NOTICE OF THE SECOND AUCTION OF THE PROPERTY BY ELECTRONIC AUCTION

The Court Bailiff at the District Court in Jelenia Gora, Bailiff's Office No. VI in Jelenia Gora, announces to the public that in case GKM 143/19 on: 25.09.2025 at 11:00 an electronic auction will begin in the manner specified in Article 9864 § 4 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC) for the second auction of the following properties:

- fractional part of the property located at ul. Dzialkowicza, 58-500 Jelenia Gora.

Property description:

Share of 1/2 in the land property with an area of 0.0824 ha built with a detached residential building, located in Jelenia Gora on plot No. 110, precinct 0060, at ul. Dzialkowicza.

The estimated value is 822,945.00 PLN, while the starting price is equal to 2/3 of the estimated value and amounts to 548,630.00 PLN.

Within two weeks before the auction, the above-mentioned property can be viewed on weekdays from 08:00 to 14:00. The protocol of description and valuation is made available in the IT system.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 82,294.50 PLN. The deposit must be submitted to the bailiff's bank account 80 2030 0045 1110 0000 0298 3840 no later than 2 working days before the auction starts.

The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at elicytacje.komornik.pl and participating in the auction two working days before it starts. The bidder submits the deposit no later than 2 working days before the auction starts, and if participating in the auction as a proxy for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.

According to Article 9864 § 2 CPC, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the above-mentioned properties will take place electronically and will end on: 02.10.2025 at 11:00. According to Article 9867po § 31 CPC, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until the bids cease.

The rights of third parties will not prevent the auction and the award to the buyer without reservations if these persons do not submit proof that they have filed a lawsuit to exempt the items from enforcement and have obtained a judgment suspending enforcement before the auction starts.

Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the award of ownership.

According to Article 976 CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
