Terms of sale with an open hand as part of case number I
I). Subject of sale: Ownership right to the residential premises located in Walbrzych, ul. Rejtana 8, premises no. 3, with a total area of 101.20 m², consisting of 3 rooms, kitchen, bathroom, hall and pantry, for which the District Court in Walbrzych, VII Department of Land and Mortgage Registers maintains land and mortgage register KW no. SW1W/00038662/2.
II). Specification of the bankrupt: Justyna Wojnar, residing at 58-300 Walbrzych, ul. Rejtana 8/3.
III). Specification of the court and case number: District Court in Walbrzych VI Economic Department Ul. Slowackiego 11 58-300 Walbrzych, Case No. SW1W/GUp/5/2024.
IV). Basis for sale: Decision of the District Court in Walbrzych, VI Economic Department from February 24, 2025, Case No. SW1W/GUp/5/2024.
1). The sale takes place with an open hand, in a public offer.
2). The sale may take place for the highest price possible to obtain in the market, but not lower than 394,000.00 PLN.
3). The procedure for the sale with an open hand is written, offer-based – with the reservation of point 17 of these terms of proceedings.
4). The offer with the highest proposed sale price binds the bidder and constitutes the most favorable offer in the course of the offer procedure for the sale of the subject of the proceedings – until the decision of any auction mentioned in point 17 of these terms of proceedings.
5). The participant in the proceedings must, under the pain of exclusion from participation, pay into the account of the bankruptcy estate (account number: 78 1020 5242 0000 2602 0643 8305) a deposit by August 12, 2025. in the amount of 39,400.00 PLN.
6). The deposit paid by the bidder whose offer was selected is included in the purchase price, and if the sale agreement is not concluded within two months from the day of approval of the selection of the offer by the Commissioner Judge due to the fault of the bidder, the deposit is forfeited to the bankruptcy estate. Other bidders will have their deposits returned within 14 working days from the approval of the offer.
7). The bidder whose offer was selected is obliged to conclude the sale agreement within two months from the date of approval of the selection of the offer by the Commissioner Judge and by the date of conclusion of the agreement must pay the entire offered price.
8). The costs of verifying the object of sale and concluding the agreement shall be borne by the buyer.
9). The buyer agrees to exclude liability for physical and legal defects of the object of sale.
10). The conditions of the sale agreement set by the liquidator are not subject to negotiation; the liquidator has the right to choose the notary before whom the activities related to the sale will take place.
