via electronic auction

Court Bailiff at the District Court in Leczyca Aneta Ruszczyk based on Article 986[4] § 3 of the Code of Civil Procedure announces to the public that through the teleinformatics system available at the address: e-licytacje.komornik.pl there will be

the first auction of real estate

undeveloped land located in the village of Ostrowy, the municipality of Nowe Ostrowy, Kutno County, Lodz Voivodeship, on the plot marked with the registration number 113/2 with an area of 1.2680 ha, for which the District Court in Leczyca IV Land and Mortgage Register Department maintains the land and mortgage register number KW LD1Y/00xxxxxx/5

The property is located in an area marked with the symbol 3U - service development areas. The property is undeveloped, unconnected (there is a possibility of bringing utilities), unutilized and unfenced, with direct access via an asphalt road. NOTE: there is a discrepancy between the area of the property disclosed in the land and mortgage register (1.2681 ha) and in the information about the plot (1.2680 ha). The area from the information about the plot was accepted for valuation.

The estimated value is 334,750.00 PLN gross (including the applicable VAT), while the starting price is equal to 3/4 of the estimated value and amounts to 251,062.50 PLN.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is 33,475.00 PLN.

The auction will take place via electronic auction and will start on 16-09-2025 at 10:00 and will end on 23-09-2025 at 12:00.

According to Article 986(5) § 1 of the Code of Civil Procedure, the deposit must be submitted to the bailiff's bank account; Powszechna Kasa Oszczędności Bank Polski SA O. Centrum in Zgierz 10 10203440 0000 7502 0016 0044 no later than 2 business days before the auction starts, i.e. by 11-09-2025 at 23:59. The date of deposit submission is considered the day the bailiff's bank account is credited. According to Article 986(5) § 2 of the Code of Civil Procedure, along with the deposit, the bidder is obliged to provide in the teleinformatics system the data necessary to issue a decision on the award; PESEL number, identity document number, and a statement on whether they are married, and if so, whether they intend to acquire the property for joint or personal property, as well as to indicate whether they are bidding in their own name or as an attorney for another person, and other data if the need to provide them arises from the provisions of separate laws. The bailiff confirms the fact of deposit submission and data provision mentioned in § 2 immediately after receiving them by allowing the bidder to participate in the auction. In case of refusal to allow participation in the auction, the interested party is notified via the teleinformatics system.

If necessary, the bailiff immediately calls the bidder, under the threat of exclusion from participation in the auction, via the teleinformatics system to complete the data, and if participation in the auction requires permission from a public authority or proving authorization to act on behalf of another person - to submit electronic copies of the required documents within 3 days, no later than the day before the auction date. The condition for participation in the auction is to create an individual account in the teleinformatics system.

The method of conducting the sale of real estate via electronic auction and the method of authenticating users of the teleinformatics system servicing the electronic auction is specified in the regulation of the Minister of Justice on the method of conducting the sale of real estate via electronic auction and the method of authenticating users of the teleinformatics system servicing the electronic auction dated 27-10-2021. The auction starts and ends at the time indicated in the auction notice. During the auction, bidders offer the purchase price via the teleinformatics system. If a bid is submitted within 5 minutes before the planned end of the auction, this time is extended by 5 minutes. If further bids are submitted during the additional time, the end time of the auction is extended by another 5 minutes each time until the bids cease.

The auction is won by the bidder whose offer was the highest at the time of the auction's conclusion. After the auction, the bailiff informs the bidders via the teleinformatics system about the selection of the bidder offering the highest price at the time of the auction's conclusion. The following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, a bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a public authority, and who have not presented this permission. The presence of one bidder is sufficient for the auction to take place. The power of attorney to participate in the auction must be confirmed by a document with an officially certified signature. Signatures on powers of attorney granted by state organizational units or local government organizational units and on powers of attorney granted to lawyers or legal advisors do not require certification.

In the last two weeks before the auction, the property can be viewed on weekdays from 10:00 to 14:00 and the bailiff's office can be reviewed for a copy of the property valuation protocol, the expert's valuation report, and an excerpt from the land register along with a map from the enforcement proceedings.

The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to exempt the property or items seized with it from enforcement and have obtained a ruling in this regard suspending enforcement. Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.
