Who is selling.

Restructuring Advisor Pawel Choina license number 935 acting as the trustee of the bankruptcy estate of Dorota Plotnikiewicz, a natural person not conducting business activity based on the decision of the District Court Lublin-East in Lublin based in Swidnik IX Economic Department for Bankruptcy and Restructuring on 06.09.2024 in case LU1S/GU/756/2024.

Purpose of the announcement.

Selection through a competition of an Offeror to purchase shares in the ownership rights to the property included in the bankruptcy estate.

Subject of sale.

The subject of sale is a share of 1/3 in the ownership rights to the property included in the bankruptcy estate, which consists of plot no. 1470/1 located in Zawalow at number 166, with an area of 0.3773 ha, for which land register no. ZA1H/00084144/4 is maintained by the District Court in Hrubieszow, V Land Register Department.

The sale in bankruptcy proceedings is an enforcement sale. Thus, the buyer of the property is not liable for the obligations of the bankrupt.

The share in the ownership rights to the property has been valued by property appraiser Lukasz Sobczak at a price of 67,000.00 PLN.

Deposit

The condition for participation in the auction is the payment of a deposit of 1,700.00 PLN (one thousand seven hundred 00/100 PLN) to the bankruptcy estate bank account no. 81 1090 2590 0000 0001 5359 4935, which must be paid by 26.09.2024. The date of acknowledgment of funds in the bankruptcy estate account is decisive.

The paid deposit is forfeited to the bankruptcy estate in cases where:

  • the winning offeror does not pay the full amount in the manner and within three months from the date of selection of the offer,
  • does not conclude a sales contract within three months from the date of selection of the offer.

to other offerors, the deposit will be promptly returned after the trustee confirms the selection of the best offer, to the bank account indicated in the offers. No interest is due on the paid deposits;

Form of submitting offers

The sale of the bankruptcy estate component takes place under the rules specified in the Act of February 28, 2003 - Bankruptcy Law (Journal of Laws of 2015, item 233, as amended) "PU" and in other generally applicable regulations on the date of sale;

The starting price is set at 16,750.00 PLN net (in words: sixteen thousand seven hundred fifty 00/100 PLN) which constitutes 25% of the valuation price in the description of the court expert Lukasz Sobczak dated 09.10.2024. The sale price will be increased by the value-added tax (VAT) if it is due. The buyer pays the PCC tax if it is due.

Offers must be submitted in person or by mail to the trustee's office address by 26.09.2025.

Non-public opening of offers will take place on 30.09.2025 at the trustee's office.

The offer along with the required documents must be placed in a sealed envelope smaller than A4 format. The envelope must be addressed to the aforementioned trustee's office with a clear note "Offer to purchase Dorota Plotnikiewicz". This offer must be submitted to the trustee's office in person or by mail;

The offer must include the offered price in the net amount (exact amount designation) equal to at least the starting price and the designation of the offeror, including the PESEL number and phone number. The offer and all documents should be submitted in original or notarized copies;

The offer must be accompanied by proof of deposit payment.

In the case of a business entity, the offeror must attach a current excerpt from the KRS or the register of business entities;

Submitting an offer by the Offeror is equivalent to submitting a statement that:

i. they are aware of the legal and factual situation of the subject of sale and do not raise any objections in this regard,

ii. they agree to exclude liability for physical and legal defects under Article 558 § 1 of the Civil Code,

iii. they know the auction conditions and accept them,

iv. they know the technical condition of the properties included in the sold enterprise

v. they know the content of the description and the market value assessment of the bankruptcy estate for which they are submitting an offer and do not raise any objections to it;

vi. they agree to cover all fees and costs related to the conclusion of the purchase agreement;

vii. they have all permits and consents, if required by law due to the buyer's person;

viii. the offeror is entitled to conclude a purchase agreement for the subject of sale at the offered price;

ix. there are no grounds indicated in Article 157a sec. 2-3 PU;

In the event of more than one offer meeting the formal conditions, the trustee reserves the right to conduct a telephone auction

The offeror whose offer is selected is obliged to conclude a sales agreement in the form of a notarial deed within a maximum period of three months from the date of selection of the offer, and the entire offered amount must be paid no later than two days before signing the sales agreement, with the date of receipt of funds on the account indicated by the trustee being decisive;

Set-off of claims due to the buyer against the bankrupt

with the purchase price is inadmissible;

The costs of concluding the sales agreement are borne by the buyer, including the Notary's fees and court costs of all entries, including deletions from the land and mortgage register are borne by the buyer;

The buyer must notify the trustee in writing of the selection of the notary office within 7 days from the selection of the offer. If this deadline is missed, the trustee will indicate a notary;

Until the sale, the right to cancel the sale without giving reasons is reserved;

The trustee reserves the right to choose the notary office where the transfer of ownership agreement will be signed.

It remains at the trustee's discretion whether the transfer of the subject of sale or its part will take place before or after signing the ownership transfer agreement. The transfer will take place no later than on the day of concluding the ownership transfer agreement.

The buyer acquires components of the bankruptcy estate free of encumbrances and is not liable for the obligations of the bankrupt (Article 313 and 317 of the Act of February 28, 2003 - Bankruptcy Law (Journal of Laws of 2015, item 233, as amended));

In matters not regulated in the sales regulations, the provisions of the Civil Code and Bankruptcy Law apply;
