Syndic Jakub Taborski of the bankruptcy estate case no. GUp 430/20 of the District Court for Krakow Srodmiescie in Krakow, Economic Division VIII for bankruptcy and restructuring cases informs about the sale of a residential unit in the tender process.

The subject of the sale is the ownership right of residential unit no. 6 in building no. 7 at ul. Nowa in Bukowno with a usable area of 58.5 m2, consisting of 2 rooms, kitchen, bathroom with WC, and hallway, located on the 1st floor in a multi-family building. The property is covered by Land and Mortgage Register no. KR1O/00049493/1.

CONDITIONS FOR PARTICIPATION IN THE TENDER:

Prepare an offer, which must be submitted in a sealed envelope marked Tender Offer - Case no. GUp 430/20 delivered or sent by mail by 24.09.2025 to the address of the Syndic's Office Jakub Taborski in Chrzanow (32-500), ul. Sadowa 4B, with the date of submission of the offer sent by mail being considered the date of its dispatch at the post office. The sealed offer in the envelope must be placed inside another envelope, which will bear the address of the Syndic.


The opening of offers and selection of the bidder will take place on 01.10.2025 at 10:00 AM at the Syndic's office.

The written offer should include:
1. Name and surname, exact address, phone number (for individuals) or company name, exact address, phone, NIP, REGON, and a document confirming the legal status of the bidder, i.e. an excerpt from KRS or a certificate of entry in the business activity register,
2. Identification of the subject of the tender to which the offer pertains, including the land and mortgage register number,
3. The offered price expressed in words (indicating whether it is gross or net),
4. Specification of the payment method (cash payment or financing with a bank loan),
5. A written declaration that the bidder will cover the costs of the notarial sale agreement,
6. A written statement that the bidder has familiarized themselves with the factual and legal state of the subject of the tender and raises no objections to it,
7. A promise of permission from MSWiA for bidders who are foreigners and are required to obtain permission,
8. The bidder is obliged to declare that they are not:
a) A syndic or judge-commissioner,
b) A representative of the bankrupt,
c) A spouse, ancestor, descendant, sibling, and in-laws in the same line or degree of the persons mentioned in a-b
9. The bidder, along with the offer, is obliged to pay a deposit by 01.10.2025 as security in the amount of 10,000 PLN to the account PKO BP 38 1020 2384 0000 9402 0065 9417. In case of non-payment of the above amount, the offer will not be considered. The deadline for the return of the deposit is 10 working days from the date of opening the offers.
10. Confirmation of the deposit payment.

The tender will not take place if no offer meeting the conditions specified in the decision is submitted. However, an offer that meets the specified conditions binds the bidder until the end of the tender process. A period of four months is reserved for concluding the notarial agreement, counted from the moment of selecting the bidder. The syndic is not responsible for hidden defects of the subject of sale. The delivery of the subject of the agreement to the buyer will take place on the day of signing the transfer of ownership agreement.

The syndic reserves the right to change the conditions of the tender, as well as to cancel it without giving reasons. Subject to the powers of the judge-commissioner, the syndic reserves the right to conduct additional negotiations with bidders, the right to withdraw the subject from the tender, the right to withdraw from the sale at any time, and the right to invalidate the tender without giving reasons.

The sale price must be paid in full no later than the day before the conclusion of the sale agreement, with the payment being considered made on the date of crediting the bank account. There is a possibility of financing the property with a bank loan, the payment will be determined through the credit process with the syndic.

All costs related to the transfer of ownership, including notarial fees, fees related to entries in the land and mortgage registers, taxes, and others are borne by the buyer. The notary office handling the sale will be indicated by the syndic.
