Judicial Officer at the District Court in Nowe Miasto Lubawskie Marcin Milcarek, announces to the public that
on 06-08-2025 at 10:00
the
first electronic auction
of the property located at; 13-324 Grodziczno, Montowo 11, for which the District Court in Nowe Miasto Lubawskie Land and Mortgage Register maintains the land and mortgage register number ELlN/0000xxxxx/1.
The subject of the auction is agricultural property with buildings consisting of land plots No. 207/3 and 207/4 located in the Warmian-Masurian Voivodeship, Nowe Miasto County, Grodziczno Commune, Montowo village The plots have a total area of 1.2939 ha. According to the data from the land and mortgage register, there is a discrepancy regarding the plot number - in the land and mortgage register, there is one plot number 207/2. Plot number 207/2 with an area of 1.2939 ha has been divided into two plots, whose total area is consistent with the area in the land and mortgage register. Plots No. 207/3 and 207/4 have direct access to the public road with an asphalt surface.
The property is built with a residential building and a farm building and is located in a dispersed building area of the village of Montowo. The nearest neighborhood of the property consists of residential buildings and agricultural land. The property has access to water and electricity infrastructure. Sewage to a local septic tank.
The residential building is located on plot No. 207/3 with an area of 0.1217 ha, the farm building is located on plot No. 207/4 with an area of 1.1722 ha.
The farm building occupies an area of 1203m2 (according to land records - symbol B-RIVa), the remaining part of plot No. 207/4 with an area of 1.0519 ha is used for agricultural purposes. The land is flat. The bonitation value of the agricultural land is good, mostly class IVa. The residential part built from the asphalt road has a fence made of masonry in part, wooden elements in part, and reinforced concrete elements in part, with a steel mesh on steel posts, there are two gates, one wooden and the other made of steel elements.

Technical description of the building: concrete foundations, walls made of slag block and brick, partially made of aerated concrete, insulated with polystyrene + mesh and glue, painted with facade paint, concrete ceiling over the ground floor, wooden ceiling over the attic finished on a wooden frame with panel board, insulated with mineral wool, multi-pitched roof with wooden structure, covered with boards and thermal welding paper, internal plaster on the ground floor cement-lime leveled with gypsum, in the attic cement-lime plaster leveled with gypsum, on the slopes panel board, internal walls in the attic of wooden structure covered with panel boards, internal wooden doors, typical wooden external doors, PVC windows, bathroom on the ground floor fully equipped, equipped with a bathtub, shower cabin, toilet, and sink, walls and floor finished with tiles, bathroom in the attic finished, equipped with a shower cabin, toilet, and sink, stairs to the attic concrete, gutters in 1/2 PVC, in 1/2 to be completed. The technical condition of the building is assessed as good.
The farm building - brick, detached, single-storey with part of the usable attic - attic, in the shape of the letter L according to data from land and building records consists of three connected buildings forming one body. Building area 95.00 m2 (former barn) with 1 storey with a 2-pitched roof covered with asbestos; building area 53.00 m2 with 2 storeys (ground floor and attic) with a 2-pitched roof covered with asbestos; building area 37.00 m2 with 1 storey part extended finished with a roof covered with trapezoidal sheet metal, inside the room renovated after 2016.
Technical description of the building - concrete foundations, walls made of slag block and other building materials partially insulated from the side of the municipal road, poured concrete ceiling, in part suspended light ceiling insulated with polystyrene, in part with wool, roof with wooden structure, multi-pitched, covered with asbestos, in the recently renovated part finished with trapezoidal sheet metal, internal plaster cement-lime, in part finished with gypsum board, in part with reclaimed panels, cold room insulated from the inside and finished with PVC panels. external plasters are mostly missing in the recently renovated part, the wall from the street insulated with polystyrene + mesh glue and smooth external plaster, internal wooden and panel doors, wooden gates, wooden and PVC windows in the recently renovated room, concrete floors, in the recently renovated part finished with panels, gutters made of galvanized sheet metal, installations: electrical, connection from the power grid, water from the water supply network, sewage to a local septic tank. The technical condition of the building is assessed as average.

The property is valued at 504,000.00 PLN. The starting price is three-quarters of the estimated value, i.e. the amount of 378,000.00 PLN.
The bidder participating in the auction should submit a deposit of 1/10 of the estimated amount, which is 50,400.00 PLN.
The property can be viewed within two weeks before the auction from 10:00 to 18:00. The sale by electronic auction is conducted through the IT system available at: elicytacje.komornik.pl.
Participation in the auction requires registration in the IT system servicing electronic auctions available at: elicytacje.komornik.pl 2 working days before the auction starts. The condition for participation in the auction is to create an individual account in the IT system. The deposit must be paid to the judicial officer's bank account number: PKO BP SA 85 10203583 0000 3802 0011 2938 no later than 2 working days before the auction starts. The date of the deposit is considered the day the judicial officer's bank account is credited. The provisions of Article 964 of the Code of Civil Procedure do not apply.
Along with the deposit, the bidder is obliged to provide in the IT system the data necessary to issue a decision on the award: PESEL number, identity document number, and a statement of whether they are married, and if so, whether they intend to acquire the property for joint or personal property.
The judicial officer confirms the fact of submitting the deposit and providing the data immediately after receiving them by allowing the bidder to participate in the auction. The auction starts and ends at the time indicated in the notice of the auction of the property.
The rights of third parties will not be an obstacle to the auction and awarding ownership to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to release the property or items seized with it from execution and obtained a judgment suspending the execution in this regard.
Use, easements, and rights of a lifetime, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of execution.
