NOTICE OF SECOND AUCTION OF PROPERTY BY ELECTRONIC AUCTION

The Court Bailiff at the District Court in Znin, Rafal Musial, announces to the public that in the case Km 1204/15 on the date: 11.08.2025 at 10:00 the second auction will begin in the manner established in art. 9864 § 4 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC) in electronic mode for the following properties:

- property located at ul. Dabrowskiego, 88-400 Znin, for which the District Court in Znin IV Land and Mortgage Register Department (address: ul. Sadowa 2, Znin, 88-400 Znin) maintains a land and mortgage register with the number XXX.

Property description:

The property consists of a built-up plot no. 559/2 with an area of 0.0175 ha. The property includes a residential building in a duplex structure with two floors, partially basement (built in 1938) with an annex of one floor (built in 1969) with a net building area of 64.69 m2, and an outbuilding with a net area of 17.76 m2. The property has connections to the electricity, water, and sewage networks with access to the building. The entrance to the building and the staircase are located partly on plot no. 559/2 and partly on the neighboring plot no. 559/3. No mutual land easements have been established for the use of the entrance and staircase.

The estimated value is 177,800.00 PLN, while the starting price is equal to 2/3 of the estimated value and amounts to 118,533.33 PLN.

In the two weeks before the auction, the above-mentioned property can be viewed on weekdays from 08:00 to 15:00. The protocol of description and valuation is made available in the IT system.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 17,780.00 PLN.

The deposit must be submitted to the bailiff's bank account 43 1020 1505 0000 0602 0009 0159 no later than 2 business days before the auction begins.

The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at elicytacje.komornik.pl and joining the auction two business days before it starts. The bidder submits the deposit no later than 2 business days before the auction starts, and if participating in the auction as a representative of another person, must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.

Based on art. 9864 § 2 CPC, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the above-mentioned properties are conducted electronically and will end on: 18.08.2025 at 10:00. Based on art. 9867po § 31 CPC, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until the bids cease.

The rights of third parties will not prevent the auction and the award to the buyer without reservations, if these persons do not submit proof that they have filed a lawsuit to exempt the items from enforcement and have obtained a judgment suspending the enforcement before the auction begins.

Usufruct, easements, and rights of a lifetime, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction begins, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the award of ownership.

According to art. 976 CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
