SALE BY FREE HAND

RESIDENTIAL PROPERTY

("REGULATIONS")

§1

1. This sale by free hand is conducted in connection with ongoing proceedings

before the District Court for Krakow – Srodmiescie in Krakow VIII Economic Department for bankruptcy and restructuring proceedings of Maciej Krynicki – a natural person not conducting economic activity.

2. The sale is conducted by Maciej Strosznajder – the Trustee of the bankruptcy estate of Maciej Krynicki, license no. 629.

3. The sale of the property occurs based on the Act of February 28, 2003, Bankruptcy Law (hereinafter referred to as "BL") and the Act of April 23, 1964 –

the Civil Code (hereinafter referred to as "CC"). Sales made in bankruptcy proceedings have the effects of enforcement sales (art. 313 sec. 1 BL).

4. Bankruptcy proceedings are conducted based on the IT system called the National Register of Debts.

5. Process documents and documents containing non-public information within the meaning of the Act of August 5, 2010, on the protection of non-public information (Journal of Laws of 2019, item 742, as amended) and also offers submitted during the tender or auction are submitted

excluding the IT system serving the court proceedings (art. 216ab BL).

§2

1. The subject of the sale is a residential property at ul. Kolonia Rospontowa 8/1 in Chrzanow, with a usable area of 42.13 m², constituting a separate property, associated with a share: 101/1000 in the shared property; for which this property the District Court in Chrzanow – V Real Estate Register Department maintains the land and mortgage register number KR1C/00056784/8

2. The property is occupied by the bankrupt.

3. The starting price of the sale item is 146,063.25 PLN

4. The property valuation report can be reviewed at the office of the Restructuring Advisor Maciej Strosznajder, ul. Gen. Tadeusz Kosciuszko 36a in Chrzanow, from Monday to Friday from 12:00 PM – 5:00 PM, after prior telephone contact at: 502482666. 5. The condition of the property can be inspected after prior telephone appointment with the Trustee.

§3

1. Offers must be submitted in paper form to the address of the trustee’s office by 15:00 on July 22, 2025.

2. Offers sent by post are considered submitted on time if received by the Office by 15:00 on July 22, 2025.

3. Offers must be submitted in sealed envelopes with a note "Offer for purchase of property in bankruptcy proceedings KR1S/GUp-s/925/2023" along with the note: "DO NOT OPEN''.

The envelope should contain the exact identification of the offeror, i.e., first name and last name or company name and address of residence/headquarters.

§4

1. Each offer must contain:

a) exact identification of the offeror (first name and last name or full name indicating legal form, address of residence or headquarters);

b) identification of the person representing the offeror and their phone number;

c) proposed purchase price, which cannot be lower than the starting price;

d) statement that the offeror has read the sale regulations, meets the conditions specified in these regulations and accepts the contents of the regulations,

e) statement that the offeror commits to cover all costs related to the purchase;

f) statement that the offeror has familiarized themselves with the current legal status of the property and does not raise any objections in this regard;

g) handwritten signature.

2. The offer must include:

a) an extract from the relevant register or records (in the case of entrepreneurs);

b) permits required by the Commercial Companies Code authorizing the company’s bodies to acquire the sale item;

c) a document confirming the authorization of the person signing the offer to represent the offeror.

§5

1. The condition for participation in the bidding competition is to pay a deposit of

10% of the sale price, i.e., 14,606 PLN

2. The deposit should be paid by bank transfer to the following account: 08 1140 2004 0000 3702 8219 1500 titled "Deposit – case reference KR1S/GUp-s/925/2023" no later than the last day of the deadline for submitting offers, where the actual date of acknowledgment of the deposit amount on the above account is counted.

3. In the case of later selection of the offer, the deposit paid will be offset against the purchase price.

4. If the offer is not selected, the deposit will be returned to the account from which the funds arrived within 7 days from the date of opening offers.

§6

1. Detailed information regarding the sale will be provided to interested parties under the information held by the Trustee at the email address

and phone number tel.: 502 482 666.

§7

1. Opening of offers will take place the day after the deadline for submitting offers

i.e., July 23, 2025, at 3:30 PM at the Office of Trustee Maciej Strosznajder

(ul. Gen. Tadeusz Kosciuszko 36a, 32-500 Chrzanow).

2. The selection of the offer is made by the trustee based on the price criterion.

3. The offeror whose offer is selected will be immediately notified.

4. Offers that do not meet the requirements of these Regulations, as well as unreadable or incomprehensible offers will not be recognized.

§8

1. The trustee selects the offer with the highest price.

2. If two or more identical offers are submitted meeting the conditions of these Regulations, i.e. two identical highest prices, the trustee invites the offerors to submit further offers, setting a deadline not exceeding 14 days until the selection of the most advantageous offer.

3. If the highest offer is not selected, the trustee will annul the proceedings and publish another announcement regarding the sale.

§9

1. The offeror whose offer is selected is obliged to pay the purchase price reduced by the amount of the deposit no later than on the day of signing the deed of property transfer. Payment is considered timely if the funds reach the account indicated by the trustee. The funds must be credited to the account before the notarial deed is signed.

2. The sale agreement will be signed after the full price is paid by the offeror.

3. The sale agreement will take place in the form of a notarial deed before a notary chosen by the trustee.

4. All costs related to closing the sale agreement shall be borne by the buyer.

5. Failure to attend the notarial deed will result in the forfeiture of the deposit in favor of the bankruptcy estate.

§10

The trustee reserves the right:

1) to cancel the sale or its annulment without giving reasons;

2) to hold an auction in case of submission of offers by more than one offeror;

3) to request additional information from offerors or to complement documents.

§11

In matters not regulated by these Regulations, the provisions of the Bankruptcy Law and the Civil Code shall apply.
