The President of the City of Dabrowa Gornicza, performing tasks in the scope of government administration, announces that on September 25, 2025, at the City Hall in Dabrowa Gornicza at Graniczna Street 21, the following auctions for the sale of properties owned by the State Treasury will take place: * 11:00 AM - third unlimited oral auction for the sale of undeveloped property located in Dabrowa Gornicza at Jaskolcza Street, marked as geodetic number 2997 with an area of 620 m2 (Zabkowice district). As of the date of the auction announcement, the land register is maintained for the property with a total area of 0.5019 ha, the subject plot is registered under number 5 (identifier 246501_1.0018.2997). Sections I-Sp, III, and IV of the land register are free of entries. The first unlimited oral auction for the sale of this property took place on April 3, 2025, and the second on July 3, 2025. The starting price of the property: 115,200.00 PLN. Deposit: 23,040.00 PLN. The auction price will be subject to VAT at the rate applicable on the date of sale (currently this rate is 23%). In the event of changes to the regulations on goods and services tax, the rates will be adjusted to those applicable on the date of sale of the property. The undeveloped, unutilized plot has an elongated shape similar to a rectangle, narrow (with a width of less than 16 m), covered with disordered low greenery. The area is unfenced, slightly sloping towards the south. The plot has access to a public road. An underground power network runs along the eastern boundary of the plot. Nearby, there are technical infrastructure networks in the form of an overhead power network, water supply, and gas. The sewage network runs at a further distance (about 360 m). Connection of the facility to the technical infrastructure network will be possible under the conditions specified by the network operators. According to the classification of land use contained in the land and buildings register, the plot constitutes arable land (RIVa). The property is free of encumbrances and is not subject to any obligations. According to the current "Local Spatial Development Plan of the City of Dabrowa Gornicza for areas located in the vicinity of the Young Steelworkers and Wygielzow estate" approved by Resolution No. XXIII/454/13 of the City Council in Dabrowa Gornicza on January 30, 2013, as amended (consolidated text Resolution No. LXII/1106/2023 of the City Council in Dabrowa Gornicza on December 13, 2023, Journal of Laws of the Silesian Voivodeship, item 9962 of December 21, 2023), the plot is located in the area marked with symbols: 14MN - areas for single-family residential development and 9KDW - internal road areas (about 1% of the plot area). In the area covered by the plan, among others, in the areas of single-family residential development marked with the symbol MN, it is allowed to situate a building at a distance of 1.5 m or directly at the boundary with the neighboring building plot (§4 sec. 3 point 3 of the above resolution). * 11:30 AM - third unlimited oral auction for the sale of undeveloped property located in Dabrowa Gornicza at Jaskolcza Street, marked as geodetic number 3001 with an area of 947 m2 (Zabkowice district). As of the date of the auction announcement, the land register is maintained for the property with a total area of 0.5019 ha, the subject plot is registered under number 8 (identifier 246501_1.0018.3001). Sections I-Sp, III, and IV of the land register are free of entries. The first unlimited oral auction for the sale of this property took place on April 3, 2025, and the second on July 3, 2025. The starting price of the property: 175,300.00 PLN. Deposit: 35,060.00 PLN. The auction price will be subject to VAT at the rate applicable on the date of sale (currently this rate is 23%). In the event of changes to the regulations on goods and services tax, the rates will be adjusted to those applicable on the date of sale of the property. Detailed conditions for the development of the subject properties (including orders and prohibitions) are included in the provisions of the above local spatial development plan, which should be reviewed in the Urban Planning Department or on the website of the Public Information Bulletin: (tab: Subject lists → Spatial planning, Monuments → Applicable documents → Local plans). The auctions will be conducted based on the Act of August 21, 1997 on real estate management and the provisions of the Regulation of the Council of Ministers of September 14, 2004 on the manner and procedure for conducting auctions and negotiations for the sale of real estate. The condition for participation in the individual auctions is the payment of the amounts specified in this announcement as a deposit in cash to the account of the City Hall in Dabrowa Gornicza no. 57 1560 0013 2002 3620 7000 0049 in VeloBank S.A. (indicating the designation of the property and the auction participant - in the case where the participant is another entity than the one making the payment), by September 17, 2025. /The date of payment of the deposit is considered to be the date of receipt of the funds in the account of the City Hall/. The deposit will be returned immediately (but no later than within 3 days) after the closing, cancellation, invalidation, or negative result of the auction. The deposit made by the participant who wins the auction will be credited towards the purchase price of the property. Persons entitled to compensation for leaving the property outside the current borders of the Republic of Poland due to expulsion from the former territory of the Republic of Poland or leaving it due to the war that began in 1939, if they announce their participation in the auction, present the original certificate or decision confirming the right to credit the value of the property left outside the current borders of the Polish state (with a note from the voivode on the chosen form of realization of the right to compensation and the amount of compensation) and submit a written commitment to pay an amount equal to the amount of the deposit established in case of evasion of concluding the contract. This statement must be submitted at the office before the deadline for the deposit payment. The President of the City will notify the person designated as the Buyer of the property about the place and date of concluding the sale agreement in a written notification, no later than within 21 days from the date of the auction resolution. In the event of the Buyer failing to appear for the notarial agreement without justification, i.e. not appearing at the place and time indicated in the notification or failing to pay the sale price of the property in the amount and time specified therein (the date of payment is considered to be the date of receipt of the funds in the account of the City Hall), the President of the City may withdraw from concluding the agreement, and the deposit paid will not be refunded. The purchase price of the property will be payable before signing the notarial agreement, no later than 3 days before the date of concluding the notarial agreement. The acquisition of property by foreigners may occur upon obtaining permission from the Minister of Internal Affairs, if required by the provisions of the Act of March 24, 1920 on the acquisition of real estate by foreigners. The Buyer is obliged to determine on their own whether the acquisition of the property subject to the auction requires such permission and bears legal responsibility for this. The President of the City reserves the right to: - make changes to the auction announcement, including changing the date of the auction and the date of deposit payment. Any changes will be posted on the notice board at the City Hall in Dabrowa Gornicza, Graniczna Street 21 and published on the City Hall's website: (tab: News / Real Estate) and the Public Information Bulletin: (tab: Subject lists / Sale of real estate) - no later than 7 days before the auction date; - cancel the auction for important reasons, providing information about the cancellation of the auction to the public; - invalidate the auction without giving a reason. The right to announce a break in the auction for the purpose of, for example, verifying additional documents or information regarding the subject of the auction that arose after its opening is reserved by the Auction Committee. In the event of cancellation or invalidation of the auction (especially for reasons beyond the control of the President of the City), costs incurred by participants will not be refunded. Persons who are late for the opening of the auction, i.e. enter the room after the list of persons admitted to the auction has been read, may not be allowed by the Auction Committee to participate in the auction. Individuals participating in the auction should have an identity card or passport with them, and entities conducting business should additionally have a current extract from the relevant register. The State Treasury and the Municipality of Dabrowa Gornicza are not responsible for networks running through properties subject to auctions that are not disclosed on existing geodetic maps and documents. Regardless of the information provided above, the buyer is responsible for independently familiarizing themselves with the legal and factual status of the property and its current method of development, its parameters, and the possibility of development. Recognizing all factual and legal conditions necessary for the planned investment is entirely the buyer's responsibility and constitutes an area of their risk. For the purpose of possibly examining the land at their own expense, one should contact the Real Estate Management Department of the City Hall in Dabrowa Gornicza for permission to enter the area. All costs associated with the sale of the property (in particular: notarial, court, geodetic, including the possible indication of boundaries/indication of the location of boundary points), removal of any contamination from the property (including items left in buildings) and other things conflicting with the investment (including trees and shrubs) or demolition costs are borne by the buyer. The buyer will be obliged to submit a request for the removal of trees and shrubs from the property personally. The sale of the property will take place in accordance with the extract from the land register and the extract from the cadastral map. The buyer will be obliged to submit a statement in the notarial sale agreement that they will not make claims regarding any discrepancies in the type of uses and any difference in the area of the sold property if, after its sale, as a result of measurements made by an authorized surveyor, it turns out that the area of the property is different from its designation in the documents indicated above. The sale of the property will take place in accordance with the certificate issued by the Urban Planning Department regarding its designation in the local spatial development plan. The buyer will be obliged to submit a statement in the notarial sale agreement that they will not make claims regarding any discrepancies in the designation of the sold property in the local spatial development plan if, after its sale, as a result of geodetic works conducted in the area, it turns out that the boundaries of the property are also in the area of land with a different, neighboring designation. Before the opening of the auction: 1. The auction participant will be obliged to submit a statement (the statement form will be provided on the day of the auction): a. that they have familiarized themselves with the content of the full auction announcement, the factual and legal status of the property, and the auction conditions and accept these conditions without reservations, b. that they have familiarized themselves with the detailed conditions for the development of the subject property (including orders and prohibitions) specified in the provisions of the local spatial development plan applicable to this area, c. that they acknowledge that the sale of the property takes place in accordance with the extract from the land register and the extract from the cadastral map and undertake to submit in the notarial sale agreement a statement that they will not make claims regarding any discrepancies in the type of uses and any difference in the area of the sold property if, after its sale, as a result of measurements made by an authorized surveyor, it turns out that the area of the property is different from its designation in the documents indicated above, d. that they acknowledge that the sale of the property takes place in accordance with the certificate issued by the Urban Planning Department regarding its designation in the local spatial development plan and undertake to submit in the notarial sale agreement a statement that they will not make claims regarding any discrepancies in the designation of the sold property in the local spatial development plan if, after its sale, as a result of geodetic works conducted in the area, it turns out that the boundaries of the property are also in the area of land with a different, neighboring designation, e. I acknowledge that the State Treasury and the Municipality of Dabrowa Gornicza are not responsible for networks running through the property, not disclosed on existing geodetic maps and documents, f. whether they are a foreigner within the meaning of the Act of March 24, 1920 on the acquisition of real estate by foreigners, g. that based on Article 6 point 1 letter a of the GDPR, they consent to the processing of the provided data for the purpose of implementing the sale procedure of the subject property. If the auction participant is a person in a marriage, they will be obliged to submit a statement: 2. regarding the applicable marital property regime, 3. specifying the property (joint, personal) to which the acquisition of the property will take place. If the auction participant is a natural person, married under the community property regime, winning the auction will be obliged to conclude a notarial sale agreement jointly with their spouse or with their consent. In the absence of the spouse's consent to conclude the agreement, the deposit paid will not be refunded. If the statement of the auction participant being a natural person, married under the community property regime, regarding the acquisition of the property to personal property turns out to be incorrect and this fact comes to light after the auction is closed and the protocol is signed, the notarial sale agreement will not be concluded, and the deposit will be forfeited. If the auction participant is a natural person, married under the separation of property regime, they should present to the auction committee a copy of the notarial deed documenting the marital property agreement or a copy of the court ruling establishing the separation of property. The documents should be in original or copies certified as true to the original by, for example, a notary. 4. The auction participant will be obliged to submit a written information about the bank account number to which the deposit should be returned. 5. A foreigner is obliged to present registration documents from their country of origin, along with a certified translation into Polish. 6. Representatives of legal persons, civil partnerships, organizational units referred to in Article 331 §1 of the Act of April 23, 1964, the Civil Code, will be obliged to submit the appropriate document authorizing them to make declarations of will on behalf of these persons /partners/, required to participate in the auction. In the event that the auction participant is represented by an attorney, a notarial power of attorney is required, to the extent required to participate in the auction.
