NOTICE OF THE FIRST AUCTION OF REAL ESTATE

IN THE COURSE OF ELECTRONIC AUCTION

The Court Bailiff at the District Court in Pabianice, Mariusz Kuzniak, announces to the public that in case Km 15/18

on the day: 19.09.2025 at 12:00

the first auction will commence in the manner specified in Article 986'* § 4 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC)

first auction in electronic mode

of the following properties: - fractional part of the property located at ul. Skośna 4, 95-200 Pabianice, for which the District Court in Pabianice, 5th Land and Mortgage Register Department (address: ul. Partyzancka 105/127, Pabianice, 95-200 Pabianice) maintains a land and mortgage register with the number LD1P/000xxxxx/2.

Description of the property: The subject of the auction is a 1/2 fractional part of plot no. 170/7 with an area of 0.0862 ha, it is unfenced, unpaved, covered with vegetation; it is located in the area of the urban unit marked with the symbol "KDW" - communication area - internal road.

The estimated value is 38,000.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 28,500.00 PLN.

In the two weeks before the auction, the above-mentioned property can be viewed on weekdays from 09:00 to 15:00. The protocol of description and valuation is made available in the IT system.

The bidder participating in the auction should submit a deposit in the amount of one-tenth of the estimated value, which is 3,800.00 PLN. The deposit must be paid to the bailiff's bank account 98 1020 3352 0000 1602 0245 9790 no later than 2 working days before the auction begins.

The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at elicytacje.komornik.pl and joining the auction two working days before it starts. The bidder submits the deposit no later than 2 working days before the auction starts, and if participating in the auction as an attorney for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.

Based on Article 986'* § 2 CPC, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the above-mentioned properties take place in electronic mode and will end on: 26.09.2025 at 12:00.

According to Article 986^po § 3* CPC, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until the bids cease.

The rights of third parties will not hinder the auction and the awarding to the buyer without reservations, provided that these persons do not submit proof before the auction starts that they have filed a lawsuit to exempt the items from enforcement and have obtained a ruling suspending the enforcement in this regard. Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.

According to Article 976 CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
