THE PLOT IS BETWEEN ZBIKOWSKA STREET AND ROUTE A2. THE PLOT IS SOLD IN ITS ENTIRETY. A shapely and wide plot, approximate dimensions 32m x 486m, located almost perpendicular to the expressway, about 45m along the route. The plot is covered by three development plans. SELECTED PROVISIONS FROM THE DEVELOPMENT PLAN FOR THE SUBJECT PLOT, looking from Route A2 towards ZbiKowska Street; 1. PART OF THE PLOT NEAR ROUTE A2 establishes the purpose of services and production facilities as well as storage functions. In terms of dividing the property into plots, a new division is established for plots provided that the following conditions are met: a) the width of the plot front is not less than 30m, b) the area of the plot is not less than 2000m2, c) the angle of the plot boundaries in relation to the road lane is in the range of 45° - 135°, and other conditions detailed in the development plan. In terms of land development, it is established: 1) unexceedable building lines according to the markings on the plan drawing; 2) the building area not exceeding 70% of the area of the plot or land property; 3) biologically active area not less than 20% of the area of the plot or land property; 4) the location of parking spaces within the plot, in an amount resulting from the functional needs of the facility, not less than: a) 1 space for every 50m2 of usable service area, b) 20 spaces for 100 employees. In terms of shaping new buildings, it is established: 1) the height of buildings not exceeding 15m; 2) allowing for an increase in the height of accompanying elements and devices, the height of which results from technological requirements; 3) roofs with a slope from 0° to 45°; 4) for new facilities intended for permanent residence of people within the forecasted zone of noise level exceeding the permissible level for residential buildings, the obligation to use technical solutions (e.g. internal and external partitions, building elements with increased insulation or other solutions to protect against noise and vibrations), limiting negative impacts and threats associated with the impact of the communication system. 2. THE MIDDLE PART OF THE PLOT establishes the purpose of service and single-family residential development. It allows for the resignation of services in favor of residential functions or resignation of residential functions in favor of services. In terms of dividing the property into plots, a new division is established for plots provided that the following conditions are met: a) the width of the plot front is not less than 20m, b) the area of the plot is not less than 1500m2, c) the angle of the plot boundaries in relation to the road lane is in the range of 45° - 135°, d) ensuring access to the public road; In terms of land development, it is established: 1) unexceedable building lines, marked on the plan drawing; 2) the building area not exceeding 40% of the area of the plot or land property; 3) biologically active area not less than 30% of the area of the plot or land property; 4) the character of residential buildings is free-standing. It allows for buildings in a semi-detached development in the case of joint development of neighboring plots; 5) the location of service and residential functions within one object or separate objects; 6) garages integrated with residential or service buildings. It allows for independent garage buildings located on the plot or directly at the plot boundary; 7) utility rooms in residential buildings. It allows for independent utility buildings or integrated with garage buildings, located on the plot or directly at the plot boundary; 8) the location of parking spaces within the plot, in an amount not less than: a) 2 spaces for 1 residential unit, b) 1 space for every 50m2 of usable service area. 8) In terms of shaping new buildings, it is established: 1) the height of buildings: a) residential not more than 2 above-ground floors (including usable attic), not exceeding 10m, b) service not more than 2 floors, not exceeding 12m, c) garages and utility buildings not more than 1 floor, not exceeding 4.5m; 2) roofs with a slope from 0° to 45°. 3. THE PART OF THE PLOT ON THE SIDE OF ZBIKOWSKA STREET establishes the purpose of single-family residential development. It allows for non-intrusive service functions, in a commercial premises separated in a residential building, with a total area not exceeding 30% of the total area of the building. In terms of dividing the property into plots, a new division is established for plots provided that the following conditions are met: a) the width of the plot front is not less than 18m, b) the area of the plot is not less than 700m2, c) the angle of the plot boundaries in relation to the road lane is in the range of 45° - 135°, d) ensuring access to the public road; 2) allowing for the separation of plots smaller than specified in point 1: a) intended for internal roads, b) for the location of technical infrastructure devices, with direct access from the public road, c) for the purpose of enlarging the neighboring plot (subdivision); 3) the possibility of development on smaller plots, separated on the basis of valid administrative decisions issued before the entry into force of the plan. In terms of land development, it is established: 1) unexceedable building lines, according to the marking on the plan drawing; 2) the building area not exceeding 40% of the area of the plot or land property; 3) biologically active area not less than 30% of the area of the plot or land property; 4) the location on the plot of no more than one residential building; 5) the character of residential buildings is free-standing. It allows for buildings in a semi-detached development, in the case of joint development of neighboring plots; 6) prohibition of the location of free-standing service buildings; 7) garages integrated with residential buildings. It allows for independent garage buildings, located on the plot or directly at the plot boundary; 8) utility rooms in residential buildings. It allows for independent utility buildings or integrated with garage buildings, located on the plot or directly at the plot boundary; 9) the location of parking spaces within the plot in an amount not less than: a) 2 spaces for 1 residential unit, b) in the case of services, 1 space for every 30m2 of usable service area. 5. In terms of conditions for existing development, it allows for the retention of existing buildings and functions, with the right to reconstruct, expand, raise, rebuild, and adapt, in accordance with the provisions of the plan. In terms of shaping new buildings, it is established: 1) the height of buildings: a) residential not higher than 2 above-ground floors (including usable attic), not exceeding 10m, b) service not higher than 2 above-ground floors, not exceeding 12m, c) garages and utility buildings not higher than 1 floor, not exceeding 4.5m; 2) roofs with a slope of 0°-45° (when using mansard roofs, other slopes of roof surfaces are allowed, according to their form and construction). 7. Within the existing drainage on the areas referred to in paragraph 1, the provisions contained in §11 of the resolution apply. 8. The communication service of the areas is established from the adjacent streets.
