Description
The syndic of the bankruptcy estate invites written offers in the competition for the sale of ownership rights to a residential unit in Nysa, located at Głuchołaska Street. The residential unit is located on the ground floor of a two-story single-staircase multi-family residential building. The subject of sale is the ownership rights to the property covered by KW: OP1N/00061387/5, i.e. a residential unit with a usable area of 33.66 m2, consisting of one room with a kitchenette, a bathroom with a toilet, and a communication part, i.e. a hallway, located in Nysa at Głuchołaska 12B/12. There is no basement belonging to the unit. Along with the share in the common property, which consists of the land and parts of the building and devices that are not exclusively for the use of the owners of the units, amounting to: 75/2000 for KW no: OP1N/00039100/7. The starting price due to the forced sale is set at: 110,000 PLN (one hundred ten thousand zlotys) for the property covered by KW no: OP1N/00061387/5. There is an opportunity to familiarize oneself with the valuation report for the property. The syndic will provide the valuation report at the office or in electronic form by sending it via email. There is an opportunity to participate in the 'open house' day when interested parties can inspect the property. The planned date for the 'open house' is October 10, 2025, from 2:00 PM to 6:00 PM. It is possible to arrange an inspection of the property on-site with the syndic or the bankrupt at another time. The selection of the buyer will take place through a written offer competition. The condition for participation in the auction is to submit an offer to purchase the indicated subject of sale by October 23, 2025, and to pay a deposit of 11,000 PLN. Offers submitted after the deadline specified in § 2 point 2 or without the deposit payment will not be considered. The day of the deposit payment is considered the day the syndic's bank account is credited. An offer without the full deposit amount paid on time or with the deposit paid after the designated deadline will not be considered. The deposit should be paid to the deposit account: mBank no: 58 1140 2004 0000 3002 8482 9828. In the payment title, please indicate the KW number of the property to which the deposit relates. The offer should include: the bidder's data - name and surname, company, address of residence or registered office, current excerpt from the register of entrepreneurs, account number for potential deposit return, as well as email address and contact phone number, the bidder's signature or signatures of persons authorized to represent the bidder according to the excerpt from the register, in the case of having a NIP and REGON number or in the case of foreign entities, the number assigned by the relevant tax or statistical authority, the offered price in PLN for the selected subject of sale, payment method and payment deadline, permits and consents - if required by law due to the bidder's person, it is allowed to attach a promise in place of the permit if obtaining it is not possible or is difficult, a statement of having read the Competition Regulations and acceptance of its terms, a statement by the bidder that they undertake to pay the price for the subject of sale no later than the day before the designated day of concluding the sale agreement for the subject of sale, a statement by the bidder that they undertake to cover all costs associated with the transfer of ownership of the subject of sale, a statement stating that the bidder is not a close person in relation to the syndic and the judge in this proceeding, proof of deposit payment. The offer and other documents should be prepared in Polish. Authorization to sign offers and other documents should be attached to the offer unless it follows from other documents attached by the bidder. The offer should be submitted in a sealed envelope marked: "Auction for the purchase of property OP1O/GUp-s/320/2024". The opening and public consideration of offers will take place on October 30, 2025, at 12:00 PM at the syndic's office in Opole at Plebiscytowa 3/18. A protocol will be drawn up from the opening and consideration of offers. The protocol lists the offers in the order of their submission, as well as the persons present at the opening. The selection of the most advantageous offer is made by the syndic. The public may be present at the opening of the offers. If an offer is submitted with a price lower than the starting price or which does not meet all the requirements specified in the Regulations, the offer will not be considered. The criterion for evaluating an offer that meets all the requirements specified in the Regulations is the highest offered price. The winner of the auction is the bidder whose offer was selected by the syndic. The auction does not take effect if none of the bidders submits an offer that meets all the requirements specified in the auction regulations. The sale agreement for the subject of sale will be concluded no later than one month after the decision to approve the selection of the offer by the judge becomes final. The deadline begins no earlier than the moment of delivery of the copy of this decision. The sale agreement for the subject of sale will be drawn up at the notary office indicated by the syndic. The day of concluding the sale agreement for the subject of sale will be indicated by the syndic, who will inform the buyer in writing no later than 14 days before the day of concluding the agreement. The payment of the purchase price for the subject of sale will take place in full no later than the day before the day of concluding the sale agreement (the date of crediting the syndic's bank account is decisive), without making any deductions, to the account indicated for the deposit payment. All fees related to the acquisition of the auction subject are borne by the buyer. The deposit paid by the bidder whose offer was selected by the syndic is credited towards the purchase price of the subject of sale. The deposit is forfeited if the sale agreement for the subject of sale is not concluded due to the fault of the bidder within the time specified by the syndic. The deposit paid by the bidder whose offer was not selected by the syndic is returned immediately after the day of consideration of the offers. The day of return of the deposit is considered the day of debiting the syndic's bank account. Warranty for physical and legal defects of the subject of sale is excluded. The syndic reserves the right to determine that the auction did not yield the expected result (does not take effect) at any stage of the proceedings without giving reasons. In cases where the difference between the two highest valid offers in the auction is less than 12.5% of the value of the highest offer, the syndic may order a second stage of the auction, at their discretion, in written or oral form. The auction in the second stage is a closed auction, only all bidders who submitted valid offers in the first stage are invited to participate. The deposits paid remain valid in the second stage of the auction. The starting price in the second stage of the auction will be equal to the highest offer submitted in the first stage. The first offer is considered the highest offer of the first stage. In justified circumstances, the syndic may negotiate with the bidder or bidders, including those whose offers did not meet the formal requirements, to obtain the most advantageous price for the sold property. A protocol will be drawn up from the course of the auction in the second stage or negotiations, containing a list of submitted offers, persons present at the opening of the offers, and the syndic's decision on the selection of the offer, for submission to the supervising judge. The protocol may also include statements from persons present at the opening of the offers. In the case of conducting the auction in oral form, the protocol includes a statement from the participants in this form of the auction about their consent to participate, as the starting price is entered as the highest price previously offered and proposed bids. The highest of the offered bids, after being called three times and no higher bid being offered, is binding for the syndic as the organizer and for the bidders participating. In such a situation, the syndic indicates the winner of the auction, whose offer receives the bid and will be submitted to the supervising judge for approval. At the request of the winner of the second stage of the auction organized in oral form, a certificate of the bid awarded by the syndic is issued to them.
