Court Bailiff at the District Court Poznań-Grunwald and Jeżyce in Poznań Artur Kaczmarek, based on art. 986[4] § 3 of the Code of Civil Procedure, announces to the public that on 27-06-2025 at 11:00 AM through the IT system available at the address: e-licytacje. komornik. pl the second auction of the residential unit located at: 62-052 Walerianowo, ul. Brzozowa, for which the District Court Poznań Stare Miasto in Poznań VI Land and Mortgage Register Department keeps land and mortgage register number KW XXX, is initiated. The unit is a duplex located in a single-family residential building with two units, along with a 1/2 share in the common property.
The auction takes place through electronic bidding. The auction lasts 7 days and will end on 04-07-2025 as soon as the bids cease.
The estimated value is 852,000.00 PLN, and the starting price is equal to 2/3 of the estimated value, amounting to 568,000.00 PLN.
The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is 85,200.00 PLN.
According to art. 986 [5] § 1 of the Code of Civil Procedure, the deposit must be paid into the bailiff's bank account:

According to art. 986[5] § 2 of the Code of Civil Procedure, together with the deposit, the bidder is obliged to provide in the IT system the necessary data to issue the decision on the award: PESEL number, identity document number, and a statement of whether they are married, and if so, whether the property is intended to be acquired for the joint or personal property, as well as indicating whether they are bidding on their own behalf or as an attorney for another person, and any other data if required by separate laws.
The deposit submitted by the bidder awarded will be retained; it will be promptly returned to the other bidders. The bailiff confirms the fact of the deposit submission and data provision, as mentioned in § 2, immediately after their receipt, by allowing the bidder to participate in the auction. The refusal to allow participation in the auction will be notified to the interested party through the IT system.
A condition for participating in the auction is to create an individual account in the IT system. The method of conducting the sale of real estate by electronic auction and the method of authenticating users of the IT system servicing the electronic auction is defined by the regulation of the Minister of Justice regarding the method of conducting the sale of real estate by electronic auction and the method of authenticating users of the IT system servicing the electronic auction dated 27-10-2021 (Journal of Laws 2021, item 2005).
The auction starts and ends when indicated in the announcement of the real estate auction. During the auction, bidders offer the purchase price through the IT system. The auction is won by the bidder whose offer was the highest at the end of the auction. After the auction, the bailiff informs the bidders via the IT system of the selection of the bidder offering the highest price at the end of the auction.
Debtors, bailiffs, their spouses, children, parents, and siblings may not participate in the auction and people present at the auction in an official capacity, bidders who did not meet the conditions of the previous auction, persons who can acquire real estate only with the permission of a public authority, and who did not present this permission. The presence of one bidder is sufficient for the auction to take place. Power of attorney to participate in the auction should be confirmed by a document with an officially certified signature.
Rights of third parties will not hinder the auction and the award of ownership to the purchaser without reservations if these persons do not submit proof before the auction that they have brought an action for the release of the real estate or items seized with it from enforcement and have obtained a judgment suspending enforcement in this regard.
Usufruct, easements, and the right of lifetime ownership, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further enforcement process and will expire upon the validation of the decision on awarding ownership.
The IT system also provides access to the protocol of the description and valuation of the property.
According to art. 986[4] § 4 pt 4 of the Code of Civil Procedure, the property can be viewed on the day 23-06-2025 at 12:30 PM.
To the actions of the bailiff, a complaint can be submitted to the district court, unless the law provides otherwise. This also applies to the bailiff's failure to perform an action. The complaint shall be examined by the court competent due to the seat of the bailiff's office. No complaint is allowed against the bailiff's order to call for the removal of defects in the letter, the notification of the timing of the action, and the payment of tax on goods and services by the bailiff. A complaint can be submitted on an official form. A complaint is submitted within a week from the day of the action, when the party or person whose right was infringed or threatened by the bailiff's action was present at the action or was notified of its timing; in other cases - from the day of notification to the party or person whose right was infringed or threatened by the bailiff's action, and in the absence of notice - from the day the complainant learned about the action. A complaint regarding the bailiff's failure to act is submitted within a week from the day on which the complainant learned that the action was to be taken. The complaint is submitted to the bailiff who performed the contested action or failed to do so (art. 767 of the Code of Civil Procedure).
