NOTICE OF THE FIRST AUCTION OF REAL ESTATE

IN THE FORM OF AN ELECTRONIC AUCTION - SIMPLIFIED

The Court Bailiff at the District Court in Grójec Robert Sienkiewicz based on art. 1013^ § 1 in conjunction with art. 867 § 1 in conjunction with art. 879' and subsequent acts of the law of November 17, 1964, Civil Procedure Code (hereinafter: CPC) announces to the public that on the portal e-licytacje.komornik.pl/

the first auction will start on September 18, 2025, at 12:00 and end on September 25, 2025, at 12:00

the first auction of a plot of 2 ha.

The subject of the auction will be the right of perpetual usufruct of the property until March 19, 2090 - a plot of land located in Kociszew, Grójec municipality, Mazowieckie voivodeship, plot no. 12/5, (district 0016), with an area of 2.0000 ha. (20,000 m²). The plot in the shape of a triangle includes, among others, a concrete block paving and a surface. The property is located along an asphalt road. (Grójec - Warka), in equipped areas with an energy, gas, and water supply network from its own water intake - a deep well. The plot has been drained. The immediate vicinity consists of undeveloped areas, partially wooded, scattered residential and farm buildings.

The area where the property is located is covered by a study of conditions and directions of spatial development, according to the study these are agricultural areas with the exclusion of orchards, (resolution no. XXX/229/12 of the Grójec City Council of September 10, 2012).

For the property, the District Court in Grójec, Land and Mortgage Register Department maintains a land and mortgage register with the number KW RA 16/000xxxx/3.

The estimated value is 156,500.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 117,375.00 PLN.

The minimum bid increment in the auction is 1,174.00 PLN. The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is 15,650.00 PLN, no later than 2 business days before the auction starts, i.e. by September 15, 2025, at 23:59. The deposit can be paid through the IT system. The deposit should be paid to the bailiff's office bank account: BNP Paribas Bank Polska S.A. 35 16001462 1853 6337 6000 0007. A condition for participation in the auction is to create an individual account in the IT system.

Along with the deposit, the bidder is obliged to provide in the IT system the data necessary to issue a decision on the award, including: PESEL number, identity document number, and other data. The following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, a bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission. In the last two weeks before the auction, the property can be viewed on weekdays. The valuation report is available at the bailiff's office.

The rights of third parties will not be an obstacle to the auction and the awarding of ownership to the buyer without reservations, if these persons do not submit proof before the auction starts that they have filed a lawsuit to release the property or items seized with it from enforcement and have obtained a judgment suspending enforcement in this regard. Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.

The buyer is obliged to pay the purchase price on the next day after receiving the notification of the award during the working hours of the bailiff's office or to the bailiff's bank account by 18:00 the next day. If this day falls on a Saturday or a public holiday, the price is paid on the next day after the day or days off. The purchase price can be paid through the IT system. The bailiff informs about the obligation contained in the Act of September 9, 2000, on the tax on civil law transactions (Journal of Laws of 2015, item 626). According to art. 4, the burden of tax obligation, subject to art. 5 of the act in the sale agreement - rests on the buyer. The auction may be canceled without giving a reason.

To participate in the auction, you must create an account in the National Bailiff Council e-auction service and participate in the auction by submitting and providing the appropriate data. The auction is conducted electronically. The bidder whose offer was the highest at the end of the auction wins. If within 5 minutes before the planned end of the auction a bid is submitted, this deadline is extended by 5 minutes. If further bidding is submitted during the additional time, the end of the auction is extended by another 5 minutes each time until bidding ceases.
