The bankruptcy administrator Justyna Kucejko-Kowalczyk, leading the bankruptcy proceedings of a natural person in bankruptcy marked as case no. LD1M/GU/813/2024, informs about the sale by free hand in a competitive bidding procedure for the highest offered price of no less than 332,000 PLN (three hundred thirty-two thousand zlotys)
1) The property is marked as number 17 with a usable area of 42.42 m2, located on the 3rd floor of the building at Armii Krajowej 14 in Lodz, in the geodetic precinct P-24, in the resources of the Housing Cooperative “Retkinia Poludnie”. The building is marked as block 211.

2) For the commercial property, the District Court for Lodz-Srodmiescie in Lodz, XIV Land and Mortgage Register Division is conducting case no. LD1M/00203137/6. The residential unit consists of 2 rooms, a kitchen, a bathroom, a toilet, and a hallway.

Based on the decision of the District Court for Lodz-Srodmiescie, XIV Economic Division for Bankruptcy and Restructuring案件, case no. LD1M/GU/813/2024, the bankruptcy administrator invites you to submit offers - starting price of 332,000 PLN (three hundred thirty-two thousand zlotys gross)

Subject to the following conditions:
1. Participants in the competition may be domestic and foreign individuals and legal entities, as well as organizational units with legal capacity and capacity to perform legal actions. Foreign entities must possess the permission of the minister responsible for internal affairs for the acquisition of real estate, in accordance with the applicable regulations of the Act of March 24, 1920, on acquiring real estate by foreigners.
2. The offer must be submitted in writing only in Polish, either personally or by registered mail, in a sealed envelope clearly marked: “Offer for sale of bankruptcy estate components marked as LD1M/GU/813/2024 - DO NOT OPEN” by June 25, 2025, by 10:00 AM at the Bankruptcy Administrator's Office in Lodz, Radwanska 22 lok 2, 90-541 Lodz

4. The written offer, under penalty of rejection, should include:
a) the name and address of the firm, and for individuals – the first name, surname, and address of residence of the offeror,
b) in the case of bidders that are not individuals, a current extract from the appropriate register confirming the right to submit binding declarations of will on behalf of the given entity by the person who signed the offer, and if the offer is signed by an attorney, then also a power of attorney signed according to the rules of representation. Power of attorney to participate in the bidding and to submit declarations required by these sale conditions must be confirmed by a notarized document. A power of attorney granted to attorneys does not require such certification. Foreign attorneys should submit confirmation of their registration on one of the lists of foreign lawyers maintained by local bar councils in Poland.
c) the offered purchase price expressed in figures and words, which cannot be lower than the indicated starting price, the method, and the date of payment
d) the purchaser's obligation to cover the costs, taxes, and fees associated with concluding the contract
e) a declaration that the offeror has familiarized themselves with the factual and legal status of the subject of sale, accepts it, does not raise any objections, and waives any future claims in this regard, and also, that there are no factual or legal reasons that would limit or prevent the conclusion of the contract if their offer is chosen
f) evidence of payment of the earnest money and indication of the bank account number to which the earnest money is to be returned in case of rejection of the offer
g) declaration of readiness to conclude the contract in the event of winning the bid, at a place and time indicated by the administrator
h) declaration of having read the sale rules (competition for offers) and acceptance without objections
i) all permits and approvals, if required by law due to the nature of the purchaser
j) the offeror should demonstrate that they have the financial means enabling the purchase

5. The offer, or any statement contained therein may not be submitted conditionally, nor may they be variant. The participant in the bidding is bound by the offer until the expiry of the deadline set by the administrator for the conclusion of the contract;

6. The sale price of the real estate, minus the earnest money paid, should be deposited and credited to the bankruptcy estate’s bank account no later than one day before the date of concluding the sale contract;

7. All costs of concluding the sale contract, including the tax on civil law transactions, notary fees, and court fees, are borne by the purchaser. If the provisions of the VAT Act stipulate this, the VAT will be added accordingly to the sale price. From the moment of concluding the contract in the form of a notarial deed, the purchaser acquires the proceeds, taxes, and other public levies due from the subject of sale; recurrent public law obligations are borne by the purchaser only when their payment falls on the date of concluding the contract in the form of a notarial deed or after that date;

9. The Syndicate reserves the right to cancel the competition, withdraw from the competition and withdraw from the sale at any stage without providing a reason and without public notification, as well as to change the announcement or change the terms of the competition.
