Individuals and legal entities as well as organizational units without legal personality established in accordance with the provisions of law and which are granted legal capacity by separate provisions may participate in the auction, provided they have the status of an entrepreneur within the meaning of Article 431 of the Civil Code, as well as the status of an active VAT taxpayer within the meaning of the Act of March 11, 2004 - on goods and services tax. The entrepreneur status and active VAT taxpayer status must be held both at the time of submitting the offer to purchase the auction item and at the time of concluding the sales agreement for the auction item or conditional sales agreement and agreement transferring ownership of the auction item (disposal agreement). The offer along with the required documents should be placed in a sealed envelope, which should be placed in a second, larger envelope.
