  NOTICE OF THE SECOND AUCTION OF REAL ESTATE

The Court Bailiff at the District Court in Piotrkow Trybunalski Agnieszka Rozycka based on art. 953 of the Code of Civil Procedure announces to the public that:

  on March 24, 2025 at 10:30 AM

in the building of the District Court in Piotrkow Trybunalski at ul. Juliusza Slowackiego 5 in room No. X there will be

  a second auction

2x 1/2 undivided part of the property consisting of:

A agricultural property - plots marked No. 15/1, 33/1, 33/2 precinct 0036 Kolonia Wola Kamocka, and plot marked No. 557 precinct 0009 Grabica with a total area of 2.8760 ha.

On plot marked No. 33/2 there is a single-storey residential building with a usable area of 123.90 m2 connected to a farm and inventory building with a usable area of 361.70 m2. The farm buildings include: garage rooms, storage rooms, and pigsty rooms. The built-up part of plot No. 33/2 has an area of 0.27 ha.

On plot No. 33/1, which is a separate property, there is a free-standing brick inventory building with a usable attic area of 78.50 m2 and a covered storage shed of steel construction with a building area of 130 m2 adjacent to the farm and inventory building. The built-up part of plot No. 33/1 has an area of 0.23 ha. The part of plots No. 33/1 and 33/2 where the buildings are located is fenced. The entrance to plot No. 33/2 is paved with cobblestones and concrete slabs. Part of the property is located along a road with an asphalt surface. The built-up part of the property has access to the electricity and water network. On plot No. 33/2 there is a deep well. The remaining plots that are part of the property are farmed, characterized by good agricultural culture.

The area where the valued property is located is not covered by a spatial development plan. According to the findings in the study, the built-up plot is located in the area of farm and single-family residential development, while the remaining part of plots marked No. 33/1, 33/2 and plot marked No. 15/1 is located in the area of agricultural land. Plot marked No. 557 is located in the area of green areas, located: the village of Lubanow, Kolonia Wola Kamocka, Grabica, gm. Grabica for which the District Court in Piotrkow Trybunalski, Land and Mortgage Register Department maintains the land and mortgage register with the number KW PT1P/000xxxxx/0, PT1P/000xxxxx/3.

The total valuation for each share is 399,600.00 PLN, while the starting price is equal to 2/3 of the valuation and amounts to 266,400.00 PLN (for each share)

Bidders wishing to purchase both shares must pay 2x the deposit in the amount of one-tenth of the valuation, which is 39,960.00 PLN. The deposit should be made in cash or in a savings book of banks authorized under banking law equipped with the owner's authorization to withdraw the entire deposit according to the court's valid decision on the loss of the deposit. The deposit can also be paid to the bailiff's account: PKO BANK POLSKI S.A. Branch in Piotrkow Tryb. 13 10203916 2109 0000 2003 1623 The deposit must be paid no later than the day before the auction. According to the provisions of art. 976 § 1 of the Code of Civil Procedure, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission, and other persons mentioned in this article cannot participate in the auction.

In the last two weeks before the auction, it is allowed to view the property on weekdays from 10:00 AM to 3:00 PM and to review in the District Court in Piotrkow Trybunalski at ul. Juliusza Slowackiego 5 a copy of the property valuation protocol, the expert's valuation report, an excerpt from the land register along with a map from the enforcement proceedings.

The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations, if these persons do not submit proof before the auction starts that they have filed a lawsuit to release the property or items seized with it from enforcement and have obtained a ruling in this regard suspending enforcement.

Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the ruling on the awarding of ownership.
