THE STAROSTA OF ZAGAN ACTING ON BEHALF OF THE TREASURY OF THE STATE based on Article 38 sec. 1 and 2 of the Act on Real Estate Management of August 21, 1997 (Journal of Laws 2024.1145 as amended) announces the second unlimited oral auction for the sale of the perpetual usufruct right of the State Treasury to the property built owned by the Municipality of Szprotawa. 1. The subject of the auction is: Ø Precinct 0001 of the city of Szprotawa plot no. 302 with an area of 0.0924 ha, marked with the use Bi (other built-up areas). The property constitutes a partially paved access road with cobblestones and concrete slabs, rectangular and elongated in shape. The property in the southern part is built with a production and warehouse building, single-storey, brick, plastered, with a gable roof covered with roofing felt, the roof covering is tight. The building is mostly devoid of entrance gates and doors. Utilities are supplied to the facility: E, G, K, W. Inside, the hall is divided into 4 segments. Concrete floors. Most of the equipment has been dismantled, only a few pieces of furniture remain, the rooms are plundered and damaged. Ø Precinct 0001 of the city of Szprotawa plot no. 299/12 with an area of 0.3258 ha, marked with the use Bp (urbanized undeveloped areas or under construction). The property constitutes land approximately 25% paved with concrete slabs, there is a weighbridge sunk into the ground on the plot. The remaining part of the plot is biologically active, covered with grassy vegetation. The shape is polygonal, close to rectangular. The property in the southern part is built with a production and warehouse building. Ø Precinct 0001 of the city of Szprotawa plot no. 299/10 with an area of 0.0158 ha, marked with the use Bp (urbanized undeveloped areas or under construction). The property is undeveloped, there is a double concrete power pole located on it. The shape is a regular rectangle. 2. KW ZG1G/00048784/5 – the property is encumbered with a limited property right related to another property – a free and unlimited time easement consisting of the right of free passage and transit through plots no. 299/10, 299/12, and 302, the right to conduct power lines, water and sewage, and gas through the encumbered property, as well as the right of free access and use of devices supplying electricity, water, sewage, and gas, located on plot no. 302. For the property (another) a land and mortgage register no. ZG1G/00055158/0 is maintained. 3. Based on the change of the "Study of conditions and directions of spatial development of the city and municipality of Szprotawa" adopted by the City Council in Szprotawa on July 26, 2024, by resolution no. VI/30/2024, the properties marked in the land registry as plots 299/10, 299/12, and 302 located in precinct 0001 of the city of Szprotawa have the function of industrial, storage, and warehouse areas. 4. The owner of the land property is the Municipality of Szprotawa. The building - production and warehouse hall with a volume of 3214 m3 and a building area of 742 m2 as well as devices in the form of a weighbridge and a gas reduction station - a metal gas box mounted on the building - closed, no possibility of opening it. The area of all properties is flat, on the day of inspection contaminated with heaps of soil mixed with ceramic and concrete construction waste. Direct access to the public road, in the vicinity of industrial and service buildings, multi-family residential, and partially commercial. The property is subject to annual fees for the perpetual usufruct of the land in the amount of 370.30 PLN (as of 01.01.2025) to the City Hall in Szprotawa. The percentage rate of the fee for perpetual usufruct is 3%. The period of perpetual usufruct - 2091-11-24. 5. Starting price: 1,500,000.00 PLN Deposit: 80,000.00 PLN The first auction took place on July 17, 2025, at 9:00 AM, the second unlimited oral auction will take place on September 19, 2025, at 9:00 AM at the seat of the District Office in Zagan at ul. Jana Pawla II 9, room 104. The condition for participation in the auction is the payment of the deposit by September 15, 2025, and by that date it must be in the account of the District Office in Zagan - PKO Bank Polski S.A. 96 1020 5402 0000 0602 0336 8206. The paid deposit is subject to: - inclusion in the purchase price of the property in case of winning the auction, - forfeiture in case of the participant who won the auction withdrawing from the contract, - refund within 3 days after the closing, cancellation, invalidation, or negative result of the auction. Persons entitled to compensation for leaving the property outside the current borders of the Republic of Poland as a result of expulsion from the former territory of the Republic of Poland or leaving it due to the war that began in 1939 are exempt from the obligation to pay the deposit within the deadline specified in the auction announcement if they report participation in the auction by September 15, 2025, present the original certificate or decision confirming the right to include the value of the property left outside the current borders of the Republic of Poland and submit a written commitment to pay an amount equal to the amount of the deposit established in case of withdrawing from the contract. The property is sold based on data from the land and building registry consistent with the extract from the land registry map. In the event of a possible boundary renewal carried out at the buyer's expense and effort, the Starosta of Zagan is not responsible for any discrepancies. A person participating in the auction must present an identity document, and a person representing a natural or legal person in the auction must present the appropriate power of attorney with a notarized signature, spouses with statutory community property participate in the auction personally or by presenting a power of attorney from the spouse containing consent to the paid acquisition of the property. Entities that are foreigners must demonstrate the appropriate permit issued under the provisions of the Act of March 24, 1920, on the acquisition of real estate by foreigners (Journal of Laws 2017.2278 consolidated text). The auction price of the property is subject to payment in such a way that the required amount is in the account of the District Office at the latest the day before the conclusion of the notarial deed. The costs associated with the preparation of the notarial deed and court fees are borne by the buyer. Failure to meet the deadline for concluding the sale agreement results in the forfeiture of the deposit, and the auction is deemed null and void. The buyer will be notified of the date of concluding the sale agreement in the form of a notarial deed within 21 days from the date of the auction resolution.
