Conditions of sale by private sale in the proceedings number I
I). Subject of sale: Ownership rights to a residential premises located in the town of Boguszow-Gorce at ul. Kopernika 12, premises no. 2, consisting of 2 rooms, kitchen, WC and hallway, with a total area of 53.60 m2, for which the residential premises the District Court in Walbrzych, VII Land Registry Department maintains land and mortgage register KW no. SW1W/00025562/7.
II). Identification of the bankrupt: Marta Owcarz, residing at 58-372 Boguszow-Gorce, ul. Mikołaja Kopernika 12/2.
III). Identification of the Court and case number: District Court in Walbrzych, Economic Department VI, ul. Slowackiego 10, 58-300 Walbrzych, Case No. SW1W/GUp-s/292/2024.
IV). Basis for disposal: art. 491(11a) paragraph 2 of the Act of February 28, 2003 Bankruptcy Law (Dz.U.2024.794 t.j.).
1). The sale takes place by private sale, in a public offer.
2). The sale may take place for the highest price possible to obtain on the market, but not lower than 222,000.00 PLN.
3). The procedure for the sale by private sale is written, offer-based – subject to point 17 of these conditions of proceedings.
4). The offer with the highest proposed sale price binds the bidder and constitutes the most advantageous offer in the course of the offer proceedings for the sale of the subject of the proceedings – until the resolution of any auction referred to in point 17 of these conditions of proceedings.
5). Participants in the proceedings must, under penalty of exclusion from participation, pay into the bank account of the bankruptcy estate (account number: 58 1020 5242 0000 2202 0663 1503) a deposit by August 26, 2025 in the amount of 22,200.00 PLN.
6). The deposit paid by the bidder whose offer was selected is credited to the purchase price, and in the event of failure to conclude the sale agreement within two months from the date of approval of the selection of the offer by the Commissioner Judge due to the fault of the bidder, the deposit is forfeited to the bankruptcy estate. Other bidders will have their deposits returned within 14 working days from the approval of the offer.
7). The bidder whose offer was selected is obliged to conclude the sale agreement within two months from the date of approval of the selection of the offer by the Commissioner Judge and by the date of concluding the agreement must pay the entire offered price.
8). The costs of checking the subject of sale and concluding the agreement are borne by the buyer.
9). The buyer agrees to exclude liability for physical and legal defects of the subject of sale.
10). The conditions of the sale agreement established by the syndic are not subject to negotiation; the syndic is entitled to choose the notary before whom the activities related to the sale will be carried out.

13). Submission of one offer is sufficient to effect the sale.
14). Offers in Polish or translated into Polish by a sworn translator in sealed envelopes preventing their opening with a clear and legible identification of the bidder, as well as with the note "Proceedings for sale - SW1W/GUp-s/292/2024 – DO NOT OPEN" must be submitted by August 26, 2025 to the address: Syndic Office, Court Supervisor, Manager Dr. Michal Blaszczyszyn, PO Box 102, 53-350 Wroclaw 15. The date of receipt is decisive.
15). The opening of offers will take place on August 28, 2025, at 9:00 AM, place of opening offers: Syndic Office in the presence of all interested parties.
16). The opening of offers will be carried out in terms of compliance with the conditions of the offer proceedings, which are specified above and the proposed purchase prices.
17). In the case of equivalent offers, an oral auction may be held on August 28, 2025, at 9:15 AM, place of auction: Syndic Office with the following conditions:
18). The selection of the most advantageous offer will be made by the syndic, the selection requires the approval of the Judge - Commissioner.
19). The price must be paid no later than at the time of concluding the agreement – before its conclusion.
20). In matters not regulated by these conditions, the provisions of the Bankruptcy Law and the provisions of the Civil Code shall apply accordingly.
21). The possibility of canceling in whole or in part the sale proceedings or its annulment at any stage of the proceedings without giving a reason is reserved.
