NOTICE OF SECOND AUCTION OF REAL ESTATE

BY ELECTRONIC AUCTION

The Court Bailiff at the District Court in Zgierz Michał Durański, Law Office No. II in Zgierz announces to the public that in case Ckm 5/23, an electronic auction will commence in the manner established in art: 985* § 4 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC)

second auction in electronic mode

of the following real estate:

- real estate located at Wyszyńskiego, 95-03 5 Ozorków, for which the District Court in Zgierz (address: ul. Sokołowska 6/., Zgierz, 95-100 Zgierz) maintains a land and mortgage register with the number LD1G/000XXXX/2.

Description of the property:

The property in question is a developed plot of land No. 285/3 with a total area of 0.0674 ha. The plot is characterized by high territorial compactness and a shape close to a rectangle with sides approximately 37 m and 18 m long. The property does not have access to a public road. The property is built with a building under construction, whose walls are situated on the boundaries of neighboring plots: 36, 284/2, 285/5. Fragments of the plot outside the building area (SE and SW) are overgrown with wild vegetation, several years of construction materials, and abandoned construction equipment.

The building in question is designed as a four-story building with usable attic. The ground floor of the building is entirely designated for commercial and service functions. Rooms are accessible from ul. Kard. St. Wyszyński and from ul. Południowa. The building is designed with two staircases, one of which is accessible from both sides. The ground floors are intended for commercial and service areas, the building is partially basement, with auxiliary rooms for commercial and service functions and a billiard room planned in the basement level.

On the remaining above-ground floors, residential units are designed. The apartments have been designed with the possibility of variant functional solutions. The possibility of these solutions at the stage of the building project excludes changes made during implementation and increases the attractiveness of the sold residential units.

Technical parameters of the building: Building area: 484.68 m2, Usable area: 1703.28 m2, Volume: 7200.0 m3, Total area - structure: Basements: 212.95 m2, Ground floor: 384.02 m2, 1st floor: 388.92 m2, 2nd floor: 388.29 m2, 3rd floor: 388.92 m2 Construction work was halted before the completion of the investment process in December 2010 - according to information from the Building Supervision Inspector, the last entry was made in the construction log at that time.

The state of investment progress: the building has been completed to an open shell state, without a roof and its covering (which may be defined for this state as temporary covering). This means that it is an incomplete open shell state.

The estimated value of the property is 3,241,050.00 PLN (three million two hundred forty-one thousand fifty zlotys) - represents the market value of the property in the amount of 2,635,000.00 PLN increased by 23% VAT in the amount of 606,050.00 PLN.

The starting price is equal to 2/3 of the estimated amount and is 2,160,700.00 PLN. The sale of the goods is subject to VAT at the rate of 23%. The amount presented above is the gross amount.

Within two weeks before the auction, the above-mentioned property can be viewed on weekdays from 10:00 AM to 2:00 PM. The protocol of description and valuation is made available in the IT system.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated amount, which is the amount of 324,105.00 PLN. The deposit should be paid to the bailiff's bank account 88 1020 3440 0000 7902 0015 9996 no later than 2 business days before the auction starts.

The auction will take place in the mode of real estate sale by electronic auction and will start on: 18.09.2025 at 11:00 AM and will end on 25.09.2025 at 11:00 AM.

Based on art. 966^ § 3' CPC, if within 5 minutes before the planned end of the auction a bid is submitted, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until the bids cease. The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at // . and joining the auction two business days before it starts. The bidder submits the deposit no later than 2 business days before the auction starts, and if participating in the auction as an attorney for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place. Based on art. 936* § 2 CPC, the condition for participation in the auction is the creation of an individual account in the IT system.

The rights of third parties will not hinder the auction and the awarding to the buyer without reservations, if these persons do not submit proof before the auction starts that they have filed a lawsuit to release the items from enforcement and obtained a judgment suspending the enforcement in this regard. Usufruct, easements, and rights of a lifetime, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.

According to art. 976 CPC, the debtor, bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, and persons who can acquire the property only with the permission of a state authority, and who have not presented this permission, may not participate in the auction. According to art. 18 of the Goods and Services Tax Act (Journal of Laws No. 54, item 535), court bailiffs performing enforcement actions within the meaning of the provisions of the civil procedure code are payers of tax on the supply of goods made in the course of enforcement, goods owned by the debtor or held by them in violation of applicable regulations. According to art. 106 c point 2 of the Goods and Services Tax Act, invoices documenting the supply of goods referred to in art. 18 of the cited act, for which the debtor has a tax obligation, are issued on behalf of and for the debtor by court bailiffs performing enforcement actions within the meaning of the provisions of the civil procedure code.
