The syndic of the bankruptcy estate appointed in the proceedings conducted under case number: KO1K/GUp-s/7/2025 sells an apartment in Darlowo: - The property is located at Kościelna Street 5 in Darlowo, - The residential unit is situated on the ground floor of a two-story former German tenement built of brick, - The usable area of the unit is 56.36 square meters, - The unit consists of two rooms, a kitchen, a bathroom, and a hallway, - The apartment is heated by a solid fuel stove, - The unit includes a storage room with a usable area of 7.28 square meters, - The land and mortgage register of the property: KO1K/0015678/5. Special price for forced sale 164,600 PLN. The first consideration of offers will take place on September 2, 2025, after 12:00 PM. In the case of similar priced offers, the syndic will arrange for an auction, where it is reserved that the auction will not be conducted in the sense of the Civil Code. Property viewings will take place: - On August 29, 2025, from 5:00 PM to 7:00 PM, - On August 30, 2025, from 5:00 PM to 7:00 PM, - On August 31, 2025, from 5:00 PM to 7:00 PM. Interested parties are requested to contact the syndic's office to provide information about planned attendance. SALES REGULATIONS: I. SALE OF PROPERTY, AFTER CONDUCTING AN AUCTION: - Ownership rights to the residential unit No. 1 with an area of 56.36 m2 consisting of 2 rooms, a kitchen, a bathroom, and a hallway along with the attached utility room of usable area 7.28 m2 and ½ share in the common parts of the property, i.e. in the right of perpetual usufruct of the land and in the co-ownership of the building at Kościelna Street No. 5 in Darlowo on plot No. 356 with an area of 0.0192 ha in the area of 0010 of the city of Darlowo. The land and mortgage register of the property number KO1K/00015678/5 is maintained by the District Court in Slawno IV Land and Mortgage Division. Bankruptcy estate component number 2.1. for a price not less than 164,600 (one hundred sixty-four thousand six hundred) PLN. II. DATES: 1. Offers for the purchase of the property must be submitted to the syndic's office at: ul. Piłsudskiego 6, 75-511 Koszalin or send a scan of the signed electronic offer (with a qualified signature or trusted profile) to the email box: (...), and in the case of an unsigned scan of the offer, it is reserved that the original signed offer must be delivered to the syndic's office no later than within 3 days from the date of sending the offer electronically. 2. The first consideration of offers will take place on September 2, 2025, after 12:00 PM. In the case of similar priced offers, the syndic will arrange for an auction, where it is reserved that the auction will not be conducted in the sense of the Civil Code. 3. Subsequent considerations in the case of the influx of further offers will take place weekly (on Tuesdays) starting from September 9, 2025 – depending on the influx of offers meeting the conditions contained in these regulations. 4. The bidder is obliged to provide contact details in the offer to the syndic in the form of a phone number that will allow contact on the day of the offer consideration. III. FORMAL REQUIREMENTS OF THE OFFER: - Each offer should include: - exact identification of the bidder – name and surname or company name and address of residence or registered office and contact details (phone number, email address), - offered price (to be stated in figures and words) in Polish currency – in the case of a difference, the higher price prevails, - proposed payment term – not longer than 30 days from the date of notification by the syndic of the approval of the offer, - a statement from the bidder that they have familiarized themselves with the technical and legal condition of the subject of sale and that this condition does not raise any objections, - a statement from the bidder that they have familiarized themselves with the sales regulations and do not raise any objections to its terms. - The syndic may require the submission of additional documents and statements with the offer or waive part of them. IV. OTHER SALES CONDITIONS: - The selection of the offer is made by the syndic after possibly conducting an auction. The syndic may postpone the auction to another date, of which they will inform the bidders. - The syndic may not select any of the presented offers. - The buyer is obliged to pay the purchase price to the bank account number 71 1160 2202 0000 0006 4769 1127 in Millennium Bank S.A. The syndic may require the buyer to pay a deposit of about 10% of the accepted purchase price within the time specified by them, from which they condition the binding nature of the offer. The payment term is considered the date of receipt of funds in the bankrupt's account. - Submission of an offer is simultaneously a statement that the bidder agrees to the conditions specified in the regulations, including the exclusion of liability for defects and limitation of the seller's liability for improper performance of the contract. Additionally, submission of an offer is equivalent to the bidder having fully familiarized themselves with the physical and legal condition of the subject of sale and not raising any objections to it. - All costs of submitting the offer and concluding the sales contract are borne entirely by the buyer, in particular notary and court costs. - The seller does not provide any guarantees and excludes liability for defects in the property. The syndic is liable for improper performance of the contract only if the damage occurred due to their gross negligence and within the limits of actual damage. Liability for improper performance of the contract is completely excluded due to the technical condition of the property. - It is presumed that the bidder participating in the competitive procedure is an entrepreneur. The entrepreneur cannot modify the provisions of these regulations. - The date and place of concluding the contract is indicated by the syndic. - The right to cancel the sales procedure in whole or in part or to withdraw without giving a reason is reserved.
