ANNOUNCEMENT OF UNLIMITED ORAL AUCTION The Mayor of the Gmina Jednorożec announces the second unlimited oral auction for the sale of the property listed below: based on Article 38, 40 section 1 point 1 of the Act of August 21, 1997 on real estate management /consolidated text: Journal of Laws 2024, item 1145 with amendments/ § 3, § 6 and § 13 of the Regulation of the Council of Ministers of September 14, 2004 on the manner and procedure for conducting auctions and negotiations for the disposal of real estate /consolidated text: Journal of Laws of 2021, item 2213/, § 3 section 1, § 5 of Resolution No. XXXII/159/06 of the Council of the Gmina Jednorożec of February 9, 2006 on determining the principles of acquisition, disposal and encumbering real estate and their leasing and renting for a period longer than 3 years, Order No. 10/2025 of the Mayor of the Gmina Jednorożec of January 20, 2025 regarding the sale of residential premises No. 2 in the residential building at ul. Seweryna Pienieznego 13 in Ostróda, constituting the property of the Gmina Jednorożec, marked with the land registry number 106/11, located in the geodetic area of Ostróda. Identification of the property according to the land registry and land book Land No. 106/11 KW No. EL1O/00034185/0 (premises) EL1O/00030246/8 (5/100 parts of the common property) Area of the premises Premises with an area of 32.8m2 (according to the land book data), according to EGiB 31.2 m2 Location and description The premises are located in the central part of the city of Ostróda, at ul. Seweryna Pienieznego 13/2 in a four-story, brick residential building, built in 1910, building area – 319 m2. The building is listed in the register of monuments of the Warmian-Masurian Voivodeship under No. A-2412. The residential premises are located on the 1st floor and include one room and one kitchen with a total usable area of 28.60 m2. The premises include a cellar with an area of 1.60 m2 and a toilet with an area of 1 m2 (access to the toilet directly from the staircase) - according to EGiB data from the District Office in Ostróda. A small bathroom annex with a WC and shower has been separated in the kitchen. Windows in the room – southwest exposure; kitchen – northeast exposure. The functional layout of the rooms is unfavorable, with an entrance from the corridor to the kitchen, from the kitchen to the room. The finishing of the rooms is of old type: wooden doors, PVC windows, floors covered with PVC roll carpet. The premises require renovation. The premises are equipped with electrical, water, gas, sewage, gravity ventilation, and central heating installations (municipal heating network). The gas meter in the staircase has been removed, and there is no data on the efficiency and technical condition of the installations. Purpose of the property According to the provisions of Resolution No. XLV/293/98 of the City Council in Ostróda of March 25, 1998, regarding the adoption of changes to the local spatial development plans of the city center of Ostróda (Journal of Laws of the Warmian-Masurian Voivodeship No. 9 of April 30, 1998, item 119) and Resolution No. XVII/123/2000 of the City Council in Ostróda of April 5, 2000, regarding the adoption of changes to the local spatial development plans of the city center of Ostróda (Journal of Laws of the Warmian-Masurian Voivodeship No. 28 of May 16, 2000, item 442): the property located at ul. Seweryna Pienieznego 13, marked with land registry number 106/11 in the area of 8 of the city of Ostróda is designated for purposes: S6MU4 – "residential-service". The plot is located in the conservation protection zone "B". Form of disposal Sale by way of unlimited oral auction Starting price (PLN) 135,000.00 PLN Cost of preparing the valuation (PLN) 830.00 PLN Starting price: 135,830.00 PLN (gross) Deposit (PLN) 27,166.00 PLN I. The sale of the property will take place for the highest price achieved in the auction, which will be held in the conference room of the Gmina Office in Jednorożec, ul. Odrodzenia 14, on September 9, 2025, at 10:00 AM. The price of the property will constitute the starting price in the auction. The sale price of the property is payable in full before signing the contract in the form of a notarial deed. II. The deadline for submitting applications by persons who had priority in acquiring the property based on Article 34 section 1 point 1 and 2 of the Act of August 21, 1997 on real estate management /consolidated text: Journal of Laws 2024, item 1145 with amendments/ expired on March 31, 2025. III. The deadline for developing the property: unspecified IV. The method of developing the property: in accordance with the purpose of the property. V. Property restrictions: the property is free from mortgage encumbrances, is not encumbered with rights, debts, or claims against third parties. VI. The auction is valid regardless of the number of participants in the auction, provided that at least one participant offers at least one bid above the starting price. The bid must be at least 1% of the starting price, rounded up to the nearest ten zlotys. VII. A condition for participating in the auction is to pay the deposit in cash by September 2, 2025, the proof of deposit payment must be presented to the auction committee before the auction opens. The deposit must be paid to the account: Limes Bank Cooperative Chorzele No. 95 8913 0005 0008 9597 2000 0050 (in such a way that by September 2, 2025, it is credited to the account of this Office, i.e., it has been posted). In the case of intending to acquire the property within the statutory community of marriage, the deposit must be paid by both spouses (the transfer title must indicate the data of both spouses). Both spouses must participate in the auction unless a written consent for the acquisition of the property is presented by the other spouse before a notary. The deposit paid by the participant who wins the auction will be credited towards the purchase price of the property. The remaining price of the property obtained in the auction must be paid by the buyer before the sale agreement is concluded in the form of a notarial deed. Other auction participants will receive a refund of the deposit immediately after the cancellation or closing of the auction, but no later than within 3 days from the date of cancellation, closing, invalidation, or negative outcome of the auction. VIII. The seller will notify the buyer of the place and date of the sale agreement no later than 21 days after the auction closes. IX. Consequences of refusing to conclude the sale agreement - if the person designated as the buyer of the property does not appear without justification to conclude the agreement at the place and time specified in the notification, the auction organizer may withdraw from concluding the agreement, and the paid deposit is non-refundable. X. Notarial costs, tax fees, and court fees are borne by the buyer of the property. Persons who pay the deposit within the time specified in point VII and present the auction committee with proof of payment before the auction opens may participate in the auction. Each person participating in the auction is required to have an identity document with them. XI. The auction organizer reserves the right to cancel the auction for important reasons. XII. This announcement is posted for at least 30 days (from 05.08.2025 to 08.09.2025) before the designated auction date at the seat of the Gmina Office in Jednorożec, ul.
