The bankruptcy trustee of Ewa Plichta - Waldemar Lukaszowicz is selling the assets of the bankruptcy estate of Ewa Plichta, a natural person not conducting business activity, under the following conditions: 1. The subject of sale is: a) a plot of land located in Gorzyce, constituting plot no. 334/37, for which the District Court in Wodzislaw Slaski, V Land Registry Department maintains land registry no. GL1W/00070763/8 ("Property"); b) a 1/5 share in the land property located in Gorzyce, constituting plot no. 329/37, for which the District Court in Wodzislaw Slaski, V Land Registry Department maintains land registry no. GL1W/00070764/5 ("Share"). The Property and the Share are sold together. The starting price is 91,600.00 PLN (Property – 86,480.00 PLN, Share – 5,120.00 PLN). 2. The sale of the Property and the Share is based on the Act of February 28, 2003 Bankruptcy Law and the Civil Code. 3. The sale may occur for a price not lower than the indicated starting price. 4. A detailed description of the subject of sale will be provided by the bankruptcy trustee in response to the bidder's inquiry. 5. The sale will occur to the bidder offering the highest price, for a price not lower than the minimum price. 6. The following cannot participate in the sale proceedings: the bankrupt, the trustee, their spouse, children, and those present during the consideration of offers in an official capacity. In other respects, the circle of bidders is unlimited. 7. The offer must include: - identification of the bidder, - proposed purchase price, - signature of the bidder or a person authorized by the bidder acting on their behalf, - phone number, email address, - current excerpt from KRS, CEIDG, or other register (depending on the legal form of the bidder) or a notarized copy of the ID if the bidder is a natural person, - original or a notarized copy of any granted power of attorney, - a statement agreeing to cover all costs related to the transfer of ownership, - a statement confirming familiarity with the state of the subject of the proceedings, including legal and technical aspects, and a statement agreeing to exclude liability for physical and legal defects under Article 558 of the Civil Code, - a statement that the bidder does not belong to the group of persons specified in point 6 of these conditions, - confirmation of payment of the deposit for the purchase of the subject of sale, i.e. 10% of the starting price, i.e. 9,160.00 PLN. 8. An offer that does not include at least one of the elements specified in point 7, submitted after the deadline or with a failure to pay the deposit will not be considered. 9. Offers in Polish or translated into Polish by a sworn translator in sealed envelopes preventing their opening with a clear and legible identification of the bidder, as well as the note "Sale proceedings of the property Ewa Plichta DO NOT OPEN" must be delivered by August 19, 2025, to the address: "Law Office of the Trustee Waldemar Lukaszowicz, ul. Daszynskiego 59/8, 44-100 Gliwice". The date of receipt counts. 10. The bidder must pay a deposit of 10% of the starting price to the bankruptcy estate's bank account: 49 160*******1711 7623 7000 0001. Submission of at least one offer is sufficient to conduct the sale proceedings of the aforementioned asset. 11. The consideration of offers will take place on August 20, 2025, at 09:00, at the Trustee's Office in Gliwice in the presence of all interested parties. The trustee will select the most advantageous offer based on the price criterion. The bidder whose price is accepted will be promptly notified electronically. 12. The trustee is obliged to sign the sale agreement with the bidder within four months from the date of selection of the offer. 13. The sale price must be paid in full no later than the day of signing the sale agreement - before its conclusion. The transfer of ownership of the offered asset will occur after the bidder has paid the full price. 14. The deposit submitted by the bidder whose offer was selected by the trustee will be credited towards the purchase price. The remaining bidders will have their deposits returned without interest within 7 days from the date of selection of the offers. 15. If the buyer fails to meet the conditions of the offer within four months from the date their offer was selected by the trustee, they will lose the deposit and be excluded from the proceedings. 16. The costs of checking the subject of sale and concluding the sale agreement at the place indicated by the trustee will be borne by the buyer. 17. The buyer agrees to exclude liability for physical defects of the subject of sale. 18. In matters not regulated by these conditions, the provisions of the Bankruptcy Law and the Civil Code apply accordingly. 19. The possibility of canceling the proceedings in whole or in part or invalidating it at any stage without giving reasons is reserved.
