The Syndic of the Bankruptcy Estate in the bankruptcy proceedings marked with the case number RZ1Z/GUp/28/2023 invites offers for the purchase of a real estate property built with a detached single-family residential building, single-story with usable attic, non-basement, with a building area of 154.32 m2 and usable area of 187.74 m2, brick, covered with sheet metal roofing, with a garage in the building structure. 1. The organizer of the auction is the Syndic of the Bankruptcy Estate in the bankruptcy proceedings marked with the case number RZ1Z/GUp/28/2023;
2. The subject of the auction includes:
1) the real estate property built marked in the land registry as plot 687/20, for which the District Court in Tarnobrzeg maintains the land and mortgage register number TB1T/00061624/6,
2) a 1/5 share in the ownership of the real estate property marked in the land registry as plot 687/24, for which the District Court in Tarnobrzeg maintains the land and mortgage register number TB1T/00059195/2;
3. The starting price of the auction subject is the amount of 998,998.00 PLN (in words: nine hundred ninety-eight thousand nine hundred ninety-eight zlotys zero groszy) net, which will be increased by the appropriate tax (PCC);
4. An unlimited circle of entities may participate in the auction;
5. Participants in the auction have the opportunity to inspect the auction subject after prior arrangement with the syndic;
6. Detailed information about the auction subject is contained in the valuation report prepared by a property appraiser, available for inspection at the syndic's office at Al. Jana Pawła II 25/217, 37-450 Stalowa Wola, after prior arrangement of the inspection date;
7. The condition for participating in the auction is:
1) payment of a deposit in the amount of 10% of the net starting price of the auction subject, i.e. the amount of 99,899.80 PLN (in words: ninety-nine thousand eight hundred ninety-nine zlotys eighty groszy), which must be made within four weeks from the date of publication of the invitation to submit offers on the "OLX" website, to the bank account appropriate for servicing the bankruptcy proceedings of the Debtor:

provided that only payments that are credited to the above-mentioned bank account appropriate for servicing the bankruptcy proceedings of the Debtor by the last day of the above-mentioned deadline will be considered as a timely deposit. The payment receipt must indicate "Deposit - auction RZ1Z/GUp/28/2023" and provide the name and surname or the name of the participant in the auction. Payments that do not meet the above requirements will not be recognized as effectively made deposits, which will mean the inability to participate in the auction;
2) submission of a written offer in a sealed envelope marked "Auction - RZ1Z/GUp/28/2023 - do not open", at the syndic's office at Al. Jana Pawła II 25/217, 37-450 Stalowa Wola, within four weeks from the date of publication of the invitation to submit offers on the "OLX" website, on business days from 8:00 AM to 6:00 PM (actual receipt at the syndic's office).
8. Each offer must include:
1) exact identification of the offeror, i.e.:
a) in the case of a natural person not conducting business activity: name and surname, residential address, PESEL number,
b) in the case of an entrepreneur being a natural person: name and surname, the company under which the business activity is conducted, as well as the address of the place of conducting this business activity, and the NIP of this person,
c) in the case of an entrepreneur other than a natural person: specification of the legal form of the offeror, indication of the company, registered office and address of the offeror, registration number in KRS and NIP,
2) written statements of the offeror that:
a) there are no reasons, as referred to in the provisions of the Act of February 28, 2003 on Bankruptcy Law, excluding the possibility of acquiring by the offeror things or rights in the bankruptcy proceedings conducted against the Debtor,
b) the offeror has familiarized themselves with the legal and technical states of the auction subject and accepts them without reservations;
c) in the event of the selection of the offer of the offeror, the offeror undertakes to pay the offered price, as well as to cover all taxes, fees, and costs related to the sale of the auction subject,
d) the offeror has familiarized themselves with the sale conditions and accepts them without reservations;
e) the offeror consents to the exclusion of liability for physical and legal defects of the auction subject;
f) the offeror consents to the processing of personal data in the scope of data disclosed in the offer for the purpose of preparing and concluding the sales contract for the auction subject under these sale conditions;
g) the offeror, before submitting the offer, has been instructed by the Syndic about the provisions of the Act of April 23, 1964, the Civil Code, and the provisions of the Act of February 28, 2003 on Bankruptcy Law, and that they understood their content and do not raise any comments or reservations in this regard,
h) the submitted offer is unconditional and irrevocable;
3) indication of the offered sale price of the auction subject, provided that the offered sale price must be expressed both numerically and in words and cannot be lower than the minimum price of the auction subject, i.e. it cannot be lower than 998,998.00 PLN (in words: nine hundred ninety-eight thousand nine hundred ninety-eight zlotys zero groszy) net. In the event of discrepancies between the value expressed numerically and the value expressed in words, the price expressed in words shall prevail.
4) a legible signature of the offeror being a natural person or legible signatures of persons authorized to represent the offeror who is not a natural person.
The Syndic reserves the right to change the auction conditions and to cancel the auction at any stage of its conduct without giving reasons.
