NOTICE OF THE FIRST AUCTION OF THE PROPERTY
The Court Bailiff at the District Court in Pisz Bailiff's Office No. III in Pisz based on Article 953 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc) announces to the public that in case Km 365/23 on September 19, 2025, at 12:00 in the building of the District Court in Pisz located at Warszawska 47, 12-200 Pisz, room I, the first auction will take place:
- of the property located in m. Zdory, 12-200 Pisz.
Property description:
The property located at: 12-200 Pisz, Zdory (plots no. 54/46, 54/47, 54/48) with a total area of 10,000.00 m2, undeveloped.
The estimated value is 528,000.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 396,000.00 PLN.
The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 52,800.00 PLN.
For two weeks before the auction, the above-mentioned property can be viewed on weekdays from 07:30 to 15:30. The protocol of description and valuation can be reviewed at the District Court in Pisz ul. Warszawska 47, 12-200 Pisz.
According to Article 962 of the kpc, the bidder participating in the auction should submit the deposit no later than the day before the auction. The deposit should be submitted to the bailiff's account: BNP Paribas Bank Polska S.A. 16 1600 1462 1850 5433 6000 0003. The date of deposit submission is considered the day the bailiff's bank account is credited.
The deposit may also be submitted in a savings book equipped with the owner's authorization to withdraw the entire deposit according to the court's valid decision on the loss of the deposit. The presence of one bidder is sufficient for the auction to take place.
The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to release the property or items seized with it from enforcement and have obtained a ruling suspending enforcement in this regard.
Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the ruling on the awarding of ownership.
According to Article 976 § 1 of the kpc, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, a bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
