service facilities is allowed, as well as the use of residential and utility buildings for service functions, prohibiting the realization of facilities with nuisances exceeding the boundaries of the plot of the facility owner;
8) the realization of buildings at a distance of less than 30 meters from the wall of the forest or historical alleys is excluded;
9) the planting of isolation greenery from national and voivodeship roads is mandatory;
10) in addition, the following locations are allowed:
a) holiday buildings (ML),
b) low residential buildings (MN),
c) commercial service facilities (UC),
d) public service facilities (UP),
e) the separation of public green areas (ZP, ZI),
f) sports facilities (US),
g) technical infrastructure facilities,
h) communication facilities, except for technical service facilities and gas stations;
11) the facilities and devices mentioned in point 10 can be located on the condition that:
a) they constitute a supplement or enrichment of the primary designation,
b) do not violate the provisions for the leading function of the land,
c) the location of burdensome and particularly harmful services for the environment and human health or that may worsen the state of the environment is excluded,
d) the conditions for the provisions of the selected land function are maintained,
e) the compact area of the investment land cannot exceed the area: - 0.50 ha on soils of classes I to III, - 1.00 ha on soils of class IV organic soils, with no consent for the exclusion of land from agricultural production.
12) for new volumetric objects intended for permanent residence, a building line is established 90 meters from the edge of the roadway of express roads designated graphically on the plan drawing.
