The Mayor of the City of Lubawka

Announces the second unlimited tender (oral auction) for the sale

of real estate from the municipal property resources

The tender includes plot of land no. 86/4 with an area of 0.3159 ha built with a single-family residential building with a usable area of 66.8m2 located

in Chełmsko Śląskie at Podhalańska Street no. 4, Lubawka municipality, Kamienna Góra district, Lower Silesian Voivodeship. According to the spatial development plan, the plot is located in the E-Chełmsko Śląskie unit in the E-20 MN/MR/MP/U area. It is designated for multi-family or single-family housing of medium and low intensity, farm buildings, guesthouse housing, and services.

The property is located in the area of the historical urban layout of the village of Chełmsko Śląskie, legally protected by entry in the register of monuments under no. A/1809/368 by decision of November 25, 1956, and thus all actions within its scope are subject to the provisions of Article 36, paragraph 1 of the Act of August 26, 2024, on the protection and care of monuments (Journal of Laws 2024, item 1292).

The plot of land has a shape close to a rectangle and preserved proportions of the sides, the land is leveled. The property is built with a small single-family residential building and three wooden farm buildings. The single-family residential building, detached, was built in traditional technology in 2005. The building is not basement, has two above-ground floors (ground floor and usable attic). The building was used until 2016. The technical, functional, and environmental wear of the building was determined at the level of 40%.

The undeveloped part of the plot consists of land left without human intervention for about 10 years, which has overgrown with expansive species of grasses, shrubs, and deciduous and coniferous trees. At the northeastern boundary of the plot is a roadside cross on a pedestal - a monument. At the southern boundary of the plot is a concrete slab from a demolished utility room. The plot is equipped with an electrical network and water-sewage system. The plot is fenced only from the side of Podhalańska Street with a wooden fence.

The building has an energy performance certificate no. SCHE/20586/21/2024, according to which the annual demand for usable energy is: EU=108.66 kWh, for final energy: EK=173.93 kWh, for non-renewable primary energy: EP=240.98 kWh, the unit size of CO2 emissions is: 0.0611 t.

The first tender took place on May 22, 2025.

The second tender will take place on September 10, 2025, at 12:00 at the seat of the City Office of Lubawka - 1st floor, room no. 13.

For this property there is a land and mortgage register no. JG1K/00016915/1 in the District Court in Kamienna Góra, 4th Land and Mortgage Division. The buyer should separate and arrange a new land and mortgage register for the purchased property.

The starting price of the property is 661,628.80 PLN

The sale of the property is exempt from VAT based on Article 43, paragraph 1, point 10 of the VAT Act of March 11, 2004, on goods and services (Journal of Laws of 2024, item 361 with amendments).

The deposit of 5% i.e. 33,080.00 PLN must be paid no later than on September 2, 2025, to the account of the Municipality of Lubawka No. 30 1600 1462 1837 1762 8000 0004 maintained by BNP PARIBAS S.A.

The deposit should be paid for the specified subject of sale in cash. In the title of the payment, please write "Deposit for the tender for the sale of plot no. 86/4 built with a residential building located in Chełmsko Śląskie".

The date of payment of the deposit is considered to be the date of receipt of funds in the bank account of the City and Municipality of Lubawka.

The deposit paid in cash by the participant who won the tender is credited towards the purchase price of the property. The deposits of other tender participants are returned immediately to the account indicated by the payer, after the written instruction of the payer.

The deposit is forfeited in case of withdrawal of the participant who won the tender and did not appear to conclude the contract in the form of a notarial deed.

The deposit paid by other tender participants is returned no later than within 3 days from the date of closure or cancellation of the tender to the indicated bank account of the tender participant.

The minimum bid increment is 1% of the starting price rounded up to the nearest ten zlotys - 6,620.00 PLN.

The date for viewing the property is set for August 19, 2025 from 10:00 to 10:30 by prior telephone appointment at 516 318 126 or 516 318 335.

Persons participating in the tender for the purchase of the property must submit declarations that they are familiar with the way the purchased property is to be developed and that they have familiarized themselves with the conditions of the tender, the technical condition of the buildings and structures, and that all collisions arising during use or construction will be removed at their own expense and accept these conditions without reservations.

Individuals and legal entities may participate in the tender (they must present originals or certified copies of documents: partnership agreement, current extract from the relevant commercial register, not older than two months from the date of the tender, current list of partners and a resolution of the appropriate body of the legal entity allowing the purchase of the property - if required).

Foreigners who are not citizens or entrepreneurs of the member states of the European Economic Area may participate in the tender if they have permission from the Minister of Internal Affairs to acquire property in ownership or perpetual usufruct - on the terms specified in the Act of March 24, 1920, on the acquisition of real estate by foreigners (Journal of Laws of 2017, item 2278).

If legal entities or individuals act through proxies, the proxies are required to present a power of attorney to participate in the tender for the designated property with a signature certified by a notary.

Participants in the tender are required to present documents confirming their identity.

According to Article 41 of the Act of August 21, 1997, on real estate management, it is informed that if the person identified as the buyer of the property does not appear without justification to conclude the purchase agreement at the place and time specified in the notification, the organizer of the tender may refrain from concluding the agreement, and the paid deposit is non-refundable.

The Mayor reserves the right to cancel the tender, immediately providing information about the cancellation of the tender to the public in a customary manner.

The information also states the reason for the cancellation of the tender.

Notarial and court costs are borne by the buyers of the property.

In the 6-week period specified in the announcement of the property intended for sale, which is covered by this announcement, no applications have been received from persons entitled to priority acquisition under Article 34, paragraph 1, points 1 and 2 of the Act on real estate management (Journal of Laws of 2024, item 344).

Participation in the tender procedure involves the processing of personal data of the bidders on the principles specified in the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and to the extent resulting from the Act of August 21, 1997, on real estate management and the regulation of the Council of Ministers of September 14, 2004, on the manner and procedure for conducting tenders and negotiations for the sale of real estate.
