ANNOUNCEMENT OF THE SECOND AUCTION OF THE PROPERTY
The Court Bailiff at the District Court in Zgierz, based on Article 953 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc) announces to the public that in the case Km 478/21 on the day 18-09-2025 at 14:30 in the building of the District Court in Zgierz located at Sokolowska 6, 95-100 Zgierz, room IX, the second auction will take place:
- of the property located at Lodzka, 95-011 Bratoszewice, for which the District Court in Zgierz V Land Registry Department (address: ul. Sokolowska 6, Zgierz, 95-100 Zgierz) keeps the land and mortgage register number XXX.
Description of the property:
An undeveloped land property marked as land plots with registration numbers: 567 and 568/1 with a total area of 0.4989 ha.
The estimated value is 406,000.00 PLN, while the starting price is equal to 2/3 of the estimated value and amounts to 270,666.67 PLN. The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is 40,600.00 PLN.
For two weeks before the auction, it is allowed to view the above-mentioned property on weekdays from 10:00 to 14:00. The protocol of description and valuation can be viewed at the District Court in Zgierz ul. Sokolowska 6, 95-100 Zgierz.
According to Article 962 kpc, the bidder participating in the auction should submit the deposit no later than the day before the auction.
The deposit should be paid to the bailiff's account: BANK 45 9263 0000 0920 0991 2010 0001.
The date of deposit submission is considered the day the bailiff's bank account is credited.
The deposit may also be submitted in a savings book equipped with the owner's authorization to withdraw the entire deposit according to the legally binding court decision on the loss of the deposit.
The presence of one bidder is sufficient for the auction to take place.
The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to release the property or items seized with it from execution and have obtained a ruling suspending the execution in this regard.
Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of execution and will expire upon the finalization of the decision on the awarding of ownership.
According to Article 976 § 1 kpc, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
