MAYOR OF THE CITY OF PUCK ANNOUNCES IV UNLIMITED PUBLIC AUCTION for the sale of property located in Puck. The subject of the auction is the sale of ownership rights to built property located at ul. Morskiego Dywizjonu Lotniczego 9 in Puck, consisting of a plot marked in the land registry no. 61 with an area of 287 m2 (district 2, precinct 4), use: B. For the above-mentioned property, a land and mortgage register no. GD2W/00059910/4 is maintained by the District Court in Wejherowo, IV Land and Mortgage Division. Sections III and IV of this register are free from entries for the aforementioned plot. The first auction for the sale of the aforementioned property took place on 02.10.2024. The second auction for the sale of the aforementioned property took place on 28.01.2025. The third auction for the sale of the aforementioned property took place on 14.05.2025. Property description: The property is built with a two-story residential building (with usable attic) with a registered building area of 171 m2 and a fragment of a single-story utility building. The buildings located on the aforementioned plot are not listed in the Municipal Register of Monuments. Both buildings are currently unused and qualify for a general renovation or demolition. The plot is partially fenced, flat. Access to the property is via an asphalt road ul. Morskiego Dywizjonu Lotniczego. The property has the possibility of connection to the electricity network, water supply network, and sewage network, while a gas network runs along the access road. Connection conditions (including distances and costs) to individual infrastructure networks must be individually agreed with the relevant network operator at the buyer's own effort and expense. Any removal of trees or shrubs must be done by the buyer at their own effort and expense, in accordance with applicable legal regulations. According to the currently applicable Local Spatial Development Plan, the property is located in an area marked in the MPZP (resolution XLVI/4/2010 of 25.02.2010): S.10.M,U (land card no. 172) - areas of urban residential-service development. Based on § 20 sec. 13 of the aforementioned resolution, for areas located in the unit marked with the symbol S, the location of parking spaces outside the area of their building plots is allowed, provided that the location of these spaces is determined and the landowner agrees to their location. Considering the interpretation of the building authority and case law, it should be indicated that parking spaces located outside the area of their building plots should have a permanent character, not defined in time, and meet the technical conditions provided for by law. The starting price of the aforementioned property is: 450,000 PLN net (in words: four hundred fifty thousand zlotys 00/100). The starting price of the property is given in net amount. The potential buyer is obliged to pay VAT if such an obligation arises from applicable legal regulations. According to currently applicable regulations, the sale of the aforementioned property will be exempt from VAT based on art. 43 sec. 1 point 10 of the Act of March 11, 2004 on goods and services tax (Journal of Laws of 2024, item 361, as amended). Other information: A condition for participation in the auction is the payment of a deposit. The deadline for the deposit is the date by which the funds must reach the above-mentioned bank account of the City Hall of Puck. In the title of the deposit payment, in addition to indicating the property subject to this auction, the payer should indicate the name and surname of the individual(s) or the name of the legal entity participating in the auction. 1. Individuals may participate in the auction if they pay the deposit within the time and amount specified in the announcement. Payment of the deposit means that the payer has familiarized themselves with the legal and factual state of the auction subject, including its technical and functional condition, and does not raise any objections or comments in this regard, and that they have familiarized themselves with the conditions recorded in the MPZP and the auction conditions. 2. Proof of deposit payment by the auction participant must be presented to the auction committee before the auction opens. 3. A condition for participation in the auction is to present to the auction committee documents such as: power of attorney for representation (if the auction participant does not act personally), a valid ID or other valid document confirming identity, and in the case of legal entities or individuals conducting business activity additionally: a printout from the KRS, a certificate of entry in the business activity register (for each of the partners), as well as a copy of the civil partnership agreement in the case of civil partnership partners. 4. The amount of the bid increase is determined by the auction participants, provided that the increase cannot be less than 1% of the starting price rounded up to the nearest ten zlotys. 5. The auction is valid regardless of the number of participants if at least one auction participant offers at least one increase above the starting price. 6. The deposit paid by the participant who wins the auction is credited towards the price obtained in the auction on the day of payment of the full amount due. The remaining part of the property purchase price must be paid no later than two days before the conclusion of the sale agreement. The deadline for payment of the remaining part of the property purchase price is the date by which the funds must reach the bank account indicated in the auction protocol. 7. Individuals who paid the deposit but did not win the auction will receive a refund of the deposit to the bank account they indicated. 8. The Mayor of the City of Puck will notify the person designated as the buyer of the property about the place and date of the sale agreement no later than 21 days from the date of the auction resolution. If the person designated as the buyer of the property does not appear without justification to conclude the sale agreement at the place and time indicated by the Mayor of the City of Puck in the notification, the auction organizer may withdraw from the conclusion of the agreement, and the paid deposit is non-refundable. The notary office should be located in Puck. 9. All costs, including notarial and court costs, related to the conclusion of the sale agreement in the form of a notarial deed for the property described above, shall be borne by the buyer. 10. The property is sold based on cadastral data contained in the land registry, and the renewal and demonstration of the boundaries of the sold property is possible at the cost and effort of the buyer. 11. A foreigner, within the meaning of the provisions of the Act of March 24, 1920 on the acquisition of real estate by foreigners (Journal of Laws of 2017, item 2278), should, in cases provided for by this Act, present the auction committee with the appropriate promise before the auction begins. In addition, a foreigner obliged by the aforementioned Act to obtain permission to acquire real estate must present it before signing the property transfer agreement, under penalty of losing the deposit. 12. Individuals participating in the auction are obliged before the auction opens to submit declarations: of familiarization with the auction conditions; of confirming the current status and validity of the submitted documents; of familiarization with the conditions recorded in the MPZP; of familiarization with the full content of the auction announcement and the factual and legal state of the auction subject, including its technical and functional condition, and that they raise no objections or comments regarding this state; of consent to the processing of personal data; of receiving the information clause regarding the processing of personal data; of meeting the conditions resulting from the Act on the acquisition of real estate by foreigners. 13. The Mayor of the City of Puck is authorized to request from the auction participant or their representative data including: first name(s) and surname, PESEL number, residential address, and address for correspondence, including email address. In the case of a person without Polish citizenship, instead of the PESEL number, the Mayor of the City of Puck may request the passport number or other identity document. 14. During the state of epidemic threat or epidemic state, the auction may be conducted using electronic communication means, of which the Mayor of the City of Puck will inform by posting information in the Public Information Bulletin (Journal of Laws of 2020, item 1698). 15. In justified cases, the Mayor of the City of Puck may withdraw from the auction, of which he will inform publicly, and in this case, the deposit is refundable to the indicated bank account.
