Court Bailiff at the District Court in Zabkowice Slaskie Henryk Kupis Bailiff's Office, 1 Maja 8F, Zabkowice Slaskie, 57-200 Zabkowice Slaskie Signature: GKm 16/22 NOTICE OF FIRST AUCTION OF REAL ESTATE The Court Bailiff at the District Court in Zabkowice Slaskie, based on Article 953 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC), announces to the public that in case GKm 16/22 on the day 23-09-2025 at 12:20 in the building of the District Court in Zabkowice Slaskie located at 1 Swierkowa St., 57-200, room 21, the first auction will take place: - of the property located in Sulislawice, 57-200 Zabkowice Slaskie, for which the District Court in Zabkowice Slaskie, 5th Land Registry Department (address: 1 Swierkowa St., Zabkowice Slaskie, 57-200 Zabkowice Slaskie) maintains land registry number SW1Z/000XXXXX/1. Property description: the property constitutes plot no. 96 AM-1 with an area of 1.15 ha built with a residential building, single-family, in a free-standing development. This object is single-storey, basement, with an attic (usable area - ground floor and residential attic 150.19m2) - part is built within the B-RIIIa use. The building was probably constructed in the 1980s and has not been disclosed in the land registry. For the area where the property is located, there is a valid Local Spatial Development Plan for the village of Sulislawice in the municipality of Zabkowice Sl. (Resolution No. XLII/10/2013 of the City Council of Zabkowice Slaskie dated 28-02-2013). In this document, the property is located in the area marked as MU20 - residential and service-economic development areas, RM3 - farm development areas (eastern part of the plot) and KDD3 - public road areas (former access road) (fragment in the southwestern part of the plot). Additionally, plot no. 96 is within the boundaries of the archaeological protection zone and the cultural landscape protection zone. The total valuation is 731,400.00 PLN, while the starting price is equal to 3/4 of the valuation and amounts to 548,550.00 PLN. The bidder participating in the auction should submit a deposit of one-tenth of the valuation, which is the amount of 73,140.00 PLN. For two weeks before the auction, it is allowed to view the aforementioned property on weekdays from 08:00 to 10:00. The protocol of description and valuation can be reviewed at the District Court in Zabkowice Slaskie, 1 Swierkowa St., 57-200 Zabkowice Sl. According to Article 962 of the CPC, the bidder participating in the auction should submit the deposit no later than the day before the auction. The deposit should be submitted to the bailiff's account: Santander Bank Polska SA 72 1090 2372 0000 0006 0400 4445. The date of deposit submission is considered the day the bailiff's bank account is credited. The deposit may also be submitted in a savings book equipped with the owner's authorization to withdraw the entire deposit according to the legally binding court decision on the loss of the deposit. The presence of one bidder is sufficient for the auction to take place. The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations, provided that these persons do not submit evidence before the auction starts that they have filed a lawsuit to release the property or items seized with it from execution and have obtained a ruling suspending the execution in this regard. Usufruct, easements, and rights of a life tenant, if not disclosed in the land registry or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of execution and will expire upon the finalization of the ruling on the awarding of ownership. According to the provision of Article 976 § 1 of the CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
